RE: BALLOT ISSUE PURSUANT TO ARTICLE X, SECTION 20 OF THE COLORADO
CONSTITUTION FOR WELD COUNTY DELWOOD AVENUE LOCAL IMPROVEMENT
DISTRICT 1995-2
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has the authority to create Local
Improvement Districts pursuant to C.R.S. § 30-20-601 et seq., and
WHEREAS, Article X, Section 20 of the Colorado Constitution may require an election prior
to assessments being levied under a Local Improvement District and approval by vote of the
registered electors who are owners of property within or residents of the District, and
WHEREAS, it is necessary to set the ballot issue language for the general election to be
conducted November 7, 1995.
NOW, THEREFORE, BE IT RESOLVED that the issue of imposing assessments for the
Weld County Delwood Avenue Local Improvement District Number 1995-2 be placed on the ballot
for the November 7, 1995, election with those persons eligible to vote being registered electors who
are owners of property within or residents of the District.
BE IT FURTHER RESOLVED that the ballot issue shall read as follows:
Shall taxes (in the form of a one-time special assessment) be
increased $33,320 or such lesser amount as may be necessary to
pave certain roads and streets within Weld County Delwood Avenue
Local Improvement District 1995-2, to be established pursuant to
C.R.S. § 30-20-601, et seq., which shall include those 17 Lots
adjoining Delwood Avenue between East 18th Street and U.S.
Highway 34 as shown in the Plat of Lindale Subdivision, and the
Replat of a Part of Lindale Subdivision as recorded under Reception
Numbers 1201268 and 1722678, respectively, of the records of the
Weld County Clerk and Recorder, for purposes other than
enterprises, said assessments to be against the described lots in an
amount not to exceed $1,960 per lot payable in the year 1996 or
over a ten-year period at an interest rate of 6.25%; said
assessments to be collected and spent by the District for the paving
of Delwood Avenue without regard to any expenditure, revenue
raising, or other limitations contained within Article X, Section 20 of
the Colorado Constitution?
