WELD COUNTY, COLORADO, TO ACCEPT WARRANTY DEED FROM KUNER-EMPSON COMPANY FOR LAND TO RE-LOCATE THE COUNTY SHOP FOR DISTRICT NUMBER TWO (2) AT JOHNSTOWN, COLORADO FOR THE SUM OF $1,458.00: WHEREAS, it has become necessary to re-locate the county shop for Road District Number Two (2) at Johnstown, Colorado, theretofore used for public county purposes and in order to do so it is advisable to acquire for said purposes a tract of land described as f11ows, to-wit: That portion of a tract of land in the Northwest Quarter (NW4) of Section 9, Township 4 North, Rdnge 67 West, of the 6th P.M., bounded and described as follows: Beginning at a point on the West line of a tract owned by Kuner-Empson Company in said Northwest Quarter (NW4) of Section 9, 376.4 feet south of and 907 feet East of the Northwest corner of Section 9, Township 4 North, Range 67 West; thence, South 316.6 feet to the Southwest corner of said Kuner-Empson Company tract; thence, East 510 feet; thence, Northwesterly song the right-of-way line of the Great Western Railway, a distance of 342.5 feet; thence, West 375 feet to the place of beginning; containing 3.24 acres, more or less. PARTIAL RELEASE OF MORTGAGE AND DEED OF TRUST KNOW ALL MEN BY THESE PRESENTS, That Whereas KUNER-EMPSON COMPANY, a Colorado corporation ( hereinafter sometimes called the "Corporation"), by a certain Indenture of Mortgage and Deed of Trust (hereinafter sometimes called the "Indenture") dated for convenience as of the first day of December, 1950, but actually signed in several counterparts as of June 1, 1951, and duly recorded on the first day of June 1951 in the office of the County Clerk and Recorder of Weld County, Colorado, and now appearing of record in Book 1304 at Page 138 of the records in said ,--- office, did mortgage unto The International Trust Company, a corporation organized and existing under the laws of the State of Colorado, as Trustee (and hereinafter sometimes called the "Trustee") certain real estate and other property in said Indenture described, to secure the payment of Kuner-Empson Company First and Refunding Mortgage 4 bonds, bearing date the first day of December, 1950, in the aggregate principal amount of not exceeding One Million Dollars ($1,000,000), with interest and all charges thereon, as in said Indenture and in said bonds mentioned; AND WHEREAS, the Corporation has sold and disposed of the following described real property situate in the County of Weld and State of Colorado as set forth on Exhibit A attached to and made a part of this Release; AND WHEREAS, the net proceeds from said sale amounted to $1458.00 have been paid in cash to the Trustee pursuant to Section 5,02 of said Indenture; AND WHEREAS, the Trustee has been furnished in form satisfactory to it a certified copy of the Resolution required by subparagraph (a) of said Section 5.02 and has also been furnished with the certificate required by subparagraph (b) of said Section 5.02; AND WHEREAS, all things have been done, pursuant to said Indenture, which entitle the Corporation to a release of the above described property from the lien thereof, and such release is now requested; wok1496 r;,m 129 NOW, THEREFORE, in consideration of the premises and the sum of One Dollar, lawful money of the United States of America, to the Trustee duly paid by the Corporation, the receipt whereof is hereby acknowledged, the said The International Trust Company, as Trustee, does hereby remise, release, transfer, assign, and forever quitclaim unto the said Kuner-Ernpson Company and to its successors and assigns forever that certain real estate situate in Weld County, Colorado, herein above described and which is a portion of the real estate and other property mortgaged by the said Indenture. And further, in consideration of the premises, the said Indenture of Mortgage and Deed of Trust is by these presents fully and absolutely released, cancelled, and forever discharged as to the above described real estate only situate in Weld County, Colorado, but otherwise said Indenture shall remain in full force and effect.
