BE IT RESOLVED, by the Board of County Commissioners of Weld
County, Colorado, that they sign Easement with S. C. McClure and Jessie L.
McClure, WRCS, Eaton, Colorado, for surface gravel located in the
Southeast Quarter (SE4) of Section 21, Township 7 North, Range 65 West, of
the 6th P.M., mre particularly described as follows, to—wit:
Beginning at a point 1,795 feet North of the Southwest
corner of the Southeast Quarter; thence, East to a point
466.66 feet; thence, South to a point 466.66 feet; thence,
West to a point 466.66 feet; thence, back North to starting
point, or 466.66 feet, containing five (5) acres, more or
lees. It is agreed by Party of the second part (Weld County,
Colorado) not to remove gravel within fifteen (15) feet of
fence line.
Limit of depth to be eighteen (18) feet.
Party of the First Part agrees that it will not sell, load,
or give any gravel or dirt from this pit to any individual
or firm.
Also, agreement for ingress and egress. The consideration is
$4,500.00. Reference is hereby made to the records of the Weld County
Recorder, Book 1482 Page 158

• of Weld County, Colorado, part ies of the first part, and The County of Weld, in the State of Colorado,
• 3 a municipality, party of the second part:
WITNESSETH: The part of the first part. for and in consideration of
4 Four thousand, five hundred dollars and No/100 Collars,
`•• ji to first part les in hand paid by the party of the second part, the receipt whereof is hereby confessed
and acknowledged, do oeshereby bargain, sell and convey unto the party of the second part, its succes-
sors and assigns, the right to remove all gravel, sand and road-making and building material which it
shall be able to remove from the following described lands, situate in the County of Weld and State of
Colorado, to-wit:
A tract of land located in the Southeast Quarter of Section 21, lbwnship 7,
Range 65, Weld County, Colorado, described as follows, to-wit:
Beginning at the Southwest Corner of the Southeast Quarter; thence North 1,795
feet; thence East to a point 466.66 feet; thence South to a point 466.66 feet;
thence West to a point 466.66 feet; thence back north to starting point, or
466.66 feet.
Limit of depth to be eighteen (18) feet.
Party of the First Part agrees that it will not sell, load, or give any gravel
or dirt from this pit to any individual or firm.
. Above description contains 5 acres, more or less.
The County of Weld, as a further consideration for this Deed and by acceptance thereof, agrees
that said tract of land shall be excluded from further assessment for taxes; the first part hereby
granting to the party of the second part the right to enter upon said lands at any time hereafter and to
excavate and remove therefrom all gravel, sand and earthen material which it shall find suitable to its
needs, together with the rights and privileges incident to the proper enjoyment thereof.
This instrument shall give no title to said land, and shall only give the right to remove therefrom
the part of the surface thereof as hereinabove set forth. This contract shall be binding upon and inure
to the benefit of the heirs, administrators, and assigns of the part of the first part, and the succes-
sors and assigns of the party of the second part. -
