HomeMy WebLinkAbout990360.tiff HEARING CERTIFICATION DOCKET NO. 99-12 RE: APPROVE CHANGE OF ZONE #519 FROM A (AGRICULTURAL) ZONE DISTRICT TO PUD (PLANNED UNIT DEVELOPMENT) DISTRICT -WIEDEMAN/HUNT A public hearing was conducted on February 24, 1999, at 10:00 a.m., with the following present: Commissioner Dale K. Hall, Chair Commissioner Barbara J. Kirkmeyer, Pro-Tem Commissioner George E. Baxter Commissioner M. J. Geile Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Carol A. Harding Assistant County Attorney, Lee Morrison Planning Department representative, Julie Chester Health Department representative, Trevor Jiricek Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated February 10, 1999, and duly published February 13, 1999, in the Fort Lupton Press, a public hearing was conducted to consider the request of Terry Wiedeman and David Hunt for Change of Zone #519 from A (Agricultural) Zone District to PUD (Planned Unit Development) District to create five E (Estate) zoned lots, and one commercial lot for a garage with a 78.2 acre agricultural outlot and 2.82 acres of open space. Lee Morrison, Assistant County Attorney, made this a matter of record. Julie Chester, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written, and stated the concerns raised by Melvin Dinner in his letter dated December 18, 1999, Planning Commission Exhibit#18, have been addressed in the Conditions of Approval and Development Standards. (Clerk's note— Tape was malfunctioning at beginning of hearing; begins while Ms. Chester is speaking.) Responding to Commissioner Vaad regarding Mr. Dinner's letter, Ms. Chester stated there currently is a 30-foot gas and oil easement shown on the plat. In response to Commissioner Geile concerning the use of septic systems for commercial lots, Mr. Morrison explained the PUD calls out general use for the parcels, that the garage is a limited use; however, another facility could not take over and operate there without further approval. Ms. Chester stated, in response to Commissioner Geile's concern, that the Landscape Plan and parking adhere to the MUD Ordinance. David Hunt represented the applicant and stated Dan's Garage is currently in operation, the request will move it across the road, and the housing parcels will make the move economically feasible for the garage. There was no public testimony offered. Pk, 990360 PL1288 HEARING CERTIFICATION - WIEDEMAN/HUNT (COZ#519) PAGE 2 Mr. Morrison indicated a letter received by the Board this morning regarding this case, marked Exhibit E, and expresses a valid concern regarding the existence of underground storage tanks. Mr. Jiricek stated he is not sure of the exact date which was Federally mandated for removal of said tanks, and Commissioner Geile stated it is really two separate issues, therefore, the Health Department should check on the tanks at the old site. Upon ascertaining the applicant agrees with all Conditions of Approval and Development Standards, Commissioner Kirkmeyer moved to approve the request of Terry Wiedeman and David Hunt for Change of Zone #519 from A (Agricultural) Zone District to PUD (Planned Unit Development) District to create five E(Estate)zoned lots, and one commercial lot for a garage with a 78.2 acre agricultural outlot and 2.82 acres of open space, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Vaad, and it carried unanimously. This Certification was approved on the 1 s' day of March, 1999.
