HomeMy WebLinkAbout992703.tiff RESOLUTION RE: GRANT MOBILE HOME PERMIT, ZPMH #2167 - PAUL AND PATRICIA REDIN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 8th day of November, 1999, considered the request of Paul and Patricia Redin, 365 Linden Street, Eaton, Colorado 801315, for a mobile home to be used as a principal dwelling, and WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Lot 8, Block 2, East Side Addition; being part of the SW1/4 of Section 31, Township 7 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard all of the testimony, finds that said request should be granted subject to the following conditions: 1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home on the property. 2. Prior to the occupancy of the mobile home, the mobile home shall be connected to adequate water and sewage disposal facilities. 3. The mobile home shall meet the minimum setback and offset requirements for the A (Agricultural) Zone District. 4. The mobile home shall be installed in accordance with the Weld county Building Code Ordinance #119. 5. The mobile home shall not be occupied until such time that the applicant has complied with Conditions 1 through 4, as stated above. 6. The applicant shall utilize the existing access. No additional accesses will be granted. 7. Linden Street is designated on the Transportation Plan Map as a local gravel road, which requires 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld County. Pursuant to the definition of setback in the Weld County Zoning Ordinance#89, as amended, the required setback is measured from the future right-of-way line. 8. Pursuant to Ordinance#169-A, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. 10. The applicant shall maintain compliance with Section 43.2.6 of the Weld County Zoning Ordinance at all times. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Paul and Patricia Redin for permission to place a mobile home to be used as a principal dwelling on the above described parcel of land, which was found to be in compliance with Section 43 of the Weld County Zoning Ordinance be, and hereby is, granted subject to the hereinabove listed conditions. It is the opinion of the Department of Planning Services'staff that the applicant has shown compliance with Section 43.2.6 of the Weld County Zoning Ordinance, as follows: a. Section 43.2.6.1. 1-The proposed mobile home is compatible with the surrounding area, is in harmony with the character of the neighborhood and its effects upon the immediate area. The surrounding area is an Agricultural subdivision with mostly mobile homes and manufactured homes and Agricultural uses. b. Section 43.2.6.1.2 - The proposed mobile home is compatible with the Weld County Comprehensive Plan. The mobile home will be placed in an Agricultural subdivision to be used as a principal residence and will not interfere with agricultural uses. c. Section 43.2.6.1.3 - There is available water and sewage disposal facilities for the mobile home. d. Section 43.2.6.1.4-The general health, safety and welfare of the inhabitants of the area and the county will not be jeopardized or compromised by the location of the mobile home n this site. 992703 The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. Dear Applicants: I have scheduled a meeting with the Weld County Board of County Commissioners for Monday, November 8, 1999, at 9:00 a.m.. This meeting will take place in Room 101, Weld County Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you and/or a representative be in attendance to answer any questions the Commissioner's may have. A representative from the Department of Planning Services will be out to the property a minimum of ten days prior to the hearing to post a sign adjacent to and visible from a publicly maintained road right-of-way which identifies the hearing time, date, and location. In the event the property is not adjacent to a publicly maintained road right-of-way, one sign will be posted in the most prominent place on the property and a second sign posted at the point at which the driveway (access drive) intersects a publicly maintained road right-of-way. The Department of Planning Services' staff will make a recommendation concerning this application to the Board of County Commissioner's, this recommendation will be available twenty-four (24) hours before the scheduled hearing. If it is determined that the application meets the approval criteria of Section 43 of the Weld County Zoning Ordinance and you have submitted a petition with the signatures of at least 70% of the surrounding property owners who have no objection to your request, you will be notified that the zoning permit is approved. If the staff determines that the application does not meet the approval criteria, you will be notified and asked to appear before the Board of County Commissioners at a public hearing. You will be informed of the hearing date at least a week prior to the hearing. The Board of County Commissioners will then consider your application and make a final decision on the zoning permit for the mobile home. It is the policy of Weld County to refer an application of this nature to any town or municipality lying within three miles of the property in question or if the property under consideration is located within the comprehensive planning area of a town or municipality. Therefore, our office has forwarded a copy of the submitted materials to the Eaton Planning Commission for its review and comments. Our comprehensive plan calls for this area to contain a maximum of 4.5 living units per acre and not to become a trailer park. With new development in our city limits directly east of East Eaton, we are becoming more concerned than ever of the development of East Eaton properties. We would ask that mobile homes be discouraged in that area. However, if they are allowed, that they be installed to County code and that the existing trailers in East Eaton be removed or brought to the existing code as well. The flat rate charge for all property owners that have a water tap installed on their property(inculding those that are not being used) is$35 per month starting June 1999. 2. The flat rate charge for all property owners served by the District who are not using the water because they do not have a tap installed is $18.00 per month. 3. The payment of water bills will be due the last day of every month.lf the bill is not paid by the end of the month, a late fee of$2.00 will be added to the amount owed by the property owner. 4. If payment becomes late by 2 months,the property owner will be sent a notice of Intent to cut-off water and will have 10 days from the date of he notice to pay the bill in full.lf payment is not received by the end of the 10 day period,the service will be cut-off. 5. In order to have service turned on again the property owner will be - required to pay the unpaid bill in full plus$30.00 reconnect fee. 6. If anyone wants to tap into the water line the cost is$3,000. per residency. The Board is providing each resident and property owner in the District with a copy of this letter and will maintain these charges on file with the Districts Secretary. these charges may be changed from time to time by the Board of Directors as provided by the law.
