HomeMy WebLinkAbout952070.tifftatty ctsid5 2459025 B-1514 P-887 10/10/95 02:59P PG 1 OF 1 Weld County CO Clerk & Recorder RESOLUTION REC DOC 0.00 RE: APPROVE RELEASE OF COLLATERAL - FLATIRON STRUCTURES COMPANY, S #316 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated December 23, 1991, the Board did approve a Subdivision Improvements Agreement According to Policy Regarding Collateral for Improvements with Flatiron Structures Company/Azalea Farms, Limited, concerning property located in part of the W'%, SW% of Section 11, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado, and WHEREAS, pursuant to said agreement, Performance Bond No. 400GR 8424, in the amount of $128,150.00, with St. Paul Fire and Marine Insurance Company being Surety, was submitted to Weld County, and WHEREAS, upon the recommendation of the Department of Planning Services staff, the Board deems it advisable to release said collateral. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Performance Bond No. 400GR 8424, in the amount of $128,150.00, with St. Paul Fire and Marine Insurance Company being Surety, be, and hereby is, cancelled and released. BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is, directed to return said collateral to the appropriate issuing party. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 2nd day of October, A.D., 1995. (S-316) located in part of the West 1/2, Southwest '/4, of section 11, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado Dear Commissioners: The Collateral for improvements was approved by the Board of County Commissioners on December 23, 1991. The improvements agreement was in the amount of $128,150 and was for retention ponds, grading and landscaping. The property was inspected on August 11, 1995 and it was determined that the retention ponds, grading, and landscaping have been completed. William H. Mitzefeld P.E. With Scott, Cox and Associates, Inc in his letter dated September 19, 1995 indicated that the retention pond and outlet structures was built in accordance with the original plan and will keep runoff from the development below the required release rates. The Department of Planning Services Staff request that the Board approve the Requested release of collateral in the amount of $128,150. Sincerely, i eith A. September 19, 1995 Mr. Keith Schuett Current Planner Two Weld County Planning Dept. 1400 North 17th Avenue Greeley, Colorado 80631 Ref: 89156 S Azalea Farms Dear Keith: The purpose of this letter is to provide you with the results from our August 24, 1995 survey of the stormwater detention pond facility at Azalea Farms. Based on our as -built survey, we performed pond volume calculations to confirm that the pond as constructed will provide the detention pond requirements per Scott, Cox & Associates' previously -prepared drainage plan and report. Our calculations showed that the 10 -year pond volume, at elevation 4852.1, is approximately 49,000 cubic feet which is greater than the 47,400 cubic feet required. Similarly, the 100 -year pond volume at elevation 4852.5 is 88,500 cubic feet which is greater than the required volume of 85,000 cubic feet. Our survey confirmed that the outlet structures have been constructed for separate 10 -year release and 100 -year release rates. The survey confirms that the detention pond as constructed will function in general conformance with the approved grading and drainage plan. In accordance with the original plan, it will keep developed runoff flow rates below the required release rates.
