Ladies and Gentlemen: We enclose our application for Use by Special Review Permit pertaining to conversion of existing oil and gas wells and related storage facilities to produced water disposal facilities. The application covers an existing well that has received a permit for operation from the Colorado Oil and Gas Conservation Commission ("COGCC") and a proposed well on the same site. As we have discussed with Lee Morrison, Assistant Weld County Attorney, we are submitting this application as a show of good faith in our desire to work with Weld County in a constructive fashion, notwithstanding our concerns that the COGCC has exclusive jurisdiction to regulate oilfield injection well operations and that local regulation cannot burden such operations with requirements and limitations that interfere with the COGCC's duty to maximize the production of oil and gas in a manner consistent with protection of the public health, safety and welfare. We do reserve our right to object to the jurisdiction of Weld County to regulate our disposal operations. However, as we have discussed with Mr. Morrison, once a permit is issued by the County without conditions that we regard as onerous or unduly restrictive, we will waive our objection to jurisdiction, subject to our right to reassert our jurisdictional objections in the event the County changes its regulatory requirements or the terms and conditions of the permit. PROPOSED USE: Basin Operating Company has received a permit from the Colorado Oil & Gas Conservation Commission to inject produced water back into the Sussex and Shannon formations in the UPRR 43 B1 & Futura Horse Village No. 2 wells. Water will be trucked to the tank battery where it will be filtered and pumped via underground flowline to the disposal well. Approximately 200 to 1000 barrels of water will be disposed on a daily basis. The water originates from adjacent and outlying oil & gas wells owned and operated by Basin in the Spindle Field. Basin will be receiving a permit from the COGCC to inject water into the Futura Horse Village No. 2 well. 2. NEED FOR USE: The sustained production of oil and gas in the Spindle Field hinges upon Basin's ability to conduct water disposal operations in an environmentally sound and economically sensible method. The consensus of environmental and industry experts is that re -injection of produced oil field water back into the formation from where it originated is the preferred course of action. 3. EXISTING USE ON SURROUNDING PROPERTIES: The surrounding area is zoned for agricultural use and the facility is located within the Spindle Oil & Gas Field. State Highway 52 is located 1/2 mile to the north. Numerous oil and gas wells and surface facilities are located on surrounding properties. 4. DISTANCE TO RESIDENTIAL STRUCTURES IN EACH DIRECTION: There are residences located 1/2 mile to the east, 1/2 mile to the north and 1/2 mile to the south. 5. MAXIMUM NUMBER OF USERS: The expected normal operation of the facility will be six water trucks each day each containing 80-130 barrels of produced oil field water. Basin Operating Company will be the only user. 6. NUMBER OF EMPLOYEES AND HOURS OF OPERATION: There will be an employee at the tank battery and well site while water deliveries are accepted. Normal hours of operation of the tank battery and well site will be from 7 a.m. to 8 p.m. The facility is automated and will dispose produced water 24 hours per day. When the facility is not manned it will be secured with locked gates. 7. FRESH WATER SOURCE: The operation will not require the use of potable fresh water. 8. ACCESS ROUTE TO BE UTILIZED: Motorized traffic will ingress and egress the location by exiting Highway 52 south onto I-25 Frontage Road approximately 1/2 mile and west into location. 9. TYPE, SIZE, WEIGHT, AND FREQUENCY OF VEHICULAR TRAFFIC: Traffic will consist of 80-130 barrel capacity water transport with approximate gross vehicle weight of 85,000 pounds each when full of water. 10. SEWAGE FACILITIES: There will not be sewage facilities on location. 11. FIRE PROTECTION MEASURES: There will be a portable fire extinguisher located at the tank battery. All company employees carry portable fire extinguishers in their vehicles. The facility is identical to the many oil and gas tank batteries located throughout Spindle Field in Weld County and there exist no extraordinary fire hazards. 12. TYPE AND SIZE OF ANY WASTE, STOCKPILE, OR STORAGE AREAS: There will be no stockpiling of any waste at the facility. Two fiberglass tanks (400 bbls each), and one steel tank (300 bbls) will be used to hold produced water prior to disposal down the wellbore. A 90 barrel fiberglass tank will be used to skim oil from the system. A cartridge filter system will be used to remove particulate from the injected water. These cartridges are the size of domestic under -sink models and will be disposed of in approved landfills. Approximately two fiber cartridges will be generated daily. Water treatment chemicals for corrosion and bacteria control are stored in fiberglass drums. 950675 13. STORM WATER RETENTION FACILITIES: A storm water retention permit is not required at this 2 acre facility. The site would also be exempt from the Heavy Industrial Stormwater Discharge Permit until or unless a reportable spill of oil or water or other chemicals occurs during a storm water runoff event. Therefore, there is no scheduled installation of storm water retention facilities for the water disposal site. If runoff occurs it will tend to flow toward the Northwest end of the site. The entire facility is contained within a two foot spill prevention, control, and countermeasure berm. 14. TIME SCHEDULE AND METHOD OF REMOVAL AND DISPOSAL OF DEBRIS, JUNK AND OTHER WASTE: Spent water filters will be the only form of waste and will be transported to an approved disposal site on a weekly basis. 15. LANDSCAPING AND EROSION CONTROL: The tanks and buildings will be painted desert tan and will blend in with the natural environment surrounding the facility. Erosion is not expected to be a problem because of the relatively flat contour of the existing topography. 16. RECLAMATION UPON CESSATION OF ACTIVITIES: The facility will be returned to farmland upon cessation of oil and gas activity. Equipment and tanks will be removed. The disposal well will be properly plugged and abandoned per COGCC rules. 17. TIMETABLE FOR CONSTRUCTION AND START-UP: An existing well has been converted to disposal status in accordance with COGCC rules and under COGCC permit. The tank battery has been retrofitted to accommodate water disposal operations. 18. STATEMENT RE: WELD COUNTY COMPREHENSIVE PLAN The proposed use is consistent with the Weld County Comprehensive Plan for the following reasons: A. The facility is designed to be an environmentally preferred produced water disposal option. B. The traffic impact will be minimal and in fact redirects a concentrated volume of water truck traffic away from local commercial disposal facilities. The facility is located within the Spindle Oil and Gas Field and accommodates water disposal by re -injecting the water back into the formation from where it was produced. This method minimizes long distance truck transportation to other disposal wells within Weld County. C. The facility is consistent and compatible with oil and gas development and facilities throughout the area. The Weld County Comprehensive Plan allows for mineral owners and lessees to have the right to develop their mineral properties. D. The facility will only be visited during the hours of dawn to 8 p.m. for delivery and maintenance purposes. 19. CONSISTENCY WITH THE INTENT OF THE DISTRICT: The use is consistent with the intent of the Agricultural Zoning District. Existing oil and gas facilities have been utilized rather than construction of new facilities or additional location excavations. 20. EFFORTS TO CONSERVE AGRICULTURAL LAND: Existing facilities have been utilized for this project. There has been no additional impact on agricultural land. 21. PROVISIONS FOR THE PROTECTION OF HEALTH, SAFETY AND WELFARE OF THE RESIDENTS OF THE NEIGHBORHOOD AND THE COUNTY: A six foot chain link security fence has been installed on both sites to prevent any harm to either livestock or unauthorized personnel. A containment berm has been installed to prevent any spillage within the tank battery. 950675 4 22. COMPATIBILITY WITH EXISTING SURROUNDING LAND USES: The facility is compatible with existing oil and gas development activity and has minimal impact of surrounding agricultural or rural environment. 23. FUTURE COMPATIBILITY WITH SURROUNDING AREA: The long-range future uses of the surrounding areas is likely to be agricultural and mineral development. 24. FLOOD PLAIN, GEOLOGIC HAZARD, AIRPORT OVERLAY: The facility is not located in a flood plain, geologic hazard, or airport overlay. 25. PROOF OF WATER SUPPLY: No fresh water is required for the facility. 26. COPY OF DEED: A copy of the "Water Disposal Agreement" which was executed between Basin and the surface owners of the disposal well is attached. 27. NOISE REPORT: The facility's pumping equipment will be housed in an enclosed shed. The operation is silent outside the building. 28. In your review, you will find an initial approval granted by the Commission on the UPRR 43 Pan Am B #1 well, and a later approval issued for the UPRR 43 Pan Am B#11 well To clear up any misunderstandings you may have on the approval of the B#11 well, thi3 well was initially granted verbal approval by the Commission until some unresolved differences surrounding a vclt owned by Amoco in. the Se/4 Neil. of Section 3. 'TIN, R68W, could be settled. The issues surrounding that well were in debate, and until they could come to a final conclusion as to how it should be handled, the issuance of a formal approval was withheld. This should explain the final approval granted by the Commission dated August 24, 1994. We have made adjustments to the drainage area (210 acres) and reversed the net pay thickness (perforated interval) from the values you used. Using these values and the other data submitted by Basin, the Commission staff will allow Basin to inject a cumulative volume of 546.000 barrels into the Sussex and Shannon zones in the UPRR B #11 without remedial cement work on the existing Amoco well, the UPRR 43 Pan Am #X-1, SENE 3 1N 68W. Injection will be allowed under the following conditions: 1) Injection must cease at 546,000 cumulative barrels or by September 1, 1995 unless the Sussex and Shannon zones are adequately cemented in the existing Amoco well, UPRR 43 Pan Am #X-1. 2) Report the cumulative volume injected into the UPRR 43 Pan Am B #11 on monthly OGCC Form 14A reports. 3) Monitor the bradenhead pressure on the Amoco UPRR 43 Pan Am #X-1 monthly and report these values on the OGCC Form 14A reports. Injection into the UPRR 43 Pan Am B #1 must cease and the Commission staff must be notified immediately if abnormal bradenhead pressure are discovered. 950675 ' Thank you for your reply to this matter. This letter serves as final approval of the disposal application dated February 17, 1993. Maximum authorized surface injection pressure has been set at 750 psiq. As a condition of approval, bottom hole pressure at the disposal well must be determined on an annual basis. A bottom hole reservoir pressures of 1450 psi will not be exceeded. In addition, water and hydrocarbon production should be monitored and reported monthly for the five surrounding Sussex producing wellswhich you operate. This data is required to be submitted to the Commission on an annual basis. Weld County, Colorado Dear Sir, ROY ROMER Governor The Commission has reviewed your application to re -complete the UPRR 43 Pan Am B-1 as a disposal well in the Sussex formation and has found it acceptable. This letter serves as final approval of the disposal application dated February 17, 1993. Maximum authorized surface injection pressure has been set at 750 psiq. As a condition of approval, bottom hole pressure at the disposal well must be determined on an annual basis. A bottom hole reservoir pressures of 1450 psi will not be exceeded. In addition, water and hydrocarbon production should be monitored and reported monthly for the five surrounding Sussex producing wellswhich you operate. This data is required to be submitted to the Commission on an annual basis. Submit OGCC Form 14A (Monthly Report of Fluids Injected) by the 25th of the month following the month covered by the report. The following information should help you in the filing of this report. The request should be submitted on OGCC Form 4 (Sundry Notice) and specify the OGCC lease number, if one has been assigned, lease name, operator, location, and producing formation. Additional water analyses may be required if water is obtained from other producing horizons or if the distance between new sources is determined to be significant from those analyses already submitted.
