It is understood , however , that this agreement shall in no wise release the State Highway Department or any other agency or subdivision of the State from duty to properly maintain the approaches to said road or water conduits placed across said road , nor shall it release paragraph seven ( #7 ) of said agreement and the duty thereunder to provide proper and suitable corrugated metal drain pipes for the construction and future maintenance of said approaches and pipes . O- IN THE MATTER OF AUDIT AND ALLOWANCE OF CLAIMS The following claims were presented , examined , and on motion same were ordered approved and warrants drawn in payment therefor , as shown by Record of Warrant Allowance , reference to which is hereby made , viz : M-45537 to 1-46060 inclusive . /-1N THE MATTER OF ORGANIZATION FOR THE BOX -ELDER DRAINAGE DISTRICT. Chairman Forrest Powars announced that the Board was in session for the purpose of considering the petition for the organization of the proposed "The Box Elder Drainage District , " pursuant to the adjournment of the meeting of October 26th , 1928 . The Board thereupon proceeded to hearing and consideration of the petition for organization of "The Box Elder Drainage District" , and of all the evidence presented in relation thereto and after full consideration of said matters , said Board found : That the petition presented to the Board was and is signed by a majority of the owners of the lands included within the boundary of said proposed district as well as by the owners of the aggregate of the majority of the total number of acres sought to be in- cluded in said district , and the said petitioners constitute the required number of petitioners of and within aaid proposed district ; that said petition was accompanied by a good and sufficient bond which was on motion duly approved , and notice of the presenta- tion of said petition has been duly published as required by law , and that the committee designated in said petition to present the same to this Board , to-wit : Charles E. Romans , Carl L. Gordon , and Wayne McNeal had complied with all the requirements of the law made and approved in their behalf and particularly with the provision of the session laws of the State of Colorado , in 1911 , and all amendmonts thereto in relation to the organization of Drainage Districts in the State of Colorado , and the Board also found that the signers of said petition were the owners in the aggregate of the majority . 11 of the whole number of acres within the proposed boundaries of said proposed Drainage Dis- trict , and that the signatures to said petition were the signatures of the persons repre- sented thereby . It was also found and determined that the proposed drainage district lies wholly within the County of Weld and State of Colorado , and that none of the lands proposed to be embraced therein extend out of the County of Weld and that under the provisions of the acts of the legislature of the State of Colorado under which said district is proposed to be organized the Board of County Commissioners of said County is the proper Board to designate the boundaries of said proposed Drainage District , and to exclude and include lands from said proposed district . Gordon on the East Half of the Northwest quarter ( E2-NW4) of Section twenty-two ( 22 ) Township Four ( 4 ) North , of Range 64 , nest of the 6th P . M. , in Weld County , Colorado . It is further resolved anu ordered that for the purpose of holding and conducting said election as provided by law , the following judges of election are hereby appointed for the election precinct in said district , to-wit : Fred Arens , R . S . Chesnut , and Wayne McNeal , each of said persons being a qualified elector in said district ; It is further resoluved and. . ordered that the names of the following persons in said proposed district or as directors therein at said election are submitted by the Doard as follows : Fred Arens , Carl L . The Lessor hereby leases to the Lessee for aperiod commencing on the first kv". day of November , 1928 , and terminating five ( 5 ) years thereafter , unless sooner terminated in accordance with the terms hereof , the following described strip or parcel of land to be • used for highway purposes only : All that part of the Northwest Quarter of the Southwest Quarter ( NVily of SW4 ) of 1 Section Five ( 5 ) , Township Three ( 3 ) North , Range Sixty- six ( 66 ) West of the Sixth Principal Meridian , ian , lying southeasterly of a line parallel with and two hundred ( 200 ) feet distant northwesterly , at right angles , from the center line of the main track of Union Pacific Railroad Company and lying northwesterly of that certain strip of land heretofore leased to Weld County , Colorado , under that certain lease , dated May 25 , 1923 , and designated in the files of the Railroad Company as Audit No . 28345 . The Lessor reserves the right to cross the leased premises with such railroad tracks as may be required for its convenience or purposes in such manner as not unreasonably to interfere with their use as a public highway . In the event the Lessor shall place tracks upon the leased premises in accordance with this reservation , it shall , upon completion of such tracks , restore the highway across the same to its former state of usefulness . 5 . The Lessee shall not use the leased premises or permit them to be used except for the usual and ordinary purposes of a street or highway , and it is expressly understood and agreed that such purposes shall not be deemed to include the use by the Lessee or by others , of the leased premises for railroad or traction purposes or for the construction or maintenance of electric power transmission lines . 6 . This lease is subject to all outstanding superior rights ( including those in favor of telegraph and telephone companies , and leases to abutting property owners and others ) and the right of renewals and extensions of the same ; and it is understood that nothing in this lease contained shall be construed as a covenant to put the Lessee into possession or to protect the Lessee in the peaceable possession of said premises . 7 . No special assessments for establishing or improving the highway located upon the leased premises are to be made against the adjacent railroad right of way of the Lessor , and the Lessee agrees to protect the Lessor against and save it harmless from such special assessments . 8 . For the purpose of protecting the reversionary interests of the Lessor against the assertion of adverse rights , the Lessee agrees to prevent encroachtents upon the leased premises , and to this end will , at its own expense , take all necessary action , including as far as practicable the building of its ditches on and the borrowing of earth from the outer margin of said leased premises . 9 . If the Lessee should breach or fail to keep any of the covenants or conditions hereof , or fail to perform such covenants or conditions , or to remedy the same for thirty ( 30 ) days after written notice of such failure or breach on the part of. the Lessee , given by the Lessor to the Lessee , then this lease shall be null and void . 10 . Non-user by the Lessee of the leased premises for highway purposes continuing at any time during the term hereof for a period of eighteen ( 18 ) months shall , at the option of the Lessor ; work a termination of this lease and of all rights of the Lessee hereunder , and non-user by the Lessee of a portion of said leased premises continuing for a like period shall , at the option of the Lessor , work a termination of all rights and interests of the Lessee with respect to such portion . 11 . Straight offered the following resolution and moved its adpption : WHEREAS , it has been certified to the Board of County Commissioners of Weld County, by the Board of Directors of the Green City Irrigation District , that the sum of $675 . 00 is required to meet the maintenance , operating and current expense Of said District for the year 1929 , to which sum should be added 15% which is required to be added by the Board of County Commissioners to cover delinquencies , making a total of $793 .76 WHEREAS , the returns from the Assessor of Weld County show a total assessment and valuation for the purpose of said District of the real estate included in said District , and assessable for the purpose of said District , to be $19 , 360 . 00 NOW , 2HEREFORE , BE IT RESOLVED , that the rate necessary to raise the amount required to meet the maintenance , operating and current expenses of said District for the year 1929 , as estimated by the Board of Directors of said District , is hereby fixed at 41 .00 mills on the dollar of assessed valuation for irrigation district purposes , and that a levy at the last mentioned rate , to raise the amount of money required to pay said maintenance operating , and current expense , be and the same is hereby made on all assessable real estate included in said District . R . for highway purposes , and , VIIIEREAS , the Bureau of Public Roads has declared in the Spring of 1928 that for the paving improvement of federal aid projects an eighty ( 80 ) foot right of way shall be obtained within reasonable time , if the Bureau is to cooperate in making such highway a Federal Aid Project for paving ; and , WHEREAS , in the Spring of 1928 the County of Weld , in cooperation with the State Highway Department of Colorado and the Bureau of Public Roads agreed upon a policy of paving said highway , from the end . of the paving at Mumper Hill one mile north of the City limits of Greley , and it was thereupon agreed between the Board of County Commissioners , for Feld County and the State Highway Department and the Engineer of the Bureau of Public Roads in charge that the County would , from time to time as agricultural leases shall exri�•-e on the Union Pacific R . R . right of way along which said state highway is built , the County will use its best efforts to obtain leases from the Union Pacific R . R .
