RE: APPROVAL OF RECORDED EXEMPTION #1695 - BAKER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1695, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1695 was submitted by LeRoy and
Nancy Baker, 361 Hunter Ridge Drive, Longmont, Colorado 80504, for property which is described
as Lot B of Recorded Exemption #456, being part of the W'/: of Section 36, Township 5 North,
Range 64 West of the 6th P.M., Weld County, Colorado, being more particularly described in the
plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded,
and
WHEREAS, this request is to divide the property into parcels estimated to be approximately
199.0 acres and 5.6 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1695 submitted by
LeRoy and Nancy Baker be, and hereby is, approved conditional upon the following:
1. A Weld County septic permit is required for any proposed home. The septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(ISDS) regulations.
2. An ISDS permit shall be finalized and approved by an Environmental Protection
Specialist within one (1) year of the application date.
3. No additional (new) access to either Lot A or Lot B shall be allowed, except for a
new access from Weld County Road 59 to Lot A to be located on the southern end
of Lot A. Said new access shall comply with the requirements for accesses to
County roads set forth in Weld County Ordinance #180. The existing access from
Weld County Road 59 to Lot A shall be abandoned. The existing access from Weld
County Road 59 to Lot B, which is located immediately south of Lot A, shall also be
abandoned.

4. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 8th day of February, A.D., 1995.

This application for a recorded exemption in the A (Agricultural) zone district was submitted by
LeRoy J. and Nancy J. Baker. The parcel of land under consideration is described as Lot B of
RE -456, being a part of the W2 of Section 36, T5N, R64W of the 6th P.M., Weld County,
Colorado. The property is located north of and adjacent to Weld County Road 50 and east of and
adjacent to Weld County Road 59. This request is to divide a 204.6 acre parcel into two parcels
of 199 acres and 5.6 acres, more or less. The property's primary land use is agricultural
production; five oil and gas wells are located on the site as well. No residences exist on the
parcel at the present time.
Access to the property is from both Weld County Roads 50 and 59. The five existing accesses
currently have a dual function of serving the agricultural and oil and gas uses on the parcel. The
applicants desire to abandon one access and convert one access, both located on Weld County
Road 59, to residential use for proposed Lot A. Central Weld Water District is proposed as the
water source, and septic systems are proposed for sewage disposal on both lots. The Weld
County Health and Public Works Departments have reviewed this application and have no
conflict with the request.
The subject property is Lot B of RE -456, which was approved by the Board of County
Commissioners in 1980. The approval of RE -456 divided a 211.9 acre parcel into 204.6 and
7.3 acres, more or less. In 1988, the approval of RE -1117 allowed further subdivision of Lot A
of RE -456 into two parcels of 6.1 and 1.2 acres, more or less. These parcels lie west of and
adjacent to the site under consideration; each contain a residence and farm structures. Proposed
Lot A of RE -1695 is situated north of these residences and is fenced off from the balance of the
farmground (proposed Lot B).

The Department of Planning Services' staff has concerns that the proposed division is
inconsistent with efficient and orderly development and does not comply with Agricultural and
Transportation goals and policies as stated in the Weld County Comprehensive Plan. Further, it
is the opinion of staff that sufficient reasons have not been given by the applicants to warrant
creating an additional lot at this time.
The applicants wish to construct their residence on the existing 204.6 acre parcel, which is a use
by right. They have indicated that they may wish to sell either proposed Lot A or B sometime in
the future. The division of this property would create two buildable lots, which would likely
occur along Weld County Road 59 where the two residences created by RE -1117 already exist.
Two additional residences at this location would contribute to a sprawl, row -type development,
which is in conflict with efficient and orderly development. Staff believes the applicants' intent
can be accomplished without a resubdivision of the parcel, as the parcel is eligible for a building
permit as it exists now.
The Baker property is not located within any Urban Growth Boundary area of the County nor
any municipality's comprehensive plan area. The Town of Kersey is more than three miles from
the site. Agricultural policy #3 encourages minimizing the incompatibilities that occur between
agricultural uses and urban -type uses and discourages the conversion of agricultural land to
residential development.
Weld County Road 59 is classified as a county collector. Transporation policies of the County
Comprehensive Plan state that access along a collector should be kept to a minimum to maximize
traffic flow and promote safety. Although the applicants are not requesting additional accesses
for the property, an increase in residential land use intensifies access useage and trip traffic
significantly over what is currently existing.
The Department of Planning Services' staff requests that the Board of County Commissioners
consider this proposal and determine if the standards of Sections 11.5.1 through 11.5.7 of the
Weld County Subdivision Ordinance have been satisfied.

COMMENTS: Accesses to the property are from Weld County Road 50 (gravel
local road) and Weld County Road 59 (paved collector road). Proposed Lot A appears to

Your recorded exemption application will be processed on or before January 30, 1995. If it is determined
that the application meets the approval criteria of the Weld County Subdivision Ordinance, you will be
notified that the recorded exemption is approved. If the staff determines that the application does not meet
the approval criteria, you will be notified and asked to appear before the Board of County Commissioners
at a public hearing. You will be informed of the hearing date prior to the hearing. The Board of County
Commissioners will then consider your application and make a final decision on the recorded exemption.
