This proposal is consistent with the policies of the Weld County Comprehensive Plan in many ways. For example: • Agricultural Goal 4 — This proposal is providing 5 Estate Residential Lots within the County. This site is non prime fannground thus insuring the preservation of quality farmground to remain in production. The Goal states to provide a mechanism for the division of land, which is agriculturally zoned, but to maintain and enhance productive ground. The size of the proposed lots could lend for continuance of agricultural activity, however small, the thinking and making of an Ag based county still would remain as a top priority. Building envelopes and setbacks are also proposed for each individual lot to aid in the protection of views and ensure consistent house and out-building locations as well as minimizing the impacts on surrounding agricultural uses. • Agricultural Goal 6 -Major utilities such as water, electric and telephone are adjacent to the site and readily available. • Agricultural Goal 7—The"Right to Farm Covenant" shall be placed on the Change of Zone Plat and the Final Plat in an effort to provide a measure of protection to adjacent farming activities as well as alerting potential lot owners that long standing agricultural activities shall not surrender to residential uses. • Residential Goal 2 and 3 —As stated above, major utilities such as water, electric and telephone are adjacent to the site and readily available. -1- 991666 2. The proposed uses allowed within this Minor Subdivision shall be uses allowed by right as restricted and/or regulated by the (E) Estate Zone District in which this property will be located. Currently, the subject property is located within the (A) Agricultural Zone District. Through the Minor Subdivision process,it is our intent to change the existing zoning to(E)Estate Zoning. Examples of such uses allowed within the Estate Zone District are, but not limited to, one single family dwelling per legal lot, light agricultural and/or livestock environments such as equestrian or 4-H Club projects and accessory buildings as per Bulk Requirements. The uses permitted within the (E) District are similar to those allowed within the (A) District, just slightly on a smaller more controlled scale. With both, the existing and proposed uses and zoning, being so close in use by right classification, it creates a subtle transition between agricultural production and large lot rural development thus ensuring a harmonious and compatible environment between the two Districts. Surrounding land uses adjacent to the site include: North — Agricultural ground, single family residence, Greeley No. 2 Ditch(approx. 400 feet North at its closest point),Lindies Lake (approx. mile North). East — Agricultural ground. South — WCR 66, agricultural ground, single family residence, oil and gas production. West — Agricultural ground, single family residence, WCR 51 (approx. 'A mile West). 3. Each lot for the proposed Minor Subdivision shall have an Individual Sewage Disposal System (ISDS)installed per the Weld County Health Department requirements and specifications. 4. Domestic water and water for Fire Protection shall be provided by Northern Weld County Water District (see attached water letter dated October 23, 1997). Currently NWCWD has a watermain within Weld County Road No. 66. This proposal will tap into said watermain and install a watermain from WCR 66 to the proposed cul-de-sac within the Minor Subdivision. The proposed watermain will be installed per NWCWD Standard Requirements and Specifications. Each lot shall have an individual water meter. 5. There are no soils limitations for this site. See attached Soils Report prepared by Foundation Engineering. 6. The proposed Minor Subdivision will have one access off of Weld County Road No. 66. Said access will be a private Access, Utility, Drainage and Irrigation Easement being 60' in width and approximately 850' in length terminating with a cul-de-sac having a 65' radius. The cul-de-sac will contain a 50' vehicular turn-a-round radius. The roadway shall consist of two (2) 10' driving lanes and have a minimum depth of four (4) inches of gravel base (see attached Sketch Plan Map). All lots within this proposal shall have access onto the internal road system only. No lots shall be permitted to access directly onto Weld County Road No. 66. There is an existing entrance off of WCR 66 to an OiUGas tank battery. We propose this access to remain in place, however, a note shall be placed on all applicable plats indicating the restrictive use of said access to the tank battery by Oil/Gas traffic only. All access points, including the internal road and all driveways off the internal road, shall have a minimum turning radius of 20 feet. Weld County Road No. 66 is classified as a Ifrator road. Its width and structural appearance should have the ability to handle the increased traffic load of this proposed 5 Lot Minor Subdivision. State Highway 392 is approximately 1.5 miles northeast of this site providing arterial road transportation to and from many destinations. -2- 981766 7. Economic mineral resources were not found on the subject site. See attached Geological Investigation Report prepared by Foundation Engineering. 8. The Change of Zone area is not located within a Flood Hazard Overlay District. 9. The Change of Zone area is not located within a Geologic Hazard Overlay District. 10. The Change of Zone is not located within the AP(Airport)Overlay District. 11. There is an existing well head and tank battery currently located within the proposed Minor Subdivision. A meeting took place at the site on 12-29-97 with the Oil and Gas company representatives and the applicant The meeting was arranged to discuss this proposal and to acquire locates of their underground facilities(buried pipelines)to ensure the protection of said facilities and the proper placement of easements, access points and setbacks. They had no conflicts or objections with this proposal as long as setbacks, access and facility easements are addressed through the process. As always,if you should have any question, concerns or desire additional information regarding this Minor Subdivision Change of Zone submittal;please feel free to call me at(970)669-0516.
