HomeMy WebLinkAbout972478.tiffRESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND PLANNED UNIT DEVELOPMENT FINAL PLAN S #431 FOR A 19 -LOT SUBDIVISION IN A PUD C-3 AND I-1 ZONE DISTRICT - WESTERN DAIRYMEN COOPERATIVE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 24th day of November, 1997, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Western Dairymen Cooperative, 12450 North Washington Street, Thornton, Colorado 80241, for a Site Specific Development Plan and Planned Unit Development Final Plan S #431 for a 19 -lot Subdivision in a PUD C-3 and I-1 Zone District on the following described real estate, to -wit: Part of the N% of Section 10, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, said applicant was represented by Kris Pickett at said hearing, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit and Planned Unit Development Final Plan, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: A. The proposed PUD Final Plan is consistent with the Weld County Comprehensive Plan and is compatible with the future development as permitted by the existing PUD District and plans of affected municipalities. The City of Longmont has reviewed the request and finds no conflicts if consistent with the MUD Plan. The Town of Mead reviewed this request and indicated that the proposal does not affect their Comprehensive Plan. It is the opinion of the Department of Planning Service's staff that the comments listed in Mead's referral response have been addressed. The PUD Plan conforms to the approved PUD District. The Utility Coordinating Advisory Committee reviewed and conditionally approved the PUD utility plan at its August 14, 1997, meeting. The concerns of the Utility Coordinating Advisory Committee are addressed in the conditions of approval. C. The uses, buildings, and structures shall be compatible with the existing and future development of the surrounding area as permitted by the existing zoning, and with the future development projected by the Comprehensive Plan or Master Plan of affected municipalities. The proposed PUD Final Plan conforms with the performance standards in Section 35.3 of the Weld County Zoning Ordinance. The proposed PUD Final Plan will be in compliance with the Weld County Zoning Ordinance, Section 50, Overlay Districts. The site is located within the MUD area and shall comply with adopted regulations of Weld County MUD Ordinance #191. A portion of the site is located within the Flood Hazard Overlay District. Conditions of approval address the Overlay Districts requirements. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Western Dairymen Cooperative for a Site Specific Development Plan and Planned Unit Development Final Plan S #431 for a 19 -lot subdivision in a PUD C-3 and I-1 Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. Prior to recording the PUD Final Plan plat: A. The Board of County Commissioners shall review and approve the Subdivision Improvements Agreement for off -site and on -site improvements and the form of collateral. The security for the agreement shall be tendered and accepted by the Board of County Commissioners for the Subdivision Improvements Agreement. B. A phasing plan for construction of the development shall be submitted for review and approval and accepted as part of the improvements agreements. C. A complete covenants and development guideline shall be submitted for review and approval and accepted by the Board of County Commissioners. D. Sidewalks, in compliance with the MUD Ordinance #191, shall be clearly delineated on the landscape plan. 972478 PL1071 SPECIAL REVIEW PERMIT S #431 - WESTERN DAIRYMEN COOPERATIVE PAGE 3 2. The following notes shall be placed on the PUD Final Plan plat prior to recording: A. The uses permitted within the PUD Final plan shall include a total of nineteen lots and open space which comply with the PUD Zone District requirements and as described in the application materials. B. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. C. Left Hand Water District shall provide water service to all uses within the PUD Zone District. D. St. Vrain Sanitation District shall provide sewage disposal to all lots within the PUD Zone District. E. Installation of all utilities shall comply with Section 10 (Design Standards) of the Weld County Subdivision Ordinance, as amended and the conditions of the Weld County Utility Board. F. All uses within the PUD Final Plan shall comply with the requirements of the Mountain View Fire Protection District. G. Access to the development shall be from Weld County Road 7.5 which intersects State Highway 119. H. All uses within the PUD Final Plan shall maintain compliance at all times with the Department of Army, Corp of Engineers requirements/standards. Street signs and lot identification shall be in place prior to release of building permits. J. Exterior illumination of structures, yards and driveways shall be restricted as follows: (1) Sources of light shall be shielded so that beams of light will not shine directly onto adjacent properties. (2) Neither the direct nor reflected light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets. Landscaping and signage shall comply with the MUD Ordinance #191. 972478 PL1071 SPECIAL REVIEW PERMIT S #431 - WESTERN DAIRYMEN COOPERATIVE PAGE 4 L. Prior to release of building permits for structures, foundation plans shall be submitted bearing the stamp of a Colorado Professional Engineer for review and approval by the Weld County Building Inspection Department. M. Prior to any use or construction of any lot within the PUD a Site Plan Review application shall be submitted, reviewed, approved and conditions met. N. All lots within the PUD shall adhere to the MUD Development Standards and shall be reviewed through the Site Plan Review application process. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 24th day of November, A.D., 1997.
