Response to Questionnaire
1. How is this proposal consistent with the Weld County Comprehensive Plan?
A) The site of this special review is zoned agriculture and a primary goal of this type of
zone is to capitalize on the quality of natural resources. The mining of gravel for both
the production of asphalt and concrete is important to our county's growth and the
recreational use of the lakes following this mining is a secondary benefit. The
agricultural goals in the Comprehensive Plan include: (a) encouraging commercial and
industrial development to locate adjacent to existing municipalities, and (b) develop
policies to permit the development of sand, gravel, and other mineral resources on
agricultural land. The oil and gas line construction company is necessary for the county
to realize the extraction of these natural resources.
2. How does this proposal meet the intent of the zone district it is located in?
A) Property owners of agriculturally zoned land are encouraged to provide services
which assist farmers to extract their gas and oil resources, (R.M. Hiner Construction
Company), develop sand and gravel resources (asphalt and concrete batch plants) and
locate recreation areas in floodplain (water skiing and camping).
3. How is this use compatible with future development as stated in the Weld County
Comprehensive Plan?
A) The general area is not suitable for residential development. Present development
trends reflect a more commercial interest in the area. As in this area, there is:

In regards to the a lakes as a bi-product of the mining operations, recreational use
continues to enhance the area as trees and grass are planted. Weeds are kept down and
the general area is beautified. Also, the natural wildlife is not disturbed and continues to
flourish.
4. What type of uses surround this site? Is this request compatible with the surrounding
uses?
A) The types of uses around this site include; commercial development to the East;
farmland to the North; residential to the west; and quarry and mining operations to the
South; making this request compatible with the surrounding areas.

5. Is this property located within a Flood Hazard Zone, Geologic Hazard Zone, or Airport
Overlay Zone - and does it meet these special requirements?
A) As previously proposed and approved, some of the area is in a flood hazard zone,
approximately 40% including water. As far as recreational aspects, the lake presently
being used for water sports recreation is for the most part out of the floodplain. Future
recreational use of the other lakes would take place in the floodplain (see attached map).
6. What effort have been made to conserve productive agricultural land?
A) This area is pasture and open land, and to our knowledge has had no planted crops
for over 20 years.
7. How will public health, safety, and welfare be protected?
A) Neither the construction company or the recreational use will have an adverse effect
on public health. Public safety was considered when fences were erected around the
property. Signs detouring public passage are posted around the lake closest to the public
access road. A watchman will be on the site on a full-time basis. The safety and
welfare of our neighbors and the community has always been considered.
8. What will the site be used for?
A) The site will be used for the operation of the R.M. Hiner Construction Company,
Inc., in one area; and water sports recreation in another area. Future operation of the
asphalt and concrete plant will be continued as needs of the community arise.
Water sports recreation will include day use and overnight camping use, allowing only
self-contained recreational vehicles.
9. How close is this site to other residential structures?
A) At the present time, residential structures are located as close as 50 feet at the
northwest border of the site; however; the daily use recreational area is approximately
one -quarter (1/4) mile from any residential structures.
10. How many people will be employed at the site and what hours will they work?
A) There will be from one to five employees (depending on need). They will be
working from 5:00 A.M. to 8:00 P.M., seven days a week.
11. How many people will use this site?
A) One to 16 members could occupy the lake at any one time with the exception of
holidays at which time there might be up to 25 people.
12. What type and how many animals, if any, will be on this site?
A) Cattle, within the allowable limit per acre.

13. What type and how much, if any, operating and processing equipment will be
utilized on site?
A). ditchers, dozers, side booms, excavators, frac tanks, welding trucks and
trailers, and road boring equipment. Most of this equipment is used in the field
on job sites and may be kept on this site between jobs.
14. What type and how many structures will be erected (built) on this site?
A) Only RV's and mobile homes located above the 100 year flood plain.
15. What kind (type, size, weight) of vehicles will access this site and how often?
A) Approximate same size as related to batch plants. ie: semi tractor trailers, bob
tail trucks, welding trucks, permitted use vehicles. No more than what is used at
present unless batch plant operations resume and as demand determines.
16. Will this site use a septic system or public sewer facilities?
A) Business office will use septic system. Portable sanitary toilets will be
provided for employees in the construction yard and for recreational members at
the lake.
17. Are you proposing storage or stockpile of wastes on this site? If so, what is the
size and type proposed?
A) No
18. How often will debris, junk or waste be disposed of? By what means?
A) Trash service will dispose of junk and debris according to necessity. Human
waste will disposed by Sanitation service based on regular schedule.
19. How long will it take to construct this site and when will construction begin?
A) The proposed future RV parking if pursued will take no less than 10 years to
complete. Other than this no other construction is planned at this time.
20. Explain the proposed landscaping plans and erosion control measures associated
with this site?
A) In pasture areas grass has been planted to control erosion of top soil and to
provide grazing for cattle. General landscaping will continue to be maintained at
the recreational site. Maintenance of landscaping is the memberships
responsibility. Trees have been added for shade and beauty. Weeds and what
grows wild will be mowed down as needed as has been done in the past.
Landscaping around business yard will continue to be maintained.
21. Explain any proposed reclamation procedures when termination of the Special
Review use begins.

22. Explain the need for the proposed use (activity) in Weld County.
A) The proposed use of this site is necessary to serve the oil and natural gas
industry in the area. Creating employment and services to the people of Weld
County. The recreational use is necessary to encourage family participation in a
family atmosphere necessary today to develop our youth and future of our
community.
23. Who will provide fire protection for this site?
A) No change Western Hills Fire District.
24. What or who will provide water to this site?
A) N. Weld County Water District
25. How will storm water drainage be handled on this site?
A) Storm water will contained in the lakes on the site.

In reference to the application to Weld County regarding. R.M Hiner
Construction Inc. The following is submitted:
The construction company is a relatively small operation in comparison to the
concrete batch plant and asphalt facility that occupied this address in the past.
It is obvious that vehicle traffic has been greatly reduced traveling on and off
the property as most all the equipment used in this business is kept in the
field. This is a common practice throughout the oil and gas service industry,
however there is a need to keep some equipment in the yard to keep from
being vandalized or stolen and to perform preventive maintenance. This
equipment will be kept out of the flood plain on higher ground around the
north -north west side of the business office and directly east on the south side
on the larger lake (please see map). Parking for employee vehicles will
continue to be where it has been in the past that being slightly northeast of
the office structure. At this time there are no plans to operate the asphalt and
concrete batch plant but as future demands may change the need to offer this
service to the people of Weld County may deem it necessary to continue this
operation with the resources available on this site.
The reason for the request to park and R.V. in a wide variety of different
locations on the property is because we do not wish to be out of compliance
with the County should family or friends wish to visit and park around the
lakes or in the yard. Are family and friends and future acquaintances mean a
great deal to us and we wish to make them feel at home while visiting.
At this time we wish to park a mobile home on the property close to the
proximity of the precast structure on the west side of the entrance drive to the
business. Our intention is to have a employee live in it to over see the security
of the property as often times the owner may be away on business for long
periods of time. All service for this installation are accessible.
Recreational water sports:
The ski club at the lake at this time is managed by a close friend who desires
nothing more than to operate a simple club for a small number of people
who desire a clean well kept, safe, alcohol free environment to practice there
competitive water skiing sport and where a family can go to enjoy a family
tradition. Attached you will find a copy of the rules and regulations to the
club. I am sure you will find it refreshing to know there we are people who
wish to provide our families and friends a great place to enjoy water
activities. We intend to keep membership to this club at no more than 6

boats. Please see rules and regulations #26. And also intend to continue
overnight camping. This we contend is a great use for this lake and sincerely
wish to continue this privilege.

SKI CLUB
RULES AND REGULATIONS
1. No member shall remove rocks from dikes, damage property,
tamper with head gates, or trespass on adjoining land.
Entrance gate must be closed!
2. No alcoholic beverages are permitted. "Quiet Time"
is from 10:00 pm to 6:00 am.
3. No fishing or hunting is permitted without written
permission from Rex M. Hiner.
4. All boat CL# must be registered with Rex M. Hiner or Rick
Dinkel. 1 boat per membership. CL# and license must be
current.
5. No jet skis, wet bikes, sail boards, or sail boats will be
permitted at anytime.
6. All boats and boaters shall conform to all Colorado boating
statues and regulations:
7. All safety equipment must be in gdod working order per
Colorado boating statues.
8. Members must keep the premises clean, no trash may be left
on the premises.
9. Membership dues are due no later than March 1st. Members
who do not remit dues before March 1st will be assessed an
initiation fee. Memberships that are delinquent after April
1st are open to those people who are on the membership
waiting list.
10. Any new membership will be voted upon by existing members.
There will be an additional 1 time fee for new members
of $100.00
11. No open campfires are permitted according to state and
federal bans.
12. Vehicle access is limited only on established roads or entry
way. Stay on graveled surfaces when the area is wet. You
will be responsible for damaged or stuck vehicles on the
property. If you do get stuck during wet conditions, you
will be held responsible for the clean-up and repair of the
affected area.
13. Camping will not be permitted, however restroom facilities
are your responsibility and all human waste must be
contained and disposed of by you.

14. Gas operated equipment I.E. generators, trimmers, lawn
mowers are ok for use at Northern Most. However common
courtesy of other members must be observed. Due to the
possibility of theft Northern Most and its associates will
not be held responsible.
15. Guests are permitted. The member will be responsible for
the actions of there guests at all times. All guests must
sign a "Release and Covenant not to sue".
16. All persons must use only the northeast corner gate unless
you have business with Rex Hiner or Jim Rickman.
17. Slalom Course will be purchased by and cared for by the
members. If you destroy it fix it properly. It is the
boat owners responsibility to see course is kept in good
repair.
18. Primary purpose of this club is to practice the slalom
course however barefooting and boarding is allowed
if all members using the lake at that time agree to permit
it.
19. Red flag must be displayed when there is more than 1 boat
on the water when skier is down or tow rope is in the water.
20. Vehicle speed limit is 10mph.
21. Prohibited vehicles No -motorcycles, scooters, snowmobiles,
ATV's.
22. No Firearms are permitted.
23. Wakeless speed must be maintained from dusk to dawn.
24. Swimming- is permitted with an observer.
25. Boat Speed limit must not exceed 45 mph. (For Barefooting)
26. No more than 1 boat above wake speed at any 1 time.

#17 Need to mention that we have oilfield support not just pipeline; that
occasionally our trucks are called out or that our trucks have been
out and we have to store some production fluids which will be 2000 bbls
or less at one time due tothe disposals being closed.
#21 Out reclaimation is to be in accordance with the governing rules and
regulations of the Colorado Mined Land Reclaimation Board.
Also, we have been working on removing from the premises; or moving from the
100 year flood plain to the 500 year flood plain the items needed to be moved,
but would appreciate an extension of 60 days to complete as there were so many
items to be moved.
