VETERINARY CLINIC IN THE A (AGRICULTURAL) ZONE DISTRICT - MARK AND
JANESE POWELL
A public hearing was conducted on September 16, 1998, at 10:00 a.m., with the following present:

Commissioner Barbara J. Kirkmeyer

The following business was transacted:
I hereby certify that pursuant to a notice dated August 14, 1998, and duly published September 2,
1998, in the Platteville Herald, a public hearing was conducted to consider the request of Mark and
Janese Powell for a Site Specific Development Plan and Special Review Permit #1196 for a
Veterinary Clinic in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney,
made this a matter of record. Ben Patton, Department of Planning Services representative,
presented a brief summary of the proposal and entered the favorable recommendation of the
Planning Commission into the record as written. Mr. Patton stated the site is located on non-prime
farmground; the applicants intend to use the existing buildings for the clinic; and they will submit a
parking plan prior to recording the plat to provide for the traffic generated by ten to thirty customers
per day and eight employees. In response to Commissioner Kirkmeyer, Mr. Patton stated Condition
#2.A.2 is not necessary and should be deleted. Responding to Commissioner Webster, Mr. Patton
stated the clinic will treat both small and large animals.
George Ottenhoff, Attorney, represented the applicants and stated they are in agreement with the
Conditions of Approval and Development Standards with the deletion of Condition #2.A.2.
No public testimony was offered concerning this matter.
Mr. Morrison recommended adding verbiage referencing Section 90 of the Weld County Zoning
Ordinance which states a vested property right will be created for a period of three years with the
approval of this Use by Special Review Permit. Mr. Ottenhoff stated there is common law vesting
because structures already exist; however, the applicants are not opposed to including the
additional wording.

Commissioner Webster moved to approve the request of Mark and Janese Powell for a Site Specific
Development Plan and Special Review Permit#1196 for a Veterinary Clinic in the A (Agricultural)
Zone District, based on the recommendations of the Planning staff and the Planning Commission,
with the Conditions of Approval and Development Standards as entered into the record with the
deletion of Condition#2.A.2, and addition of Development Standard #1 concerning the creation of
a vested property right, and renumbering the following paragraphs. The motion was seconded by
Commissioner Hall, and it carried unanimously.
This Certification was approved on the 21st day of September, 1998.
