HomeMy WebLinkAbout980442.tiff HEARING CERTIFICATION DOCKET NO. 98-06 RE: SHOW CAUSE HEARING FOR REVOCATION OF SPECIAL REVIEW PERMIT#961 FOR AN OPEN-PIT GRAVEL MINING OPERATION - KOBOBEL A public hearing was conducted on March 16, 1998, at 10:00 a.m., with the following present: Commissioner Constance L. Harbert, Chair Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison County Engineer, Drew Scheltinga The following business was transacted: I hereby certify that pursuant to a notice dated December 8, 1997, and duly published December 31, 1997, in the Platteville Herald, a public hearing was conducted on January 12, 1998, to consider the revocation of Special Review Permit#961 for William Kobobel for an Open-Pit Gravel Mining Operation. At said hearing it was determined by the Board of County Commissioners to continue this matter to March 16, 1998. At said hearing on March 16, 1998, Lee Morrison, Assistant County Attorney, made this a matter of record. Drew Scheltinga, County Engineer, stated Mr. Kobobel's daughter called and explained he fell and broke his leg and underwent surgery making him unable to attend today's hearing. Mr. Scheltinga stated he and Lee Morrison met with Mr. Kobobel before the incident and drew up an agreement by which Mr. Kobobel will haul the gravel from his pit for road improvements. Mr. Scheltinga requested a thirty day extension to allow the applicant to be present. In response to Commissioner Kirkmeyer, Mr. Scheltinga stated the only condition required at the previous Show Cause Hearing was to finalize an agreement for road improvements. Mr. Scheltinga stated there is a $4,000 value difference between Mr. Kobobel's estimate and the County's for the cost for work and the liquid asphalt involved in the project. The agreement states Mr. Kobobel will haul the base course from his pit; the County will lay the base course, and haul and lay the asphalt. Cost will be split 28%to the County and 72%to Mr. Kobobel. In response to Commissioner Kirkmeyer, Mr. Scheltinga stated the dates of payment are scheduled for July 15, 1998, and October 15, 1998. Mr. Morrison suggested the Board schedule a business meeting in two weeks to review the agreement. Commissioner Kirkmeyer moved to set a Board Meeting on March 30, 1998. The motion was seconded by Commissioner Hall, and it carried unanimously. Mr. Morrison clarified there are no other outstanding issues to discuss. Commissioner Kirkmeyer moved to continue the Show Cause Hearing to consider the revocation of Special Review Permit#961 for William Kobobel for an Open- Pit Gravel Mining Operation to April 13, 1998, at 10:00. Commissioner Webster seconded the motion, which carried unanimously.
