RE: APPROVE VACATION OF SPECIAL USE PERMIT#458 - KILKER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated March 17, 1981, the Weld County Planning
Commission did approve Special Use Permit#458, issued to George Kilker and Ramsour
Brothers, and currently held by the George D. Kilker Trust, for a borrow pit, on the following
described real estate, to-wit:
Part of the NE'/ of Section 32, Township 1 North, Range 65 West
of the 6th P.M., Weld County, Colorado
WHEREAS, the Board has received a request from Marian G. Kilker, Trustee for the
George D. Kilker Trust, to vacate said Special Use Permit#458, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Special Use Permit#458 be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 15th day of June, A.D., 1998.

Dear Mr. Patton:
I am writing this letter on behalf of the George D. Kilker Trust
at the request of Marian G. Kilker, the Trustee. I am her
attorney.
By this letter we are informing you that the trust, as owner of
the West 1 /2 of the Northeast 1 /4 of Section 32, Township 1
North, Range 65 West in the 6th P.M. , intends to vacate Special
use Permit No. 458. This permit was obtained years ago to
provide for removal of fill dirt from this property for use in the
construction of I-76. This project was completed in the 1980 ' s.
The permit is being vacated for the purpose of enabling a recorded
exemption we are applying for.

Moved by Jack Holman that the following resolution be introduced •
for passage by the Weld County Planning Commission:
Be it Resolved by the Weld County Planning Commission that the
application for site approval of barrow pit covering
the following described property in Weld County, Colorado, to-wit :
Part NEa Section 32, T1N, R65W
be (granted) kftRith for the following reasons :
1. This request is in compliance with the Weld County Comprehensive Plan
the Weld County Extraction Plan, Mineral Resources, Volume II. The area
in question is nonirrigated. The Weld County Extraction Plan states that
extraction shall be accomodated in nonirrigated areas so longs as
appropriate extraction standards are followed.
2. It is the opinion of the Planning Commission, that if the Operations
Standards are complied with, impacts on surrounding uses and the area
will be minimized to the greatest extent possible and provide adequate
protection of the health, safety and welfare of the inhabitants of the
area and the county.

3. It is the opinion of the Planning Commission that this proposed
operation is in compliance with the provisions of Sections 3.3.E.2, and
and 6.1 (3) of the Weld County Zoning Resolution.
These determinations are based in part upon a review of the information
submitted by the applicant, other relevant information regarding the request.
The Planning Commission approval is conditional upon the following:
1 . The attached Operations Standards being recommended and approved
for this request.
2. The following note being placed on the Special Use Permit Plat:
NOTE: The Mined Land Reclamation Board has the authority to
issue permits for mining and reclamation activities .
Activities related to mining and reclamation are, therefore,
under the jurisdiction of the Mined Land Reclamation
Board, however, the Weld County has jurisdiction of those
matters outlined in the Operations Standards .
3. The Operations Standards being placed on the Special Use Permit
Plat. The Special Use Permit plat shall be delivered to the
Department of Planning Services.
