AND STORE CONSTRUCTION EQUIPMENT IN THE A (AGRICULTURAL) ZONE
DISTRICT - HARLAN WALL
A public hearing was conducted on October 9, 1996, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated September 18, 1996, and duly published
September 26, 1996, in the North Weld Herald, a public hearing was conducted to consider the
request of Harlan Wall for a Site Specific Development Plan and Special Review Permit to park and
store construction equipment in the A (Agricultural) Zone District. Lee Morrison, Assistant County
Attorney, made this a matter of record. Kern Keithley, Planning Department representative,
presented a brief summary of the proposal and submitted a letter from the West Adams Soil
Conservation District, Exhibit B, to the Board. She stated the subject site is a 1.5-acre portion of
a 100-acre parcel and is currently being used for this activity. Ms. Keithley referenced the letter
from the Soil Conservation District and entered the favorable recommendation of the Planning
Commission into the record as written. She further noted the applicant must submit a screening
plan, is required to install an individual sewage disposal system, and that two letters of support from
surrounding property owners have been received. Commissioner Hall questioned why the Health
Department is requiring an individual sewage disposal system. Ms. Keithley explained such
requirement is based on the fact that people will congregate and maintenance will be performed
at the site. Mr. Morrison clarified only a vault system is being required. Trevor Jiricek, Health
Department, stated the Health Department does not have much flexibility regarding the issue since
there is a permanent structure on the site. Harlan Wall, applicant, was present and stated he is
the owner of the property which he has farmed since 1946. He stated he retired five years ago,

and this 1.5-acre parcel is separated from the rest of the farm by a ditch. Mr. Wall said the property
has been used for parking equipment for the last ten years. Responding to questions from the
Board, Mr. Wall confirmed he has no problem with the vault, which will probably be more
economical than portable units in the long run. Mr. Jiricek suggested a forest service type design
and confirmed the tank will be approved by the Health Department. Referencing the Soil
Conservation District's letter, Mr. Wall confirmed a concrete barrier exists around the gas tank as
required by the insurance company and agreed to continue weed control. He noted grass and
trees have been planted and will continue to be maintained. Mr. Wall confirmed all Conditions of
Approval and Development Standards are acceptable and requested approval of the Permit, noting
his interest in agriculture. No public testimony was offered concerning this matter. Commissioner
Webster moved to approve the request of Harlan Wall for a Site Specific Development Plan and
Special Review Permit to park and store construction equipment in the A (Agricultural) Zone
District, based on the recommendations of the Planning staff and the Planning Commission, with
the Conditions of Approval and Development Standards as entered into the record. The motion
was seconded by Commissioner Harbert, and it carried unanimously.
This Certification was approved on the 14th day of October, 1996.
