Approved with Conditions The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of the County. 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. Prior to recording the plat: -/ A. Due to the prime agricultural soils on Lot B, the applicant shall submit a proposed building envelope to the Department of Planning Services for review. Upon approval by the Department of Planning Services, the building envelope shall be delineated on the plat. O3. The applicant shall utilize the existing access to this parcel as no additional accesses shall be granted. (Lot B) qq3j08.5 REa3o VC. Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation. No additional accesses shall be granted. D. If a drainage culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size your culvert. E. WCR 14.5 is designated on the Transportation Plan Map as a local gravel road, which requires 60 feet of right-of-way at full build out. A total of 30 feet from the centerline of Weld County Road 14.5 right-of-way shall be delineated on the plat. F. Septic systems shall not be split off by the proposed Lot lines. Lot A is not required to comply with the less than thirty-five(35) acre maximum lot size required by Section 11.1.2 of the Weld County Subdivision Ordinance due to the court decree which created the 40 acre parcel. The applicant will provide evidence of adequate access to the parcels along the section line. This may include an easement dedication on the plat, or a deed showing a right-of-way exists. Pursuant to the definition of SETBACK in the Weld '\\. County Zoning Ordinance (Ordinance 89, as amended), the required setback is measured from the future right-of-way line. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. i 3) SE-733 was approved in conjunction with this recorded exemption for the purpose of dividing off a second set of existing improvements from the parcel. 4) Staff supports this application for Recorded Exemption however subsequent Recorded Exemptions on adjacent properties will raise the issue of compliance with the intent of the Recorded Exemption process. Approval of this Recorded Exemption does not guarantee approval of future applications on adjacent properties. ,5) Prior to the release of building permits the applicant shall submit evidence to the Department of Planning Services that Lot A has an adequate water supply of sufficient quality, quantity and dependability. ✓ 6) Prior to the release of building permits on Lot A or B, the applicant will be required to submit a recorded deed describing the lot upon which the building permit is requested with the building permit application. The legal description on such deed shall include the lot and recorded exemption number. ,7) Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Ordinance 169A. 8) The Oil and Gas Commission issues well drilling permits. Therefore, they regulate new well permits and the proximity to existing development. The Oil and Gas Commission recommends that new development shall not be located within 350 feet of existing wells. 9) RIGHT TO FARM COVENANT Weld County is one of the most productive agricultural counties in the United States. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts,including noise from tractors and equipment;dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved"out of the way" of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Weld County covers a land area of over 4,000 square miles in size(twice the State of Delaware)with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed,will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by the Department of Planning Services. The information includes a recorded plat for RE-230, which was not originally brought to the attention of planning staff. Your letter of August 25, 1998 and land survey plat which were submitted to Sheri Lockman, Planner, describes the property as, "Part of the Northwest 1/4 of Section 35, Township 2 North, Range 67 West of the 6th P.M." and contains a metes and bounds legal description. Thanks. 1. Water supply a)District water is available from WCR 21 (via a tap fee)to serve as water for domestic use. A letter from the local water district is attached(see#1-a, exhibit letter). b)Irrigation water is available via'rental'of water shares from the owners of shares(City of Thornton,etc.) as the Ditch goes through the Western end of the 40 acre property in Concrete Conduits. We had to sell our original shares of the Ditch company over a decade and half ago, in order to assist us in sending the children to college. We have been successful in renting water for alphalfa,most of the previous years. 2. The present use of the area is(a)easement(public utility)on the extreme northern edge of property for large electric utility towers/lines (b)easement for entry to oil/gas storage tank located on the eastern edge of the other adjacent parcel of the total 140 acre(Lot 2,Lot B)....the tank is not on this 40 acre site. (c)concrete ditch(open)that carries irrigation water from western side of WCR 21 (under road)to the concrete ditches located on the extreme western edge of this 40 acre site. (d)Occasional use for gazing by neighbors horses, some cows. The size of the parcel(new lot)will be 40 acres(as decreed by court order). 6. No unique physical characteristics on the site noted. Land is rather flat,with a slight rolling shape. 7. All proposed houses/bams will definitely meet minimum setback and offset requirements for the Agriculture District in which the property is located. 8. We are located in between the outer boundaries of expansion for Ft.Lupton,TriCities(Firestone/Fredrich, Dacono), as we have talked with the city officials of those towns and no expansion towards our area is in the plans---which go to 2010(year). Our area is rural mainly, so the 40 acre parcel will be very compatible with the surrounding land uses. 12.It is our understanding the the district wherein this parcel is located is rural/agriculture zoned....with many horse/cattle ranching operations(dairies, horse ranches,cattle ranches)and the county comprehensive plan does wish to maintain small and large rural ranches and farms for the area. This is not a request for a su sion,but an amendment to a Recorded Exe n, separating 40 acres of an initial 160 acre lot,that had a recorded exemption done in 1971 (lot a was 19 acres and lot B was 141 acres). This request is amendment separating lot B(140+/-)into 40 acre lot(via Divorce Court decree) and leaving the remainder 100 acre lot. It is consistent with an efficient and orderly development in that it leaves the remainding acreage with the two homes on it and allows for this 40 acres(not presently used) to become a productive land,with new neighbors living on the 40 acres and improving the land It does not interfere with the health,welfare,or safety of the residents(nearby)of the county,but does assist the neighbors nearby by being a'productive'new resident(on the 40 acre home/farm)via raising cattle, chickens, eggs, and other farm crops/products that will aid the residents in providing food products. Being active on the 40 acre farm enables the'irrigation ditch'to be cleaned and free of debris for the residents serviced down the line(irrigation)and aiding water to their crops. As a productive new resident,there are services that assist the nearby resident of the county,via help on mending fences, assisting with chores, and the like(being neighborly). Recent discussions with nearby municipalities indicated this area is not in their plans to expand(WCR 21, the 40 acres)and letter from Planning/Zoning of Weld county indicated that it will conform(via Court Decree)with various land subdivision plans---the'amendment to a prior Recorded Exemption. In preserving agricultural land and promoting its most productive agrarian use, I believe that since it is not presently having crops but used for occasional horse/cattle grazing....future use of the 40 acres will only enhance the production of crops(alfalfa)via rental water and more careful/effective use of the land for any cattle/horses/chickens/etc.. This will also preserve natural vegetation and cover, and promote the natural beauty of the county.Preventing and controlling erosion, sedimentation and other pollution of subsurface water will also be best done more carefully on this 40 acre location by the new residents. The 40 acres,to our knowledge,is not in a flood hazard overlay district area,nor near a shoreland,poor soil area nor area poorly suited for construction(of one home/barn on 40 acres). Likewise,to our knowledge there are no landslides,mud flows, nor other geologic hazards in this 40 acre location. It is not in wooded terrain.
