Dear Mr. Jerke:
On March 1, 1996, the Weld County Board of Commissioners received your letter requesting
a reconsideration of a recent decision regarding time limitations on recorded exemptions (RE).
The decision to modify the recorded exemption procedure was arrived at through a lengthy
citizen participation process. The 13-member volunteer Comprehensive Plan Advisory Board
conducted over 30 meetings concerning revisions to the Weld County Comprehensive Plan.
All these meetings were open to the public. It was the unanimous consensus of the advisory
board to modify time limitations on the RE process. Additionally, the Weld County Planning
Commission voted to recommend approval of Ordinance 173-C (modifications to the RE
process) to the Board of County Commissioners. At the October 25, 1995, Board of
Commissioners meeting, the first reading of Ordinance 173-C occurred. This was followed by
two more public hearings in front of the county commissioners. Despite being publicized four
times in its entirety, no citizens spoke against the ordinance in front of either the Planning
Commission or the Board of County Commissioners.
While the Board of County Commissioners has chosen to continue to support the present land
use system, we would like to commend you for taking the time to voice your opinion. We
would also like to point out that the RE process is not the only alternative for development or
division of land. Furthermore, in an effort to recognize unique circumstances for individuals
seeking to expand opportunity or to avert personal financial calamity, the board constantly
scrutinizes all county land use policies. In the future, as the board endeavors to streamline
regulations and improve the land use process, we welcome your constructive ideas.
