The Weld County Council met in regular session in full conformity with the Weld County
Home Rule Charter at the Weld County Centennial Center, 915 10th Street, Greeley,
CO, Tuesday, February 17, 1998, 6:30 p.m.
ROLL CALL: The meeting was called to order by President Judy Curtis. Vice
President Dan Oster, Councilman Ralph Campbell, Councilwoman Pam Malcom, and
Councilman Al Roberts were present, constituting a quorum of the members. Also
present: Juan Mutuberria, and the Council secretary, Bev Thomas
APPROVAL OF MINUTES: Councilman Al Roberts made a motion to approve the
January 20, 1998 meeting minutes. Councilman Dan Oster seconded the motion and it
was approved unanimously.
ADDITIONS TO THE AGENDA: County Resident Juan Mutuberria was added to the
agenda.
PUBLIC COMMENT: Mr. Juan Mutuberria who resides on WCR 45 stated his
concerns about the summer road problems experienced by himself and his neighbors.
Mr. Mutuberria's concerns regarding a one-mile section of WCR 45 were: volume of
traffic, the speed of the traffic, and the dust created by the traffic.
Council members asked Juan about the contacts he had made with County personnel
to get help with the road problems. Various solutions were discussed. President Judy
Curtis asked for Mr. Mutuberria's telephone number, and told him that the Council
would research possible solutions and call him.
APPOINTMENTS: The March 9, 1998 Elected Officials Meeting will be attended by
Councilman Dan Oster and Councilman Al Roberts.
The Council discussed the involvement of the Council in KFKA's Coffee Break program
schedule for 1998. The Council asked Bev Thomas to check with Coffee Break's host,
Chuck Tennessen, to verify if all give Council members could participate in the program
on May 5 as it appears that will be the Council's only involvement in the program during
1998.
CORRESPONDENCE: The Council reviewed the correspondence. The Council
received updated copies of the lists of Weld County department heads and Weld

County municipalities. Council members read a February 10 letter from County
Attorney Bruce Barker. President Judy Curtis instructed Bev Thomas to add "Council's
Parameters in Seeking Legal Advise RE: Bruce Barker's Letter" to the March Council
agenda.
COORDINATOR REPORTS:
United Power Substation on Weld County Road 22
Councilman Al Roberts reported that citizens have communicated with United Power
about the location of a new substation. United Power actually moved the location of the
proposed substation to accommodate the citizens only to have a developer complain
about the second location because it is too close to a proposed development.
February 11, 1998 PUD Hearing
Council Roberts also reported on a February 11 PUD hearing that he attended at a
citizen's request. There Councilman Al Roberts learned that a petition objecting to a
change of zoning was not considered at the hearing because the petition did not object
to the site specific application being considered.
Weld County Ambulance
Councilman Ralph Campbell reported that he had received complaints about the Weld
County Ambulance Service. He presented the facts about the employment status of
ambulance service employees and the costs of ambulance service to fire districts in
Weld County. He said that he was going to talk with the complaining citizens and try to
clarify the misinformation that he had heard. �p
BFI Land Fill Problem in Erie Area
Councilwoman Pam Malcom reported that she had been contacted by a reporter from efri
the Longmont Times Call about the status of the BFI land fill issues that Council S •
members have researched.
Beet Dump Problems
County residents had telephoned Councilman Roberts in response to his February 11
letter. They do want the Council to take decimal readings of the beet transportation
noise during the 1998 autumn beet dumping season.
The citizens also reported that beet trucks have left mud on Weld County Road 13 that
County road graders have not been able to remove. Councilman Roberts referred the
citizens to Weld County's zoning compliance officer. Mr. Roberts also talked to Drew
Scheltinga about the problem. Mr. Scheltinga said that he would arrange to have the
mud cleared from the County road.

UNFINISHED BUSINESS:
Abstinence-Based Education Grant
Councilwoman Pam Malcom said that she would make a contact about letters of
support for this grant.
1998 Coordinator Assignments
Councilman Ralph Campbell made a motion that the Council assign the following 1998
Coordinator Assignments: President Judy Curtis, Department of Finance, Central
Purchasing, and Personnel; Vice President Dan Oster, Department of Human Services;
Councilman Ralph Campbell, Department of Public Works; Councilwoman Pam
Malcom, Department of Health Services; and Councilman Al Roberts, Department of
Planning Services. Vice President Dan Oster seconded the motion and it carried
unanimously.
Citizens' Request for Council Minutes
Councilwoman Malcom made a motion that only five requests per meeting for approved
minutes to be mailed to citizens will be honored. If the times comes that there is more
than five requests per month for approved minutes, the Council will reconsider its
position. No unapproved minutes will be mailed. Councilman Al Roberts seconded the
motion. Councilman Ralph Campbell called for a roll call vote. The motion carried with
Councilwoman Pam Malcom, Councilman Dan Oster, and Councilman Al Roberts
voting yes and President Judy Curtis and Councilman Ralph Campbell voting no.
Proposed Speaker
Councilwoman Pam Malcom reported that Weld County District Attorney Al Dominguez
had telephoned her in December 1997 and offered to be a guest speaker at a Council
meeting.
NEW BUSINESS:
Payment of the Bills
Councilman Al Roberts made a motion to pay the following bills:
Mileage for Councilman Ralph Campbell $11.88
Mileage for Vice President Judy Curtis $23.22
Mileage for Councilman Dan Oster $ 7.56
Mileage for Councilman Al Roberts $28.08
Subscription to Farmer& Miner $19.00
Councilman Ralph Campbell seconded the motion and it carried unanimously.
Meeting with Board of County Commissioners
The Council discussed meeting with the Board of County Commissioners to keep the
lines of communication open between the Council and the Commissioners. It was

decided that the Council secretary should contact the Commissioners' secretary to
arrange a meeting during March 1998.
Request from John Folsom
Council President Curtis dictated a response to Mr. Folsom acknowledging receipt of
his February 10 letter.
Sound System in Centennial Center First Floor Meeting Room
The Council discussed the problems encountered with the sound system in the
Centennial Center First Floor Meeting Room during Commissioners' public hearings
and during County Council meetings.
Councilman Al Roberts was asked to check if the American Disabilities Act covered
problems with sound systems at public meetings.
Colorado Revised Statutes on CD Rom
The Council secretary reported that Colorado Revised Statutes were not available on
CD ROM in the Weld County libraries or in the Law Library located in the Centennial
Center. The County Attorney's office has always provided the Council paper copies of
any requested Colorado Revised Statutes.
Secretarial Request
The Council asked the Council secretary to gather current information to be used for
setting the salaries of Weld County's elected officials.
ADJOURNMENT: The meeting was adjourned at 10:20 p.m..
