HomeMy WebLinkAbout990071.tiff RESOLUTION RE: APPROVE MARTIN RESUBDIVISION (LOT LINE ADJUSTMENT ONLY) OF LOTS 1 AND 13 OF TWOMBLY RANCH -WALTER AND ELIZABETH MARTIN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 11th day of January, 1999, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Walter and Elizabeth Martin, 24508 State Highway 52, Hudson, Colorado 80642, for Martin Resubdivision (Lot Line Adjustment Only) of Lots 1 and 13 of Twombly Ranch on the following described real estate, to-wit: Lots 1 and 13, Twombly Ranch, being part of Section 7, Township 1 North, Range 64 West of the 6th P.M., Weld County, Colorado WHEREAS, said applicant was present, and WHEREAS, Section 8.3 of the Weld County Subdivision Ordinance provides standards for review of said Resubdivision (Lot Line Adjustment Only), and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of Weld County Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 8.3.1 of the Weld County Subdivision Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 8.3.2 of the Weld County Subdivision Ordinance as follows: a. Section 8.3.2.3.1 -- How the lot line revision complies with the approved recorded final plat. 1) The proposed lot line revision is consistent with the existing uses within the subdivision. The proposed lot line adjustment does not create any new lots. The lot line between Lots 1 and 13 is being adjusted to conform to Boxelder Creek which currently divides Lot 1. Lot 13 will increase in size from 2.63 acres to 16.817 acres. Lot 1 will decrease in size from 40 acres to 25.813 acres. 2) No easements will be affected by this Resubdivision. Section 8.3.2.3.2 - How the application complies with the adopted rules, regulations, and ordinances currently in force and affecting the subdivision. 1) The Conditions of Approval address the issues concerning the regulations and ordinances that affect this proposal. The proposed lot line adjustment will not create any problems with the existing circulation on the site. The eastern lot includes an existing residence with existing access to State Highway 52. The applicant indicated to the Department of Planning Services during a phone conversation that access to the western lot will be from Weld County Road 49. 2) The existing structures will comply with all setback and offset requirements of the Weld County Zoning Ordinance. The Weld County Departments of Building Inspection, Public Works, and Health have reviewed this request and find no conflicts. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Walter and Elizabeth Martin for a Resubdivision (Lot Line Adjustment Only) of Martin Subdivision, a replat of Lots 1 and 13 of Twombly Ranch, on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The Resubdivision plat shall be submitted to the Department of Planning Services for recording within 30 days of approval by the Weld County Board of County Commissioners. 2. Prior to recording the plat: a. The Resubdivision plat shall meet all requirements of Section 8.3.1.5 and shall include the certificates and seals in accordance with Sections 4.5.21.20.1, 4.5.21.20.2 and 4.5.21.20.3. b. The applicant shall submit a proposed building envelope on Lot 1 to the Department of Planning Services for review. Upon approval by the Department of Planning Services, the building envelope shall be delineated on the plat. c. The applicant shall submit a completed Weld County Access Information Sheet to the Weld County Public Works Department for review. Evidence of Public Works Department approval shall then be submitted to the Department of Planning Services. d. The applicant shall attempt to address the requirements of the Hudson Fire Protection District. The following notes shall be delineated on the plat: 1) The lots shall maintain compliance, at all times, with the requirements of the Weld County Departments of Planning Services, Building Inspection, Public Works and Health. 2) Installation of utilities shall comply with Section 12 of the Weld County Subdivision Ordinance. 3) A Weld County Septic Permit is required for any proposed home septic system(s) and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 4) All construction or improvements occurring in the flood plain as delineated on FEMA Community Panel Map#080266 1025C shall comply with the Flood Hazard Overlay District requirements of Section 26 of the Weld County Zoning Ordinance. 5) The installation of any septic system within the 100-Year Flood Plain shall comply with the Weld County I.S.D.S. Flood Plain Policy. In accordance with the Colorado I.S.D.S. Regulations, no septic system shall be installed within the floodway. f. As access has not been addressed by the proposal, it is difficult to make comment. If no traffic increase is proposed,then COOT would not have the warrant necessary to re-evaluate access. if a 20%increase of traffic is proposed,then CDOT would request that a single access point serve both Lots 1 and 13. The access should be located equidistant from the county roads if possible. Projected traffic along this section of State Highway(SH) 52 indicates the need for a 150 foot total right- of-way, 75 feet either side of the highway centerline. Additional width to meet the projected need should be protected by reservation or preferably, dedication as permitted by County regulations.
