RESOLUTION
RE: AUTHORIZATION FOR WELD COUNTY TREASURER TO CANCEL CERTAIN
PROPERTY TAXES - ERICSON'S PRINTING
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Arthur L. Willis, II, Weld County Treasurer, has submitted a Notice of Personal
Property Tax assessed to Ericson's Printing for the year 1990, which is deemed to be uncollectible,
in the amount of $1,157.10, said notice being attached hereto and incorporated herein as reference
by Exhibit "A", and
WHEREAS, the Weld County Attorney has advised the Board that Weld County has
exhausted all means for collecting said personal property taxes, and
WHEREAS, § 39-10-114(2)(a), C.R.S., as amended, provides that any taxes levied on
personal property which are determined to be uncollectible after a period of one year after the date
of their becoming delinquent, may be canceled by the Board of County Commissioners.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the personal property taxes assessed on Ericson's Printing for the year
1990, in the amount of $1,157.10, as set forth in detail in the notice which is attached hereto as
Exhibit "A", be, and hereby is, designated as uncollectible, and, therefore, it is canceled in
accordance with provisions of § 39-10-114(2)(a), C.R.S., as amended.
The above and foregoing Resolution, was, on motion duly made and seconded, adopted
by the following vote on the 26th day of June, A.D., 1995.

Cancellation of Personal Property Taxes for Ericson's Printing

Attached is a copy of a 1990 Tax Notice for Ericson's Printing on personal property. The
amount due was $1,716.72, including $549.62 for interest and $47.50 for advertising. This
amount was valid through March 31, 1995. Also attached is various correspondence relating to
this tax amount.
The personal property owned by Ericson's Printing was sold to Bruce Dye, d/b/a Outlaw
Printers, in August, 1990. Mr. Dye ran the business until 1991, at which time he closed the
business and transferred a majority of the personal property back to Ericson's Printing. Other
portions of the personal property were sold.
Attached is a copy of an Abatement Petition for the 1991 personal property taxes which was
approved by the Board of County Commissioners on September 8, 1992. Mr. Dye represents
that he had an agreement with Gary Parker of the Treasurer's Office wherein the 1991 property
taxes on the personal property would be abated, and the 1990 taxes would be canceled. The
agreement for the cancellation of the 1990 taxes was due to the fact that Mr. Dye owned the
property for only a portion of that year. The abatement was approved; however, the cancellation
was never presented to the Board of County Commissioners.
Ericson's Printing no longer exists. We have done a search for Bill Ericson, the former owner of
the company. Our search has been unsuccessful.
In accordance with the agreement of Gary Parker and Bruce Dye for the cancellation of the 1990
personal property taxes, I recommend that the Board cancel the taxes, and thereby clear the
books of this assessment.

This letter is in response to our telephone conversation on May 18. 1995 regarding the payment of property
taxes for Parcel 095913412013.
It is my understanding that on two occasions in March, 1993 you had conversations with Gary Parker and/or
representatives of the Weld County Treasurer's Office regarding the payment of the property taxes for this
parcel number. The final agreement which you reached was that you did not owe anything on the 1990
taxes; however, you did owe for the 1991 taxes. You paid the 1991 taxes. Although there is no
documentation in the form of letters to confirm this agreement. your personal notes clearly reflect such
agreement.
At this time, the Weld County Treasurer's Office will honor the agreement which you reached with
Mr. Parker regarding the 1990 taxes. This letter will confirm that you do not owe anything for the 1990 taxes
on Parcel 095913412013. Those taxes should be paid by Erickson's Printing, given that the Ericksons owned
the property through the entire year of 1990.

RE: Further Research into Payment of Taxes on
Parcel No. 095913412013
This letter is a follow-up to my March 13, 1995, letter into our telephone conversation in late
March, 1995, relative to payment of taxes on Parcel No. 095913412013.
You informed me in our telephone conversation that it was your understanding that you had paid
all of the taxes due on the property through 1991. I have checked with the Weld County
Treasurer's Office and found that you paid the sum of $829.58 to Central Services for the 1991
taxes on April 10, 1994. This amount, however, did not include the property taxes on this parcel
for 1990, which sum is $1,157.10.
Thus, I conclude that you still owe the sum of $1,157.10 for the 1990 taxes. Please note that
through the end of March, 1995, penalty interest in the sum of $549.62 had incurred. Also, there
has been a $10.00 advertising cost which has been added to this sum. The grand total as of
March 31, 1995, was $1,716.72, but is now higher.
As I stated in my March 13, 1995, letter, the Weld County Treasurer's Office will waive the
interest if you pay the sum of $1,157.10 no later than May 20, 1995. Any payment should be
made payable to the "Weld County Treasurer" and may be sent to my office at: P.O. Box 1948,
Greeley, Colorado 80632.

Dear Mr. Dye:
The Weld County Treasurer's Office has informed me that the personal property taxes referred to in
the Treasurer's Office as Parcel 095911116022 are due and owing in the name of Ericksons Printing.
Mr. Erickson has informed the Treasurer's Office that you and your wife purchased Ericksons
Printing in 1990. A copy of the Tax Notice for 1993 is enclosed. As you can see, the total due for
the personal property taxes is $1,157.10. Additionally, interest will be accumulating on the amount
due because it is past due.
The Weld County Treasurer's Office will waive the interest if you pay the $1,157.10 no later than
April 1, 1995.
Please be advised that pursuant to Section 39-10-112, C.R.S., the Weld County Treasurer may
collect the full amount of the taxes from you personally. If the Treasurer's Office does not receive
payment by April 1, 1995, I will seek permission from the Board of County Commissioners of Weld
County and from the Weld County Treasurer to proceed with an action against you in Weld County
Court to collect this sum.
