Application Flee: The application fee for Quarry miming is 12,325. The application fee for Solution mining or any Chemical or Thermal Processing is $3,100. If none of these -methods or processes are to be included in the operation then the application fee is $1,875. The application fee for conversion to a 112 permit is $1,500. 112 Amendment application fee is -$1,550. An applicant will not be issued a reclamation permit until notifi-ed by the Division that this application and the required performance and financial warranties have been approved. Alternatively, an automatic approval -will occur where the Division fails to notify the applicant/operator that the application has been denied. The final agency action must be made within 120 calendar days from the bate the application was submitted. However, the performance and financial warranties must be approved by the Division or Board before a permit -will be issued even if you reteive an automatic approval. NO MINING OPERATIONS SHALL BEGIN UNTIL A PERMIT IS ISSUED (Rule 7.2(2)). It shall be a provision of this permit that the operations will be conducted in accordance with the terms and conditions listed in your application, as well as with the provisions of the Act and the Mineral Rules and R2egulations in effect at the time the permit is issued. 951852 -4 - Notice Requirements Immediately after the first publication of your notice in a newspaper of general circulation im the locality of your proposed mining operation, you must -mail a copy of the notice to all owners of retard of surface rights to the affected land and all owners of record -of lands that are within 200 feet of the boundary of the affected land. Notice requirements are specified in Rule 2.2. A -copy of a form which includes all required information for the notice has teen attached for your use. You will need to provide the Division proof of notice prior to the decision date, which may be by submitting -return receipts of a certified mailing or ty proof of 'personal service (Rule 2.2.2(6)). NOTE TO COMMENTDRS/OB,]ECTORS: It is likely there will be additions, changes, and deletions to this document prior to final decision by the Mined land Reclamation Board or Division. Therefore, if you have any _comments or concerns, you should contact the applicant or the Division prior to the derision date so that you will know what changes may have been made to the application document. The Division is mot allowed to consider comments, unless they are written, and received prior to the end of the public comment period. You should contact the applicant for the final date of the public comment period. (-the "-Act"), as amended, provides that -no permit may be issued under -ie Act until the Mined Land Reclamation Board (-the "Board") receives a performance warranty (or warranties) that is a written Tromise to comply -with all applic-able requi-rements of the Act. WHEREAS, Weld County (the "Operator"), has applied for a permit to conduct a mining operation known as T-appy Pit (the "Operation") o -n certain lands in Weld County, Colorado. These lands are -described in the permit application, as amended and supplemented, and are ref -erred to herein as th-e "Affected Lands". WHEREAS, in its application for the permit, the Operator has agreed to to bou-nd by all requirements of the Act and all -applicable rules and regulations of the Board, as amended from time to time. WHEREAS, the Board has determined, in accordance with the Act, that the estimated costs of reclamation with regard to those affected lands in Weld County which are now or may become subject to the -permit are those amounts i- or -the stated periods of time as set forth in the fi-nancial warranty, which -nay be amended from time to time to reflect revised -estimates of said costs of reclamation. WHEREAS, the Operator hereby gives the Board a performance warranty pursuant -to Section 34-32-117(2) of the Act, a-nd herein promises the Board that it will comply with all applicable requirements of the Act with regard to those Affected Lands. 951852 -2 - NOW, THERE -FORE, the Qperator hereby promises the Board that it will comply with all applicable requirements of the Act and rules and regulations of the Board -with respect to the Affected Lands. FURTHER, the Qperator hereby -promises the Board that it will comply with all of the terms of the application for a permit, as amended and sup.pl-emerited, as well -as any conditions attached to the permit by the Board. Farther, the Operator _premises the Board, pursuant to 3412-112(1)(d) of the Act, that it has the lawful authority to enter upon the Affected Lands to conduct mining operations, including, but not limited to, reclamation. The Operator further -recognizes the right of the Board to enter to reclaim lands affected by the operation. The description of lands herein is for conv-enienc-e of reference only, and nn error in such description, nor any revision of the permitted mining area, nor the disturbance by the Warrantor of lands outside of the permitted mining area shall alter or diminish the Operator's obligation hereunder, which shall extend to the reclamation of all such lands disturbed. The obligation of the-Qperator hereunder is such that, if the Operator shall successfully comply with the requirements of the Act, applicable rules and regulations, and the -permit, then the Board, upon a finding that the Operator teas so complied, shall release this performance warranty, and the Operator from its obligation hereunder, to -the extent that the Board determines that such compliance has been accomplished. The obligation of the Operator hereunder shall continue until released in whole or in part by the Board in accordance with applicable law. In further satisfaction of the requirements of the Act, the O..perator has attached hereto its financial warranty, which may be amended from time to time. The Operator agrees that it will maintain a -financial warranty (or warranties) for the estimated -costs of reclamation in -good standing -for the entire life of the -permit. If the Board determines that the Operator is in default under this performance warranty and ha -s failed to are such default, although written notice of such default and ample time to cure such default have been given, the Operator's financial warranty shall be subject to forfeiture. Loading will be done with a rubber -tired front-end loader dumping into tractor -trailer dump trucks. Extraction of the dry alluvial material will be less than 10,000 tons per year. Approximately five (5) acres of the site may be considered as a major disturbance are, including both the excavated area and the stockpile. The remainder of the area will either be undisturbed or only slightly disturbed. The mined area is above any ground water. Therefore, this would be considered a "dry pit" operation. Useable material is near the surface with little or no overburden. It is relatively fined -grained, with 100% passing a 1" sieve. The meager topsoil, less than 6" thick, will be pushed along both sides of the pit by dozers and front-end loaders for future replacement. The mineral deposit is about 15' ± in depth. :exhd.dc 951852 EXHIBIT E Reclamation Plan - All stockpiled material will be removed from the site or incorporated into the excavated area as part of the reclamation plan. As a large enough area is excavated, it will be regraded to slopes flatter than four feet horizontal for each vertical foot. The finished area will be sloped to correspond the natural drainage pattern of the surrounding area. The proposed use of the affected land is rangeland. The stockpiled topsoil will be placed uniformly on the graded surfaces at a thickness equal to the adjacent lands. For material less than 6", rubber -tired scrapers and motorgraders will be used. The finished surfaces will be seeded with grasses compatible to the area during the season and at such rates as recommended by the Soil Conservation Service. The term of this agreement shall be from the date of execution to and until 10 years later, unless sooner terminated in writing by either party. Said notice of termination must be received at least ten (10) days prior to the stated date of termination. 2. Property Description. A completed application form is attached. 2. A detailed description of the method of mining operation. The description shall include: A. The types and numbers of operation and processing equipment to be employed. Mining will be accomplished by surface earth moving machines, portable crusher and/or screening unit. Loading will be done with a rubber -tired front-end loader dumping into tractor -trailer dump trucks. B. The number of shifts to be worked and the maximum number of employees. Weld County will be working 4-10 hour day shifts through the construction season. The maximum number of employees from the mining and Trucking Division will be 23±. This pit will be used to obtain sand and gravel for use on the immediate quadrant of county roads to eliminate long hauling distances. C. Whether the operation will involve a wet or dry pit extraction of the dry alluvial material; therefore this would be considered a "dry pit" operation. D. County road and bridges to be utilized. State Hwy 71 will be the only access point from the pit. E. The size of the area and stages to be worked at any one time. Approximately five (5) acres of the site may be considered as a major disturbance area, including both the excavated area and the stockpile at one time. F. A time table giving the period of time which will be required for the various stages of the operations. The term of the agreement with the landowner is a 10 -year period. The various stages of mining and processing should be completed by then. G. The depth and thickness of the mineral deposit to the thickness of overburden to be removed. Useable material is near the surface, with little or no overburden. It is relatively fine- grained, with 100% passing a 1" sieve. The meager topsoil less than 6" thick has been and will be pushed aside along both sides of the he pit by dozers and front-end loaders for future replacement. The mineral deposit is about 15' f in depth. 951852 H. The proposed use of reclaimed lands and an explanation of the reclamation process. All stockpiled material will be removed from the site, or incorporated into the excavated area as part of the reclamation plan. The finished surfaces will be seeded with grasses compatible to the area during the season and such notes as recommended by the soil conservation service. The reclamation plan will result in a return of the area to the equivalent use of the adjacent native rangeland. L The source of technical advice in that type of reclamation for open cut mining land. The haul road is existing , County will upgrade to 32' wide and 2% cross slopes with adequate drainage. Either water or chemical dust control material will be used at the site and on the adjacent haul road. 6. A statement which explains how the proposal is consistent with the Weld County Comprehensive Plan. To be consistent with the comprehensive plan, extraction must follow a rehabilitation plan, which is presented in the application. Weld County will make good use of this additional gravel pit in the northeast corner of the County to obtain sand and gravel for use in the immediate quadrant of County roads to eliminate long hauling distances. The reclamation of the gravel pit will benefit the ranchers and the surrounding wildlife. The reclamation would reseed new range grasses to benefit the rangeland from poor to marginal grasses. As the demand for more gravel for county roads and project in the area purpose increases, the county needs to acquisition additional pit in area there we have mining out and reclaimed existing pit. 951852 The site does not lie in a flood plain or geologic hazard zone or the Weld County airport overlay districtarea. 7. A statement which explains how the proposal is consistent with the intent of the district in which the use is located. This is a key location for a pit for graveling the road in the immediate area without hauling long distance. 8. If applicable, a statement, will be provided to explain how the decision for the proposed use to conserve productive agricultural land in the agricultural zone district came about. Most of the soil in this is Peetz gravelly and sandy loam with 5 to 20 percent slopes. The reclamation of this area with better slopes and new grasses would benefit the agricultural district. 9. A statement which explains there is adequate provisions for the protection of the health, safety and welfare of the inhabitants of the neighborhood and the county. The county proposes safeguards to prevent access to the site during non -working hours with a gate. All site operation will occur within the requirement of applicable permits, thus providing protection for the safety, health and welfare of the inhabitants of the neighborhood and the County. 10. A statement which explains the uses permitted will be compatible with the existing surrounding land uses. As previously stated, the proposed use is compatible with the surrounding land uses which consists of sand and gravel mining, mostly rangeland and some wheat farming. As the demand for more gravel for county roads purposes increases, we need additional gravel pit as are old pit are mined out and reclaimed to supply gravel to the county roads. 11. A statement which explains the proposed use will be compatible with on future development of the surrounding area as permitted by the existing zone and with future development as projected by the comprehensive plan of the county or the adopted master plans of affected municipalities. There is no development in the surrounding area. The pit is located 16 miles north of the nearest town. This area will be reclamated to its existing surrounding after the mining has been done. 12.
