RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION #1727 - MARTIN EXPLORATION
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, at a meeting on May 15, 1995, at 9:00 a.m., the Board was presented with a
request for Recorded Exemption #1727 from Martin Exploration, and
WHEREAS, at said meeting the Board of County Commissioners deemed it advisable to
continue said matter to May 17, 1995, at 9:00 a.m., to allow staff time for further research, and
WHEREAS, at said meeting on May 17, 1995, the Board, pursuant to its authority under
Section 30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the
Chambers of the Board, that a certain parcel of land, to be divided into two. parcels, as shown on
the plat known as Recorded Exemption #1727, does not come within the purview of the definition
of the terms, "subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1727 was submitted by Martin
Exploration, 8690 Wolff Court, Suite 200, Westminster, Colorado 80030, for property which is
described as Lot B of RE #421, being a part of the SW% NW% of Section 5, Township 1 North,
Range 67 West of the 6th P.M., Weld County, Colorado, being more particularly described in the
plat which shall be provided by the applicant and known as Exhibit "A", said platto be recorded,
and
WHEREAS, this request is to divide the property into parcels estimated to be approximately
5.6 acres and 4.4 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1727 submitted by
Martin Exploration be, and hereby is, approved conditional upon the following:
1. A Weld County septic permit is required for the proposed home. The septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(ISDS) regulations.
2. The ISDS permit shall be finalized and approved by an Environmental Protection
Specialist within one (1) year of the application date.

3. Prior to recording the plat, the applicant shall submit evidence that an ISDS
evaluation has been completed by the Weld County Health Department on all
existing septic systems.
4. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.
5. The use which is allowed pursuant to Special Use Permit USR #524 shall be limited
to the area of Lot A and shall not take place on Lot B.
6. There shall be allowed only one access per legal lot. Each access shall comply with
the provisions regarding access set forth in Weld County Ordinance No. 180.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 17th day of May, A.D., 1995.

This letter is in response to your letter dated May 16, 1995 regarding Recorded Exemption RE -1727.
Your letter states that Martin Exploration consents to the limitation of the special use allowed by
Special Use Permit USR:524 to the area known as "Lot A" of Recorded Exemption RE -1727, which
is more particularly described as follows:
Beginning at a point 1408.16 feet South 89°46'25" East from the Northwest Corner
of Section 5, Township 1 North, Range 67 West of the 6th P.M., Weld County,
Colorado; thence, south 585.68 feet; thence, east 360.18 feet; thence, north 585.68
feet; thence, west 360.18 feet to the point of beginning, containing 4.4385 acres,
more or less.
You represented in the hearing on Monday, May 15, 1995 for Recorded Exemption RE -1727 that
the use allowed pursuant to USR:524 does not necessitate the use of the property known as "Lot B"
of RE -1727. As a result, Martin Exploration is comfortable with limitation of the use to the area
known as Lot A.
Please be advised that the Weld County Department of Planning Services does not consider your
consent to the limitation of the use of Special Use Permit USR:524 to the area of Lot A of Recorded
Exemption RE -1727 to be a substantial change requiring an amendment under the provisions of the
Weld County Zoning Ordinance, Section 24.4.2, or constitute a material deviation as referred to in
Development Standard 11 of USR:524. The Department will keep your letter, along with a copy of
this letter and a copy of the plat for Recorded Exemption RE -1727, in the file for Special Use Permit
USR:524. By doing so, the use shall not be permitted upon Lot B of Recorded Exemption RE -727.

Dear Gloria,
I spoke with the County Attorney, Mr.Bruce Barker concerning
the issue raised at the County Commissioners Meeting, Monday
morning May 15th. The issue raised at the meeting related to the
fact the original Special Use Permit was granted on the entire 10
acre parcel. Mr. Barker has informed me that a formal ammendment
to the original Special Use Permit reducing the permitted use from
the entire 10 acre parcel to Lot A of the proposed exemption may
not be required provided Martin Exploration agrees to limit the
permited special use to Lot A of the proposed exemption.
Let this letter serve as Martin Exploration's consent to limit
the special use to the proposed Lot A of USR 524 recorded exemption
RE -1727 and more particularly described as follows:
Beginning at a point 1408.16'South 89 46'25"E. from the
Northwest Corner of Section 5, Township 1, North Range 67 West,
thence due South 585.68', thence due East 360.18', thence due North
585.65', thence due West 360.18' to the point of beginning,
Containing 4.4385.acres more or less.
With respect to the need for a formal ammendment to the
Special Use Permit USR: 524, Martin Exploration does not believe
the division into Lot A and B and the limitation of the permitted
special use to Lot A is a substantial Change requiring an
ammendment under the provisions of the Weld County Zoning Ordinance
Sec. 24.4.2, or constitutes a material deviation as referred to in
Development Standard 11 of the Special Use Permit USR: 524.
Mr. Barker also asked whether or not a wooden fence had been
constructed around Lot A in compliance with Standard 6 of the
Special Use Permit. Martin Exploration built and has maintained
the fence around Lot A since the Special Use Permit was granted in
1982. Please respond to let us know if what we have stated in this
letter is correct and sufficient.

This application for a recorded exemption in the A (Agricultural) zone district was submitted by
Martin Exploration. The parcel of land is described as Lot B of RE -421 being a part of the SW4
NW4 of Section 5, T1N, R67W of the 6th P.M., Weld County, Colorado. The property is located
east of and adjacent to the incorporated Town of Dacono on Weld County Road 15 and
approximately 1/2 mile south of State Highway 52. The request is to divide a 10 acre parcel,
more or less, into two parcels of 5.6 acres and 4.4 acres, more or less.
Central Weld County Water District currently serves proposed Lot A and is proposed for Lot B. A
septic system provides sewage disposal on proposed Lot A and is proposed for Lot B. The Tri-
Area Planning Commission, Weld County Health and Public Works Departments returned referral
comments to staff indicating no conflict with this request. A single access exists at the north
boundary of Lot A from Weld County Road 15. If the recorded exemption is approved, the
applicant wishes to locate a second access near the south boundary (Lot B).
RE -421, approved by the Board of County Commissioners in 1979, divided a 320 acre parcel into
310 acres and 10 acres, more or less. A fence physically separates the 10 -acre parcel at the
approximate location of the boundary line proposed between Lots A and B. Lot A was approved
for an oil and gas field office through the Special Review permit process in 1982; a dwelling
exists as an accessory use to the business on this site. The office has been in operation by
Martin Exploration until recently and is now for sale. Proposed Lot B is used entirely for
agricultural production.
The Department of Planning Services' staff has concerns that the requested division will
potentially remove prime agricultural ground from production. All of Lot B, which is farmed, is
identified as Prime Farmland of National Importance by the United States Department of
Agricultural Soil Conservation Services and the Colorado State University experimental station.
The proposal, if granted, would allow for the addition of a residence on Lot B, reducing the area

for farm production. The Weld County Comprehensive Plan promotes preserving the agricultural
use of prime agricultural ground.
The Department of Planning Services° staff requests that the Board of County Commissioners
consider this request and determine if the criteria for approval of recorded exemptions as stated
in Sections 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance have been satisfied.

COMMENTS: Access to the site is from Weld County Road 15, a gravel -surfaced local road.
The existing single access is located near the north boundary of proposed Lot
A. Proposed Lot A (the location of the oil and gas field office) is fenced,
chain -link on the east and wood -screened on all other sides. This parcel
received approval from Weld County for this use in 1982 (USR-524). A
residence, office and associated structures are on site; however, the business
