J .•00-640 0 O •U 4. = ..f I A QVo2I AJ.NnoO CI -13M -... a z 0 W O �ct:u� cp J O n • 6e r 7 a • • RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #1763 - PRISTINE INVESTMENTS, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1763, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1763 was submitted by Pristine Investments, LLC, 745 North Lincoln Avenue, Loveland, Colorado 80537, for property which is located in part of the SW% of Section 6, Township 4 North, Range 68 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 7.62 acres and 7.49 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1763 submitted by Pristine Investments, LLC, be, and hereby is, approved conditional upon the following: 1. The Office of the Corps of Engineers shall be contacted for proper Department of the Army permits prior to any work in the wetland designation area. 2. The applicant shall adhere to the requirements set forth by the Berthoud Fire Protection District in a letter dated July 24, 1995, by Rick Slaby, Assistant Chief. In the event the system(s) is found to be inadequate, the system(s) must be brought into compliance with current ISDS regulations. 4. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 5. The plat shall show the areas designated as wetlands as determined by Riverside Technology, Inc. 6. Only one access shall be allowed per legal lot. The parcel of land is described as part of the SW4 of Section 6, T4N, R68W of the 6th P.M., Weld County, Colorado. The property is located north f and adjacent to Weld County Road 48 and West of and adjacent to Weld County Road 1. The request is to divide a 15 acre parcel into two parcels of 7.62 and 7.49 acres, more or less. Little Thompson Water District is the proposed water source for both lots. Septic systems are the proposed sewage disposal for both lots. Access is existing for Lot A onto Weld County Road 1 and is proposed onto Weld County Road 48 for Lot B. Comments have been received from various referral agencies and have been incorporated into the recommendation. The 15 acre parcel, upon which the recorded exemption is being requested, was formerly the Lucy - Murphy State Park (Abrams Lake). The State of Colorado Division of Wildlife recently sold this 15 acre parcel because of its small size and limited potential for habitat development. The applicant has since acquired the 15 acre parcel and is requesting to split the property into two building sites for residential construction. The Department of Planning Services' staff has concerns that the proposed division is inconsistent with efficient and orderly development and with the agricultural goals and policies as stated in the Weld County Comprehensive Plan. The applicant currently has the right to place a single-family dwelling on the existing 15 acre parcel. This request, if approved, would allow for a residence on Service, Teamwork, Integrity, Quality S, 7.3 IO' .3 Pristine Investments, LLC• RE -1763 Page 2 • both Lots A and B, greatly intensifying the residential uses on the property. Staff also has concerns regarding the piecemeal development that is occurring in this area of the County. This is the ninth request for a recorded exemption in this section. Portions of the subject property have been delineated by the Corp of Engineers as wetlands. Staff has concerns that the any development that occurs on the parcel that the applicant obtain proper permits from the Corps of Engineers. The Comprehensive Plan allows a lot in the A (Agricultural) Zone District to be divided into two separate parcels if the intent of the recorded exemption is met. The applicant however is not able to satisfy any of the three established criterion. The Department of Planning Services' staff requests that the Board of County Commissioners consider this proposal and determine if the standards of Section 11.5.1 through 11.5.7 of the Weld County Subdivision Ordinance have been met. The area is located on unusable ground agriculturally. Therefore, to promote this area for low density residential development would be consistent within the Weld County Comprehensive Plan. 4. EXPLAIN HOW THE USES PERMITTED WILL BE COMPATIBLE WITH EXISTING USES SURROUNDING THE PROPOSED RECORDED EXEMPTION. The proposed lots are going into an area of both agricultural and residential use and will be utilizing non-productive land for two residential sites. These two sites will be larger acreage residential parcels which will promote agricultural hobbies making this proposal compatible with existing agricultural and residential uses. 5. EXPLAIN HOW THE PROPOSAL IS CONSISTENT WITH THE INTENT OF THE ZONING DISTRICT IT IS LOCATED WITHIN. The zoning district that this proposal is within is agricultural, but the fact that the land is non-productive is favorable for low density residential development. The "A" district allows by right one single family dwelling unit per legal lot thus making this proposal consistent with the Weld County Zoning Ordinance. 951.643 • 6. EXPLAIN HOW THE PROPOSAL IS CONSISTENT WITH EFFICIENT AND ORDERLY DEVELOPMENT. This proposal is requesting two lots to be created, containing 7.49± acres and 7.62± acres. All the public utilities are adjacent and accessible to the proposed parcels thus insuring efficient and orderly development. 7. Our fishery biologists have requested that a closure to fishing be placed on Abrams Lake as part of the Recorded Exemption. Failing that, the Division would request a statement that all Sacramento Perch caught in Abrams Lake be returned to the water immediately upon catch, as part of the Recorded Exemption document. The proposed development is located at Abrams Lake, which is southeast of Campion in Weld County, Colorado. Weld County requires a letter from an individual who is qualified to delineate jurisdictional wetlands regarding the presence or absence of wetlands on lands proposed for development. Jurisdictional wetlands are wetlands areas that fall into the domain of regulatory oversight. This report is written to satisfy this requirement for proposed land development. The wetlands delineation described in this report identified 2.21 acres of jurisdictional wetlands within the proposed development area. The jurisdictional wetlands are primarily located along the shoreline of Abrams Lake. 1.1 Purpose The purpose of this report is to document a study to identify and delineate jurisdictional wetlands within the 15.11 -acre parcel of the Pristine Inv., LLC site in Weld County, Colorado, to satisfy Section 404 of the Clean Water Act. Section 404 authorizes the U.S. Army Corps of Engineers (COE) to issue permits for discharging dredged or fill material into waters of the U.S., which include wetlands. 1.2 Site Location The study site consists of a proposed filing called the Pristine Inv., LLC project site (referred to hereafter as the Pristine site). The Pristine site is currently slated for proposed real estate development; if the site is developed, it will contain two single family residential developments. A map showing the general location of the Pristine site is provided in Appendix A. The Pristine site is located in the southwest corner of Section 6, Township 4 North, Range 68 West of the 6th P.M. in the County of Weld, State of Colorado. Coordinates for the site were estimated from a U.S. Geological Survey (USGS) 7.5 -minute quadrangle map (USGS 1984) and are west 105° 03' 10" longitude and 40° 20' 10" north latitude. 1.3 Site Description The majority of the Pristine survey area consists of an upland grassland and the southeast portion of Abrams Lake. A wetland zone consisting primarily of cattails (Typhus latifolia) and bulrushes (Cornus spp.) exists along the lake shore. A small area of trees and shrubs exists in the southwest corner of the property. It appears that many of the trees and shrubs in this portion of the property had been planted at an earlier time, especially the junipers. Remnants of two roads are also evident in the tree/shrub area. The general slope and drainage pattern of the site is from upland areas toward the lake (0-3%). No distinct stream channel goes through the site; hydrology for the site appears to be ground -water -based. Just prior to the survey, the upland area and some of the wetlands areas were mowed. This created some problems in distinguishing vegetation types because of the absence of seedheads, flowers, and leaves on some of the herbaceous plants. However, sufficient seedheads of plants were present in unmowed areas to allow for vegetation species identification. A337 07.93 PPV-TXT.DOC 1 951643 • • 2.0 PROFESSIONAL QUALIFICATIONS The jurisdictional wetlands identifications and delineations were conducted by Stephen W. Johnson and Terry Geiselman of Riverside Technology, inc. (RTi). Mr. Johnson has 9 years of experience as a Water Quality Hydrologist and 5 years of experience in conducting jurisdictional wetlands studies in Colorado, Wyoming, and California. He is recognized by the COE under Regulatory IV to identify and delineate wetlands as part of the Section 404 process of the Clean Water Act. Mr. Johnson also has experience in conducting surveys along the Front Range of Colorado for the federally -threatened Ute ladies' -tresses orchid (Spiranthes diluvialis). Mr. Johnson's educational background includes a B.S. in Biology with a minor in Chemistry, an M.S. in Plant Ecology, and an M.S. in Water Quality Hydrology. He is a member of the Society of Wetlands Scientists, Rocky Mountain Chapter. Mr. Johnson is also the program manager of the State Wetlands Protection Program for the Campo Band of Kumeyaay Indians in southern California. Mr. Geiselman is a Registered Geologist who is currently training under Mr. Johnson on several jurisdictional wetlands delineation projects and endangered species surveys. He also assists in writing and preparing the technical reports documenting the results of these activities. As part of his training, Mr. Geiselman has participated in jurisdictional wetlands surveys in Colorado and Wyoming and has prepared final documentation on the results of several surveys. Mr. Geiselman's qualifications include a B.S. in Geology, studies in hydrogeology and environmental science, 1 year of experience conducting jurisdictional wetland studies, and over 5 years of water resources related work. The wetlands delineation described in this document was conducted during the growing season. The growing season is also important in determining whether the wetlands hydrology criterion is met. Areas that are at least intermittently inundated or saturated for 5 percent or more of the growing season are considered evidence of hydrologic characteristics that can support wetlands. In addition to wetlands hydrology information collected in the field, information on the hydrology of soils in the area during the A337 07.95 PPV-TXT.DOC 3 951643 • • growing season was obtained from U.S. Department of Agriculture (USDA) Soil Survey maps to support a wetlands hydrology determination. The growing season is defined in the Corps of Engineers Wetlands Delineation Manual (COE 1987) as the portion of the year when soil temperatures at 19.7 inches below the soil surface are higher than biological zero (5°C). However, for ease of determination, the COE manual allows for an approximation of the growing season by the number of frost -free days. In the Fort Collins/Loveland area, there are, on average, 144 frost -free days per year. The average first frost -free day occurs the first week of May, and the average last frost -free day occurs at the end of September/beginning of October. Five percent of 144 days is 7.2 days, or approximately 1 week. 33 Routine Procedures The routine procedure selected for identifying and delineating wetlands is a multi -parameter approach requiring positive evidence of hydrophytic vegetation, hydric soils, and wetlands hydrology. If these parameters are met, the area is determined to be a jurisdictional wetlands. The following routine procedure is adapted from the Corps of Engineers Wetlands Delineation Manual (COE 1987), which provides a logical, defensible, and technical basis for wetlands delineation. This routine procedure stresses on -site inspection together with preliminary data gathering and synthesis of available information. Procedures for making routine wetlands determinations when insufficient information is available for one or more parameters are described in this section. At each sampling point, the vegetation present was categorized using the National List of Plant Species that Occur in Wetlands: Central Plains (Region 5) (Reed 1988) and Rocky Mountain Flora (Weber 1976). Table 1, Plant Indicator Status Categories, was taken from the Corps of Engineers Wetlands Delineation Manual (COE 1987) and provides definitions and information concerning the indicator symbols. Table 2 lists the dominant plant species that occur at the Pristine site and provides the indicator status of each. An on -site inspection was determined to be required at the Pristine site and was conducted as outlined below. All procedures are adapted from the Corps of Engineers Wetlands Delineation Manual (COE 1987). A Data Form 1 was completed for each of the sampling sites. Copies of all data sheets are included in Appendix B. Steps taken during the on -site inspection are described below: • Step 1: Locate the project area. Determine the spatial boundaries of the project area using information from a USGS quadrangle map or other appropriate map, aerial photography, and/or the project survey plan (Loveland Realty 1995, USFWS 1975, and USGS 1984). Proceed to Step 2. • Step 2: Determine whether an atypical situation exists. Examine the area and determine whether there is evidence of sufficient natural or human - induced alteration to significantly alter the area vegetation, soils, and/or hydrology. Include possible off -site modifications that may affect the area hydrology. If there is no such evidence, proceed to Step 3. Using Section F, determine whether there is sufficient evidence that hydrophytic vegetation, hydric soils, and/or wetlands hydrology were present prior to this alteration. (No atypical situations existed at the Pristine site. The grasses at the site had been cut; however, sufficient seedheads of plants were present in uncut areas to allow for vegetation species identification.) • Step 3: Identify the plant community type(s). Traverse the area and determine the number and locations of plant community types. Sketch the location of each on the base map, and give each community type a name. (The majority of the Pristine site was determined to consist of three plant communities: (1) an upland prairie grasses community, (2) a vegetated shoreline community, and (3) an emergent and submergent vegetation lake community. A small area in the southwest corner of the property consisted of an upland tree community and wetland community with shrubs and herbs. The determined communities were not mapped but were identified on each Data Form 1.) Proceed to Step 4. • Step 4: Determine whether normal environmental conditions are present. Determine whether normal environmental conditions are present by considering the following: a. Is the area presently lacking hydrophytic vegetation or hydrologic indicators because of annual or seasonal fluctuations in precipitation or ground water levels? b. Are hydrophytic vegetation indicators lacking because of seasonal fluctuations in temperature? If the answer to either question a or b is thought to be yes, proceed to Section G of the Corps of Engineers Wetlands Delineation Manual (COE 1987), which outlines methods for dealing with problem areas. Problem areas are defined as areas in which wetlands indicators of one or more parameters are periodically lacking because of normal seasonal or annual variations in environmental conditions that result from causes other than human activities or catastrophic natural events. If the answer to both a and b is no, proceed to Step 5. (There were no problem areas identified at the Pristine site.) • Step 5: Select representative observation points. Select a representative observation point in each community type. A representative observation point is one in which the apparent characteristics (determine visually) best represent characteristics of the entire community. Mark on the base map the approximate location of the observation point. (This was done for each observation point selected at the Pristine site. Observation points are identified on the site map in Appendix A. Between observation points, the boundary lines were visually determined and staked based on observed vegetation changes.) Visually determine the dominant plant species in each vegetation layer of each community type and record them on Data Form 1 (use a separate Data Form 1 for each community type). Dominant species are those having the greatest relative basal area (woody overstory), greatest height (woody understory), greatest percentage of area cover (herbaceous understory), and/or greatest number of stems (woody vines). (The observation points at the Pristine site were characterized by one vegetation layer and a consistent herbaceous layer. A small area of trees and shrubs exists in the southwest corner of the property. Completed data forms are in Appendix B.) Proceed to Step 7. • Step 7: Record indicator statusof dominant plant species. Record on Data Form 1 the indicator status of each dominant plant species in each community type. (Completed data forms for the Pristine site are in Appendix B and results are presented in Section 4, Table 3.) Proceed to Step 8. • Step 8: Determine whether hydrophytic vegetation is present. Examine each Data Form 1. When more than 50 percent of the dominant species in a community type have an indicator status of OBL, FACW, and/or FAC, hydrophytic vegetation is present. Portions of the area failing this test are not wetlands. (At the Pristine site, the "50/20 Rule" was applied.) The "50/20 Rule" is a procedure that entails the following: For each stratum in the plant community, dominant species are the most abundant plant species (when ranked in descending order of abundance and cumulatively totaled) that immediately exceed 50 percent of the total dominance measure for the stratum, plus any additional species comprising 20 percent or more of the total dominance measure for the stratum. Complete the vegetation section of each Data Form 1. (Completed data forms for the Pristine site are in Appendix B and results are presented in Section 4.0, Table 3.) Proceed to Step 9. • Step 9: Apply wetlands hydrologic indicators. Examine the portion of the area occupied by each plant community type for positive indicators of wetlands hydrology. Record findings on the appropriate Data Form 1. (Information for determining hydrology was also obtained from USDA 1980.) Proceed to Step 10. • Step 10: Determine whether wetlands hydrology is present. Examine the hydrologic information on Data Form 1 for each plant community type. Any portion of the area having a positive wetlands hydrology indicator has wetlands hydrology. If positive wetlands hydrology indicators are present in all community types, the entire area has wetlands hydrology. If no plant community type has a wetlands hydrology indicator, A337 07.95 PPV-7XT.DOC 7 951.643 • • none of the area has wetlands hydrology. Complete the hydrology portion of each Data Form 1. (Completed data forms for the Pristine site are in Appendix B and results are presented in Section 4.0, Table 3.) Proceed to Step 11. • Step 11: Determine whether soils must be characterized. Examine the vegetation section of each Data Form 1. (Completed data forms for the Pristine site are in Appendix B and results are presented in Section 4.0, Table 3.) Hydric soils are assumed to be present in any plant community type for which the following statements are true: a. All dominant species have an indicator status of OBL. b. All dominant species have an indicator status of OBL or FACW, and the wetlands boundary (when present) is abrupt. When either a or b is true and wetlands hydrology is present, check the hydric soils blank as positive on Data Form 1 and proceed to Step 16. (At the Pristine site, a soil pit was dug at every selected observation point in each community type, even when a and/or b were true.) If neither a nor b applies, proceed to Step 12. • Step 12: Dig a soil pit. Using a soil auger or spade, dig a soil pit at the representative location in each community type. The procedure for digging a soil pit is described in Appendix D, Section 1, of the Corps of Engineers Wetlands Delineation Manual (COE 1987). When the soil pit is properly completed, approximately 18 inches of the soil profile will be available for examination. (At the Pristine site, a soil pit was dug with a spade to 18 inches at each observation point for a total of 4 documented pits.) Proceed to Step 13. • Step 13: Apply hydric soil indicators. Examine the soil at each location and compare its characteristics immediately below the A - horizon or at a 10 -inch depth (whichever is shallower) with the hydric soil indicators described in Part III, paragraphs 44 and/or 45 of the Corps of Engineers Wetlands Delineation Manual (COE 1987). (For the Pristine site, soil samples were collected in the B horizon at depths of 10 inches.) Record findings on the Data Form 1 for each location. Proceed to Step 14. • Step 14: Determine whether hydric soils are present. Examine each Data Form 1 and determine whether a positive hydric soil indicator was found. If so, the area at that location has hydric soil. If soils at all sampling locations have positive hydric soil indicators, the entire area has hydric soils. If soils at all sampling locations lack positive hydric soil indicators, none of the area is a wetlands. Complete the soil section of each Data Form 1. (Completed data forms for the Pristine site are in Appendix B and results are presented in Section 4.0, Table 3.) Proceed to Step 15. If the entire area presently or normally has wetlands indicators for all three parameters (Steps 8, 10, and 14), the entire area is a wetlands. If the entire area presently or normally lacks wetlands indicators of one or more parameters, the entire area is a non -wetlands. A337 07.95 PPV-7XT.DOC 9 951643 • • 4.0 RESULTS Table 3 summarizes the results of the multi -parameter approach to wetlands delineations for each sampling location. The delineated wetlands areas are shown on the site map in Appendix A. A total of 2.21 acres of jurisdictional wetlands were identified during the survey. The National Wetlands Inventory (NWI) Map for the Berthoud quadrangle (USFWS 1975) identifies wetlands areas on the project site. According to the Cowardin system (Cowardin 1979), the 2.21 acres of jurisdictional wetlands identified were classified as Lacustrine wetlands type. The Lacustrine System includes wetlands and deepwater habitats with all of the following characteristics: (1) situated in a topographic depression or a dammed river channel; (2) lacking trees, shrubs, persistent emergents, emergent mosses or lichens with greater than 30% areal coverage; and (3) total area exceeds 8 ha (20 acres). Similar wetland and deepwater habitats totaling less than 8 ha are also included in the Lacustrine System if an active wave -formed or bedrock shoreline feature makes up all or part of the boundary, or if the water depth in the deepest part of the basin exceeds 2 m (6.6 feet) at low water. The Corps of Engineers Wetlands Delineation Manual (COE 1987) includes as wetlands any areas that are inundated either permanently or periodically at a mean water depth of less than 6.6 feet. Therefore the wetlands boundary was extended 30 feet into the lake area (the approximate boundary where the rooted -emergent and submergent plants ended). Water depths were not measured but were estimated to be less than 6.6 feet. The area beyond this boundary is classified as "deepwater habitat," which is a water of the U.S. but not a jurisdictional wetland. Field notes are in Appendix B. 4.1 Vegetation The majority of the jurisdictional wetlands area identified consisted of a consistent herbaceous layer of hydrophytic vegetation. The most common vegetation types in the wetlands area consisted of cattails (Typha latifolia), bulrushes (Scirpus spp.), and inland saltgrass (Distichlis spiccala). Upland areas throughout the site were generally a consistent vegetation cover of western wheatgrass (Agro. smithii) and smooth brome (Bromus inermus). A small area of the wetlands in the southwest corner of the property consisted of cattails (Typha latifolia) and overstory vegetation consisting of dogwood (Cornus spp.). The upland portion of this area contained red cedar (Juniperus virginiana). 4.2 Soils The Pristine site was comprised of two soil series as mapped by the Soil Conservation Service (USDA 1980). The jurisdictional wetlands areas were generally contained in the Nunn clay loam (1- 3% slopes) and the Wiley -Colby complex (3 - 5% slopes). Neither of these soils are listed as hydric in the Soil Conservation Service comprehensive hydric soils list for Weld County (1993). The upland areas consisted primarily of Nunn clay loam (1-3% slopes). 4.3 Hvdroloav The wetlands area (and lake) appears to be primarily the result of ground water discharge. No distinct stream or drainage channels are evident at the site. The wetlands area and lake occur in a depression in the topography that extends below the existing water table. Runoff resulting from precipitation events most likely supplements the water in the lake. A337 07.95 PPV•TXT.DOC 11 951643 • • 5.0 RECOMMENDATIONS The wetlands delineation described in this report has been submitted to the COE, Omaha District, Tri-Lakes Project Office, in Littleton, Colorado. Acceptance will be conveyed in the form of a letter. If accepted, the COE will recommend that this wetlands delineation be considered valid for 3 years from the date of the letter unless new information warrants revision before the 3 years expire. A COE Section 404 permit may be required based on the area of disturbance to jurisdictional wetlands as a result of the development.
