RE: APPROVE CONTRACT WITH THE COLORADO DEPARTMENT OF HUMAN
SERVICES, DIVISION OF CHILD WELFARE SERVICES, AND AUTHORIZE CHAIR
TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a contract between the County of
Weld, State of Colorado, by and through the Board of County Commissioners of Weld County,
on behalf of the Department of Social Services, and Colorado Department of Human Services,
Division of Child Welfare Services, commencing October 15, 1997, and ending September 30,
1998, with further terms and conditions being as stated in said contract, and
WHEREAS, after review, the Board deems it advisable to approve said contract, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, ex -officio Board of Social Services, that the Contract between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, on behalf of the Department of Social Services, and Colorado Department of
Human Services, Division of Child Welfare Services, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said contract.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 24th day of December, A.D., 1997, nunc pro tunc October 15,

CONTRACT
THIS CONTRACT, made this 15th day of October 1997 by and between the State
of Colorado for the use and benefit of the Department of Human Services, Division of Child
Welfare Services, 1575 Sherman Street, 2nd Floor, Denver, CO 80203, hereinafter referred to
as the State, and Weld County Department of Social Services, P.O. Box A, Greeley, CO.
80634, hereinafter referred to as the Contractor.
WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated
and otherwise made available and a sufficient uncommitted balance thereof remains available
for encumbering and subsequent payment of this Contract in Fund Number 287 ,
Appropriation Account 076 , Organization Number 4110 , GBL Account Number Xq71 ,
Contract Encumbrance Number ; an
WHEREAS, required approval, clearance and coordination has been accomplished from
and with appropriate agencies; and
WHEREAS, the State, desires to comply with the directions contained in Colorado's Five
Year Plan for Family Preservation and Family Support (FPFS); and
WHEREAS, the State shall work with the Contractor and local collaborative council to
facilitate the process by which coordinated efforts for family preservation services and family
support networks should be available for all families within the defined targeted area; and
WHEREAS, the Contractor has been selected by the local collaborative council as the
designated fiscal agency to receive and disburse Federal Family Preservation and Family
Support funds through approved sub -contracts, as well as accept the responsibility for the local
project coordination; and
WHEREAS, the project is scheduled to run through September, 1998, and would require
quarterly reports as well as end of year project findings; and
WHEREAS, the Contractor is willing and able to render such services upon the terms
provided hereinafter.

WHEREAS, as of the date of execution of this contract, both parties meet all statutory
requirements for entering into this contract.
NOW THEREFORE, it is hereby agreed that
I. STATEMENT OF WORK
The Contractor Shall:
A. be responsible for insuring that services provided by any service provider
(subcontractors) in the targeted areas comply with requirements of this contract and
assure that the guidelines within Exhibit A, Request for Applications, are adhered to.
B. be responsible for the overall program coordination and ensure the completion of the
coordination duties expected by the State and described in Exhibit A, -Appendix D,
Working Job Description for FPFS Local Project Coordinator.
C. ensure the completion of duties, by itself or through subcontractors, described in the
approved local plan submitted by the local Collaborative Council described in Exhibit
B, Federal Family Preservation and Family Support Local Plan.
D. be an entity authorized by law to enter into legal contracts and to sue and be sued on
such contracts.
E. be responsible to provide qualified staff to coordinate and oversee the appropriate and
lawful obligation and expenditure of Family Preservation and Family Support funds;
receiving and distributing funds, keeping records, and auditing acceptable procedures of
sub -contractors.
F. present evidence of a current audit (last fiscal year), and produce balance sheets and
income statements for the last two years.
G. set up a separate account for the federal Family Preservation and Family Support funds.
H. be responsible to gather data and provide quarterly reports regarding the attainment of
the local plan's goals and objectives, and final financial and narrative reports detailing
the amounts of funds obligated and liquidated, as well as gather appropriate data for the
State evaluation of the Family Preservation and Family Support Program.
I. list all actual or pending federal, state, county grant applications related to Family
Preservation and Family Support services including agency name and amount
requested. If applicable, list private grants as well.
J. be responsible for ensuring the confidentiality of records.

K. collect, maintain and account for the funds comprising the cash match, and distribute
those funds as directed by the Collaborative Council through Exhibit B or any
amendment thereof.
L. as fiscal agent, disburse funds hereunder, in compliance with state and federal
requirements to agencies/individuals providing family preservation and family support
services, according to Exhibit B.
M. adhere to agreed upon timelines as delineated in this contract as well as those written
into the approved local plan.
N. use Exhibit A, Appendix E, Family Preservation and Family Support Local Plan
Amendment, to notify the State in writing of any anticipated or actual deviations from
the agreed upon timeline, or deviations within Exhibit B; such deviations shall require
the prior written approval of the state.
0. ensure participation with the State staff, as requested to allow for open discussions
of progress, problems encountered, and problem solution both at the local and
state level of operations.
P. ensure participation with other Family Preservation and Family Support
coordinators in all aspects of the ongoing technical assistance provided by the
State.
Q. provide adequate plans for the disbursement and ownership of equipment
purchased through payments pursuant to this contract, in the event that State and
Federal funding is no longer provided for the maintenance and support of the local
program, or in the event that the Contractor fails to fulfill the obligations of this
contract. In the event that the Family Preservation and Family Support funding is
revoked from the designated area, all purchased equipment shall revert to the
State.
R. agree that any and all work products which are the result of this contract (in whole
or in part) shall be the property of the State. Any product of this contract which is
distributed to the public or made available to the public must prominently
acknowledge the use of Family Preservation and Family Support funds through
the Colorado Department of Human Services; Division of Child Welfare.
The State Shall:
A. Reimburse the Contractor for costs incurred for services described herein, based
on the submission of expenditure statements in accordance with the budget
attached in Exhibit B. The amount of funds allocated to each item in the budget
may be reallocated upon written request of the Contractor utilizing Exhibit A -
Appendix E, and with the subsequent written approval of the State, subject to the

limitation of Provision IV of this contract. The State will process requests for
reimbursement in a timely manner.
B. Monitor the performance of the Contractor to assure satisfactory performance in
the provision of the services outlined above.
C. Provide information and technical assistance to the Contractor regarding Federal
Family Preservation and Family Support.
II. TERM
The term of this contract shall be October 15,1997 through September 30,1998 .
III.BILLING AND PAYMENT
The State shall establish billing procedures for payment due in providing services
pursuant to this contract, based upon the submission of monthly statements, utilizing
a format approved by the State, in accordance with the budget attached to this
contract as part of Exhibit B.
IV.COMPENSATION/MAXIMUM PAYABLE
Payment pursuant to this contract will be made as earned, in whole or in part, from
available funds encumbered in an amount not to exceed $ 200,000.00 for the
purchase of the within -described services. The Contractor shall submit requests for
reimbursement on a monthly basis. All requests for reimbursements must be
submitted by September 18 1998 .
It is further understood and agreed that the maximum amount of funds available for
Fiscal Year 1998 for the purchase of the above described services is in the amount
of $ 150,000.00 , and for Fiscal Year 1999 , is in the amount of $25,000.00 . The
liability of the State, at any time, for such payments shall be limited to the
encumbered amount remaining of such funds.
Financial obligations of the State of Colorado payable after the current fiscal year are
contingent upon funds for that purpose being appropriated, budgeted, and otherwise
made available.
V. PROPRIETARY INFORMATION
Neither party shall use or disclose directly or indirectly without prior written
authorization any proprietary information concerning the other party obtained as a
result of this contract. Any proprietary information removed from the State's defined
targeted areas by the Contractor in the course of providing services under this

contract will be accorded at least the same precautions as are employed by the
Contractor for similar information in the course of its own business.
VI.ORDER OF PRECEDENCE
In the event of conflicts or inconsistencies between this contract and it's exhibits or
attachments, such conflicts or inconsistencies shall be resolved by reference to the
documents in the following order of priority:
a. Colorado Special Provisions.
b. Contract.
c. The Family Preservation and Family Support Local Plan, Exhibit B.
d. The RFA, Exhibit A

designated representatives of the respective parties. Either party may from time to

GENERAL PROVISIONS
The following clauses apply to this contract. In some instances, these general
clauses have been expanded upon in other sections of this contract. To the
extent that other provisions of the contract provide more specificity than these
general clauses, the more specific provision shall control.
A.

Federal Funds Continaency
Payment pursuant to this contract, if in federal funds, whether in whole or in part,
is subject to and contingent upon the continuing availability of federal funds for
the purposes hereof. In the event that said funds, or any part thereof, become
unavailable as determined by the State, the State may immediately terminate this
contract or amend it accordingly.
INDEPENDENT CONTRACTOR
THE CONTRACTOR SHALL PERFORM ITS DUTIES HEREUNDER AS AN
INDEPENDENT CONTRACTOR AND NOT AS AN EMPLOYEE. NEITHER THE
CONTRACTOR NOR ANY AGENT OR EMPLOYEE OF THE CONTRACTOR
SHALL BE OR SHALL BE DEEMED TO BE AN AGENT OR EMPLOYEE OF THE
STATE. CONTRACTOR SHALL PAY WHEN DUE ALL REQUIRED
EMPLOYMENT TAXES AND INCOME TAX WITHHOLDING, INCLUDING ALL
FEDERAL AND STATE INCOME TAX AND LOCAL HEAD TAX ON ANY
MONIES PAID PURSUANT TO THIS CONTRACT. CONTRACTOR
ACKNOWLEDGES THAT THE CONTRACTOR AND ITS EMPLOYEES ARE NOT
ENTITLED TO UNEMPLOYMENT INSURANCE BENEFITS UNLESS THE
CONTRACTOR OR A THIRD PARTY PROVIDES SUCH COVERAGE AND
THAT THE STATE DOES NOT PAY FOR OR OTHERWISE PROVIDE SUCH
COVERAGE. CONTRACTOR SHALL HAVE NO AUTHORIZATION, EXPRESS
OR IMPLIED, TO BIND THE STATE TO ANY AGREEMENTS, LIABILITY, OR
UNDERSTANDING EXCEPT AS EXPRESSLY SET FORTH HEREIN.
CONTRACTOR SHALL PROVIDE AND KEEP IN FORCE WORKER'S
COMPENSATION (AND SHOW PROOF OF SUCH INSURANCE) AND
UNEMPLOYMENT COMPENSATION INSURANCE IN THE AMOUNTS
REQUIRED BY LAW, AND SHALL BE SOLELY RESPONSIBLE FOR THE ACTS
OF THE CONTRACTOR, ITS EMPLOYEES AND AGENTS.

Beneficiary
Except as herein specifically provided otherwise, this contract shall inure to the
benefit of and be binding upon the parties hereto and their respective successors
and assigns.
It is expressly understood and agreed that the enforcement of the terms and
conditions of this contract and all rights of action relating to such enforcement,
shall be strictly reserved to the State and the named contractor. Nothing
contained in this agreement shall give or allow any claim or right cf action
whatsoever by any other third person. It is the express intention of the State and
the contractor that any such person or entity, other than the State or the
contractor, receiving services or benefits under this agreement shall be deemed
an incidental beneficiary only.
Insurance - Contractor
1 During the term of this contract, and any extension(s) hereof, contractor
agrees that it will keep in force an insurance policy or policies, issued by a
company authorized to do business in Colorado, in the kinds and minimum
amounts specified below unless specifically waived herein. In the event of
cancellation of any such coverage, the contractor shall immediately notify the
State of such cancellation.
a. Standard Workers Compensation and Employers' Liability as required by
State statute, including occupational disease; covering all employees on or
off the work site, acting within the course and scope of their employment.
b. General, Personal Injury, Professional, Automobile Liability (including
bodily injury, personal injury and property damage) with minimum coverage
of:

(1) Occurrence basis policy: combined single limit of $600,000 or
Claims -Made policy: combined single limit of $600,000; plus an
endorsement, certificate, or other evidence that extends
coverage two years beyond the performance period of the
contract.
(2) Annual Aggregate Limit policy: Not less than S1,000,000 plus
agreement that the contractor will purchase additional insurance
to replenish the limit to $1,000,000 if claims reduce the annual
aggregate below 5600,000.

2. The State of Colorado shall be named as an additional insured on all liability
policies.
3. The insurance shall include provisions preventing cancellation without thirty
(30) calendar days prior written notice to the State by certified mail.
4. Upon execution of this contract, the contractor shall provide to the State
additional insured endorsements and certificates of the required insurance
coverage.
5. The contractor shall provide such other insurance as may be required by law,
or in a specific solicitation.
6. If the contractor is a "pubic entity" within the meaning of the Colorado
Governmental Immunity Act, 24-10-101, et sea., C.R.S., as amended ("Act");
the contractor shall maintain such insurance, by commercial policy or self-
insurance, as is necessary to meet the contractor's liabilities under the Act.
Proof of such insurance shall be provided upon request by the State.
E.
Contractor Representations - Licenses/Approvals/Insurance
The contractor certifies that, at the time of entering into this contract, it has
currently in effect all necessary licenses, certifications, approvals, insurance, etc.
required to properly provide the services and/or supplies covered by this contract.
Additionally, all employees of the contractor performing services under this
contract shall hold the required license or certification, if any, to perform their
responsibilities. Any revocation, withdrawal or nonrenewal of necessary license,
certification, approval, insurance, etc. required for the contractor to properly
perform this contract, shall be grounds for termination of this contract by the State.
The contractor further certifies that, if a foreign corporation, a limited liability
company, a limited liability partnership or a limited liability limited partnership, it
currently has a Certificate of Good Standing or Certificate of Existence to do
business in Colorado. Proof of such certification shall be provided upon request
by the State.
F. Records Maintenance
The contractor shall maintain a complete file of all records, documents,
communications, and other materials which pertain to the operation of the

program/project or the delivery of services under this contract. Such files shall be
sufficient to properly reflect all direct and indirect costs of labor, materials,
equipment, supplies and services, and other costs of whatever nature for which a
contract payment was made. These records shall be maintained according to
generally accepted accounting principles and shall be easily separable from other
contractor records.
G Records Retention and Availability
All such records, documents, communications, and other materials shall be the
property or the State unless otherwise specified herein and shall be maintained
by the contractor, for a period of three (3) years from the date of final payment or
submission of the final federal expenditure report under this contract, unless the
State requests that the records be retained for a longer period, or until an audit
has been completed with the following qualification. If an audit by or on behalf of
the federal and/or state government has begun but is not completed at the end of
the three (3) year period, or if audit findings have not been resolved after a three
(3) year period, the materials shall be retained until the resolution of the audit
findings.
Performance Monitoring
The contractor shall permit the State and any other governmental agency
authorized by law, or their authorized designee to monitor all activities conducted
by the contractor pursuant to the terms of this contract. As the monitoring agency
may in its sole discretion deem necessary or appropriate, such monitoring may
consist of internal evaluation procedures, reexamination of program data, special
analyses, on -site verification, formal audit examinations, or any other reasonable
procedures. All such monitoring shall be performed in a manner that will not
unduly interfere with contract work.
I. Audits
1. General. The contractor authorizes the State or its representatives to perform
audits and/or inspections of its records at any reasonable time during the term
of this contract and for a period of three (3) years, (unless the State
determines a longer timeframe is required) following the date of final payment
under this contract, to assure compliance with its terms and/or to evaluate the
contractor's performance.

Any amounts which have been paid by the State which are found to be
improper in accordance with other terms of this contract shall be immediately
returned to the State or may be received in accordance with other remedies.
2. Single Audit Cause. All state and local Governments and non-profit
organizations receiving more than $300,000 from all fundinc sources, that are
defined as federal 'financial assistance for single audit purposes, shall comply
with the audit requirements of OMB Circular A-123 (Audits of State and Local
Governments) or A-133 (Audits of Institutions of Higher Education and Other
Non-profit Organizations), whichever applies.
J.
Confidentiality of Records
The contractor shall protect the confidentiality of all records. and other materials
containing personally identifying information that are maintained in accordance
with this contract. Except as provided by law, no information in possession of the
contractor about any individual constituent shall be disclosed in a form including
identifying information without the prior written consent of the person in interest, a
minor's parent, or guardian. The contractor shall have written policies governing
access to, duplication and dissemination of, all such information. The contractor
shall, advise its employees, agents and subcontractors, if any, that they are
subject to these confidentiality requirements. The contractor shall provide its
employees, agents and subcontractors, if any, with a copy or written explanation
of these confidentiality requirements before access to confidential data is
permitted.
K. Conflict of Interest
During the term of this contract, the contractor shall not engage in any business
or personal activities or practices or maintain any relationships which conflict in
any way with the contractor fully performing his/her obligations under this
contract.
Additionally, the contractor acknowledges that, in governmental contracting, even
the appearance of a conflict of interest is harmful to the interests of the State.
Thus, the contractor agrees to refrain from, any practices, activities or
relationships which could reasonably be considered to be in conflict with the
contractor's fully performing his/her obligations to the State under the terms of this
contract, without the prior written approval of the State.
In the event that the contractor is uncertain whether the appearance of a conflict
of interest may reasonably exist, the contractor shall submit to the State a full

disclosure statement setting forth the relevant details for the State's consideration
and direction. Failure to promptly submit a disclosure statement or to follow the
State's direction in regard to the apparent conflict shall be °rounds for termination
of the contract.
L.
Further, the contractor (and subcontractors or sub°rantees permitted under the
terms of this contract) shall maintain a written code of standards governing the
performance of its employees engaged in the award and administration of
contracts. No employee, officer or agent of the contractor, subcontractor, or
subgrantee shall participate in the selection, or in the award or administration of a
contract or subcontract supported by Federal funds if a conflict of interest, real or
apparent, would be involved. Such a conflict would arise when:
a. The employee, officer or agent;
b. Any member of the employee's immediate family;
c. The employee's partner; or
d. An organization which employees, or is about to employ, any of
the above,
has a financial or other interest in the firm selected for award. The contractor's,
subcontractor's, or subgrantee's officers, employees, or agents will neither solicit
nor accept gratuities, favors, or anything of monetary value from contractor's
potential contractors, or parties to subagreements.
Conformance with Law
The contractor shall at all times during the term of this contract strictly adhere to
all applicable federal and state laws and implementing regulations as they
currently exist and may hereafter be amended. The contractor shall also require
compliance with these statutes and regulations in subcontract and subgrant
agreements, if any, permitted under this contract. Without limitation, these federal
laws and regulations include:
• Age Discrimination Act of 1975, 42 U.S.C. Sections 6101 et. seq. and its
implementing regulation, 45 C.F.R. Part 91;
• Age Discrimination in Employment Act of 1967, 29 U.S.C. 621-634;
• Americans with Disabilities Act of 1990 (ADA), 42 U.S.C. 12101 et sea:
• The Drug Free Workplace Act of 1983, 41 U.S.C. 701 et sea:

Equal Pay Act of 1963, 29 U.S.C. 206(d);
Immigration Reform and Control Act of 1986, 8 U.S.C. 1324b;
• Pro -Children Act of 1994, 20 U.S.C. 6081 et seq.•
Section 504 of the Rehabilitation Act of 1973, 29 U.S.C. 794, as amended,
and implementing regulation 45 C.F.R. Part 84;
• Titles VI & VII of the Civil Rights Act of 1964, 42 U.S.C. 2000d & e;
Title IX of the Education Amendments of 1972, 20 U.S.C. 1681 et seq.;
• Section 24-34-302, et sea., Colorado Revised Statutes 1993, as amended;
• The "Uniform Administrative Requirements for Grants and Cooperative
Agreements to State and Local Governments (Common Rule), at 49 Code of
Federal Regulations, Part 18;
• Office of Management and Budget Circulars A-87, A-21 or A-122, and A-102
or A-110, whichever is applicable.
• The Hatch Act (5 USC 1501-1508 and Public Law 95-454 Section 4728.
These statutes state that federal funds cannot be used for partisan political
purposes of any kind by any person or organization involved in the
administration of federally -assisted programs.
The contractor also shall comply with any and all laws and regulations prohibiting
discrimination in the specific program(s) which is/are the subject of this contract. In
consideration of and for the purpose of obtaining any and all federal and/or state
financial assistance, the contractor makes the following assurances, upon which
the State relies.
1. The contractor will not discriminate against any person on the basis of race,
color, national origin, age, sex, religion and handicap, including Acquired
Immune Deficiency Syndrome (AIDS) or AIDS related conditions, in
performance of work under this contract.
2. At all times during the performance of this contract, no qualified individual
with a disability shall, by reason of such disability, be excluded from
participation in, or denied benefits of the service, programs, or activities

performed by the contractor, or be subjected to any discrimination by the
contractor.
3. The contractor shall take all necessary affirmative steps, as required by 45
CFR 92.36(e), Colorado Executive Orders 00055 87 and 00005 94 and
State Procurement Rules, to assure that small and minority businesses and
women's business enterprises are used, when possible, as sources of
supplies, equipment, construction, and services purchased under this
contract.
M.
Pssicnment/Deleeation/Subcontractinc
Except as herein specifically provided otherwise, the duties and obligations of the
contractor arising hereunder cannot be assigned, delegated nor subcontracted
except with the express prior written consent of the State. The subcontracts
permitted by the State shall be subject to the requirements of this contract, and
the contractor is responsible for all subcontracting arrangements and the delivery
of services as set forth in this contract. The contractor shall be responsible for the
performance of any subcontractor. Failure of the subcontractor to provide
services in accordance with the requirements of this contract shall be the
responsibility of the contractor. The contractor warrants and agrees that any
subcontract resulting from its performance under the terms and conditions of this
contract, shall include a provision that the said subcontractor shall abide by the
terms and conditions hereof, as well as all other applicable federal and State
laws, and rules and regulations pertinent hereto that have been or may hereafter
be established. Also, the contractor warrants and agrees that all subcontracts
shall include a provision that the subcontractor shall indemnify and hold harmless
the State. The subcontractors must be certified to work on any equipment for
which their services are obtained.
N. Litigation
The contractor shall promptly notify the State in the event that the contractor
learns of any actual litigation in which it is a party defendant in a case which
involves services provided under this contract. The contractor, within five (5)
calendar days after being served with a summons, complaint, or other pleading
which has been filed in any federal or state court or administrative agency, shall
deliver copies of such document(s) to the State's Executive Director. The term
"litigation" includes an assignment for the benefit of creditors, and filings in
bankruptcy, reorganization and/or foreclosure.

Disoutes
Except as herein specifically provided otherwise, disputes concerning the
performance of this contract which cannot be resolved by the designated contract
representatives shall be referred in writing to a senior departmental manaoemert
staff designated by the department and a senior manager designated by the
contractor. Failing resolution at that level, disputes shall be presented in writing
to the Executive Director and the contractor chief executive officer for resolution.
This process is not intended to supersede any other process for the resolution of
controversies provided by law.
F.
Remedies
The Executive Director of the State or designee may exercise the following
remedial actions, in addition to all other remedial actions authorized by law,
should s/he find the contractor substantially failed to satisfy the scope of work
found in this contract. Substantial failure to satisfy the scope of work shall be
defined to mean incorrect or improper activities or inaction by the contractor.
These remedial actions are as follows:
1. Withhold payment to the contractor until the necessary services or
corrections in performance are satisfactorily completed;
2. Request the removal from work on the contract of employees) and/or
agent(s) of the contractor whom the Executive Director or designee
justifies as being incompetent, careless, insubordinate, unsuitable, or
otherwise unacceptable, or whose continued employment on the
contract s/he deems to be contrary to the public interest or not in the
best interest of the State;
3. Deny payment or recover reimbursement for those services or
deliverables which have not been performed and which due to
circumstances caused by the contractor cannot be performed or if
performed would be of no value to the State. Denial of the amount of
payment shall be reasonably related to the amount of work or
deliverables lost to the State;

4. Incorrect payments to the contractor due to omission, error, fraud, and/or
defalcation shall be recovered from the contractor by deduction from
subsequent payments under this contract or other contracts between the
State and the contractor, or by the State as a debt due to the State or
otherwise as provided by law.

Termination
1. Termination for Default. The State may terminate the contract for cause
without compensation for termination costs. If the State terminates the contract
for cause, it will first give ten (10) days prior written notice to the contractor,
stating the reasons for cancellation, procedures to correct problems, if any, and
the date the contract will be terminated in the event problems have not been
corrected.
a. In the event this contract is terminated for cause, the State will only
reimburse the contractor for acceptable work or deliverables received up
to the date of termination.
b. In the event this contract is terminated for cause, final payment to the
contractor may be withheld at the discretion of the State until completion
of final audit.
2. Termination for Convenience. The State shall have the right to terminate this
contract by giving the contractor at least thirty (30) days prior written notice.
If notice is so given, this contract shall terminate on the expiration of the
specified time period, and the liability of the parties hereunder for further
performance of the terms of this contract shall thereupon cease, but the
parties shall not be released from the duty to perform their obligations up to
the date of termination.
3. Immediate Termination. This contract is subject to immediate termination by
the State in the event that the State determines that the health, safety, or
welfare of persons receiving services may be in jeopardy. Additionally, the
State may immediately terminate this contract upon verifying that the
contractor has engaged in or is about to participate in fraudulent acts.
4. Termination for Financial Exiaencv. The State shall have the right to
terminate this contract for financial exigency by giving the contractor at least
thirty (30) days prior written notice. For the purposes of this provision, a
financial exigency shall be a determination made by the Colorado legislature
or its Joint Budget Committee that the financial circumstances of the State
are such that it is in the best interest of the State to terminate this contract.
If notice of such termination is so given, this contract shall terminate on the
expiration of the time period specified in the notice, and the liability of the
parties hereunder for further performance of the terms of this contract shall

thereupon cease, but the parties shall not be released from the duty to
perform their obligations up to the date of termination.

Severability
To the extent that this contract may be executed and performance of the
obligations of the parties may be accomplished within the intent of the contract,
the terms of this contract are severable, and should any term or provision hereof
be declared invalid or become inoperative for any reason, such invalidity or failure
shall not affect the validity of any other term or provision hereof. The waiver of
any breach of a term hereof shall not be construed as a waiver of any other term,
or the same term upon subsequent breach.
Intearation of Understandings
This contract is intended as the complete integration of all understandings
between the parties. No prior or contemporaneous addition, deletion, or other
amendment hereto shall have any force or effect whatsoever, unless embodied
herein in writing. No subsequent novation, renewal, addition, deletion, or other
amendment hereto shall have any force or effect unless embodied in a written
contract executed and approved pursuant to the State Fiscal Rules.
T. Proprietary Information
1. Proprietary information for the purpose of this contract is information. relating to
a party's research, development, trade secrets, business affairs, internal
operations and management procedures and those of its customers, clients or
affiliates, but does not include information lawfully obtained from third parties,
that which is in the public domain, or that which is developed independently.
2. Neither party shall use or disclose directly or indirectly without prior written
authorization any proprietary information concerning the other party obtained as
a result of this contract Any proprietary information removed from the State's
site by the contractor in the course of providing services under this contract will
be accorded at least the same precautions as are employed by the contractor
for similar information in the course of its own business.

services provided under this contract has the right to file a complaint with the

V.
If any of the payments hereunder are from federal funds, where applicable, the
following provisions shall apply to this contract.
1. Press Releases
Pursuant to Section 511 of P.L. 101-166, when issuing statements, press
releases, requests for proposals, bid solicitations and other documents
describing projects or'programs funded in whole or in part with federal funds,
the contractor shall clearly state (i) that the activity is funded in whole or in part
by federal funds, (ii) the percentage of the total costs of the program or project
which will be financed with federal money, (iii) percentage and dollar amount of
the total costs of the project or program that will be financed by non-federal
sources.
2. Debarment Certification To the extent applicable, if any payment pursuant to
this contract is in federal funds, the following provisions apply to this contract.
a. The contractor certifies to the best of its knowledge and belief that the
contractor, its principals and authorized subcontractors: (i) are not presently
debared, suspended, proposed for debarment, declared ineligible, or voluntarily
excluded from participation in this transaction by any federal department or
agency; (ii) have not within a three year period preceding this contract been
convicted of or had a civil judgment rendered against it for commission of fraud
or a criminal offense in connection with obtaining, attempting to obtain, or
performing a public (Federal, State, or local) transaction or contract under a
public transaction; (iii) have not violated a Federal or State antitrust statutes or
committed embezzlement, theft, forgery, bribery, falsification or destruction of
records, or made false statements, or received stolen property; (iv) are not
presently indicted for, or otherwise criminally or civilly charged by a

6. Rights in Data and Coovriaht - Federal Reserved Rights
Except for its own internal use, the contractor shall not publish or reproduce any
data/information, in whole or part, that is recorded in any form or medium
whatsoever and that is delivered or specified to be delivered under this contract,
nor may it authorize or permit others to do so, without the written consent of the
federal government, through the State, until such time as the federal
government may have released such data/information to the public.
As authorized by 49 C.F.R. 18.34, the federal government, through the State,
reserves a royalty free, nonexclusive, and irrevocable license to reproduce,
publish or otherwise use, and to authorize the State and others to use; a) any
work developed under this contract or a resulting third party contract irrespective
of whether or not it is copyrighted; and b) any rights of copyright to which a
contractor, subrecipient, or third party contractor purchases ownership with
federal assistance.

5. WHO MAY APPLY: Seventeen (17) areas of the state were selected to receive
funds through a non-competitive application process. The criteria for selection was
based on the information provided in the document At What Risk: County
Assessments of Safety and Risk for Child Abuse and Neglect in Colorado,
percentage of ethnic minority children with open child protection cases, history of an
active collaborative council, proximity of a family resource center, and availability of
resources to mitigate for risk factors. The targeted communities, counties, and/or
regions for 1998 are:

continuation application, these areas will be funded.
The seventeen targeted areas MUST fill out and return the attached form,
Appendix A, Confirmation of Intent to Apply for Family Preservation and
Family Support Funds, by 4:30 p.m. Thursday, July 31, 1997. Any targeted
area failing to return the form by that date will be eliminated from the
application process and the funds designated for that area will be divided

proportionately among the remaining targeted areas. Return this form to
Charles Perez, Ed.D. at the address or fax noted above.
6. ACCEPTANCE OF THE RFA TERMS: An application submitted in response to
this RFA shall constitute an offer. Acknowledgment of this condition shall be
indicated by the signature of the representative duly authorized to execute
obligations for the applicant. An application submitted in response to this RFA
acknowledges acceptance by the applicant of all terms and conditions, including
compensation, set forth herein.
7. BUDGETS: Applications must include Budget (Cost Data) and provide factual
information concerning the cost of labor, material, travel, overhead and other cost
elements which are expected to be incurred.
8. RFA CANCELLATION: The State of Colorado reserves the right to cancel this
Request for Application at any time, without penalty.
9. INCURRING COSTS: The State of Colorado is not liable for any cost incurred by
applicants prior to issuance of the Grant Award. Further, no interest of any nature
shall occur until a grant is awarded and the documents are signed by the State.
10. NON-DISCRIMINATION: The applicant shall comply with all applicable state
and federal laws, rules and regulations involving non-discrimination on the basis of
race, color, religion, national origin, age, sex, or disability.
11. REJECTION OF APPLICATION: The State of Colorado reserves the right to
reject any or all applications and to waive informalities and minor irregularities in
applications received and to accept any portion of an application or all items
proposed if deemed in the best interest of the State of Colorado, or return
incomplete applications for additional work In cases of rejection of an application,
the State will provide the applicants with technical assistance to modify or correct
the application to bring the application into compliance with the requirements of the
RFA
12. CANCELLATION OF AWARD: The State reserves the right to cancel, for
cause, any grant award resulting from this RFA, by providing timely written notice to
the contractee.
13. FAILURE TO PERFORM: In any case where the contractee's failure to perform
in accordance with this grant results in a loss of federal financial participation (as in
the case of a federal audit exception), contractee will bear full financial responsibility
for the loss. Financial responsibility shall also include payment of any legal

expenses incurred in the defense of such an audit exception. Human Services shall
also have the right to implement other available remedial actions.
14. INDEMNIFICATION: To the extent authorized by law, the contractee shall
indemnify, save and hold harmless the State, its employees and agents, against any
and all claims, liability and court awards, including costs, expenses and attorney
fees incurred as a result of any act of omission by the contractee, or its employees,
agents, sub-contractees, or assignees pursuant to terms of this grant.
15. LIABILITY INSURANCE/FIDELITY COVERAGE - CONTRACTEE: During the
term of this grant, and any extension(s) hereof, contractee agrees that it will keep in
force an insurance policy or policies, issued by a company authorized to do
business in Colorado, in the minimum amounts specified below unless specifically
waived herein. In the event of cancellation of any such coverage, contractee shall
immediately notify the State of such cancellation.
a. Standard Worker's Compensation and Employers' Liability
1) As required by State statute including occupational disease,
covering all employees at the work site.
b. Except as to a "public entity" described below, General Liability (PL and
PD) (Minimum)
1) Combined single limit - $600,000 (effective 1/1/93) written on an
occurrence basis.
2) Any aggregate limit will not be less than $1 million.
3) Contractee must purchase additional insurance if claims reduce
the annual aggregate below $600,000.
4) State of Colorado to be named as additional insured on each
comprehensive general liability policy.
5) Certificate of insurance to be provided to the State (within 10
working days after receipt of award) and a copy of the policy
endorsement naming the State of Colorado as additional insured
as indicated in "4" above.
6) Insurance shall include provisions preventing cancellation
without 60 days prior notice by certified mail to the State.
c. Except as to a "public entity" described below, Automobile Liability
(Minimum):
1) Contractee to carry a minimum of $600,000 combined single
limit auto Insurance.
d. For licensed professionals providing services in their professional
capacity, professional liability insurance in an amount not less than
$150,000 for any injury to one person in any single occurrence, and, no
less than $600,000 for an injury to two or more persons in any single
occurrence.

If the contractee is a "public entity" within the meaning of the Colorado
Governmental Immunity Act, 24-10-101, et seq., C.R.S.. as amended ("Act");
contractee shall maintain such insurance, by commercial policy or self-
insurance, as is necessary to meet contractee's liabilities under the Act. Proof of
such insurance shall be provided upon request by the State.
16. LICENSES/APPROVALS/INSURANCE: Contractee certifies that, at the time of
entering into this grant, it has currently in effect all necessary licenses, certifications,
approvals, insurance, etc. required to properly provide the services and/or supplies
covered by this grant. Additionally, all employees of Contractee performing services
under this grant shall hold the required license or certification, if any, to perform their
responsibilities. Any revocation, withdrawal or.nonrenewal of necessary license,
certification, approval, insurance, etc. required for Contractee to properly perform this
grant, shall be grounds for termination of this grant by the State.
Contractee further certifies that, if a foreign corporation, it currently has a Certificate
of Authority to do business in Colorado issued from the Colorado Secretary of State
designating a registered agent in Colorado to accept service of process.
17. CONFIDENTIALITY OF RECORDS: Contractee shall protect the confidentiality
of all records and other materials containing personally identifying information that
are maintained in accordance with this grant. Except as provided by law, no
information in possession of contractee about any individual constituent shall be
disclosed in a form including identifying information without the prior written consent
of the person in interest, a minor's parent, or guardian. Contractee shall have
written policies governing access to, duplication and dissemination of, all such
information. Contractee shall advise its employees, agents and subcontractors, if
any, that they are subject to these confidentiality requirements. Contractee shall
provide its employees, agents and subcontractors, if any, with a copy or written
explanation of these confidentiality requirements before access to confidential data
is permitted.
II. BACKGROUND
In 1993, The Family Preservation and Support Services Act was signed into law as part of
the Omnibus Budget Reconciliation Act. Funds were made available to states to serve as a
catalyst to help communities find innovative, collaborative ways to deliver services that will
promote healthy families and keep children safe. The funds were designed to create and
enhance two kinds of locally based projects: family support networks on behalf of all
families to increase family well-being, and family preservation programs geared to families
in crisis who have children at risk for maltreatment and/or children with disabilities. The
goal of the act was to increase the capacity of all families to nurture their children. It is

predicated on the beliefs that families who receive support are more capable of supporting
themselves and their children; and that respect for parents is vital in the delivery of
services.
Funds were received by Colorado at the end of 1994, and the next year was spent
consulting with parents, child advocates, youth, public and private service providers, and
representatives of diverse cultures including families with a member with a disability, to
create a plan for the next five years, to accomplish our goals, and distribute federal and
state funds. Appendix B, Colorado Family Preservation and Family Support provides the
vision, principles and goals for the state plan.
The intent of the vision seeks systemic redesign whereby all families will have access
to a system of care that individualizes their care based on an assessment of strengths
and how those strengths can be built upon to address specific family needs as well as
meeting the mandate of keeping children safe.
• The vision expands the efforts to' include all families and children, not just those at
risk for maltreatment.
• The vision anticipates that families will have access to support at any point along the
service continuum, from prevention/education efforts through foster care, to aftercare
and follow-up. If families have appropriate support, the likelihood of a child staying
in their family, and/or reunifying with their family successfully, is much greater than if
they remain isolated.
• The vision also anticipates that families will have access to family preservation
services when they are in crisis. Traditional family preservation services and other
treatment services have their own funding streams for target populations (e.g.
Medicaid recipients, open child welfare cases through core services, ADAD
programs, S.B. 94 funds, etc.). FPFS funds can be used to enhance these services
to become available for those families without funding sources, and seek
mechanisms for the providers to include this population in the future.
• The vision anticipates the incorporation of a localized process that utilizes the
strengths within a neighborhood, city, county, and/or region, to address the needs of
families and children in their local areas. The process allows for the following to
occur.
Agreements with regard to family and child outcomes.
Mechanisms for parent/professional partnerships for multi -disciplinary
expertise.
Strength based assessments and treatment planning (family and community).
Individualized treatment planning with family being experts on their family.
Locally based interventions and treatment.
Flexible or pooled funding to access needed services from various funding
streams.
Ongoing consumer input into the process.

Flexibility for programmatic change to address changing community and
family needs.
�A trusting environment for all, thus allowing coordination and collaboration to
occur.

Through the state wide planning process the following four (4) components were identified
as being critical to addressing the gaps and barriers in the current service system for
children and families, including child welfare:
• a formalized collaborative council to oversee the local project and provide an avenue for
individualized case planning.
• family advocates and/or family advocacy coordinators who facilitate linkage between
families and agency providers to ensure support for families throughout the services
continuum.
• the enhancement of a support/preservation array of services for families with children at
risk for maltreatment and families with children who have disabilities, specifically,
through home visitation and crisis respite.
• an enhanced service system that will address the specialized needs of under served
populations, specifically, adoptive families and transient families.
In addition to the local planning efforts, The Division of Child Welfare has contracted with
the Colorado Office of Resource and Referral Agencies to enhance their state wide
information and referral system to include family preservation and family support services in
addition to their current child care network. Also, the Colorado Foundation for Families and .,
Children has been contracted to work with the state and the local areas toward the
evaluation of the state wide goals and objectives as well as technical assistance for the
local areas toward the attainment of the local goals and objectives.
SCOPE OF THE PLAN
1. STATE OVERSIGHT: The State Family Preservation and Family Support
Advisory Council created during the planning process to provide technical
assistance and support to the state staff responsible for creation and implementation
of the plan serves in an advisory capacity. The Council will review all applications
from targeted areas and will assist with monitoring of programs.

2. DEFINITIONS.
Child - An individual aged 0 - 21 years. Any program targeted specifically to youth
ages 18 to 21 must limit services to those youth who are homeless/runaways or who
have been involved with human service programs prior to age 18.
Collaborative Council - Representatives from the targeted area with responsibility for
local plan development, selecting programs to be funded, and program oversight,
within the local area. For additional information, see Part III, Section 4-a.
Designated fiscal agency (Fiscal Agency) - An agency working in the targeted area
selected by the Collaborative Body to function as an agent to receive and distribute
the funds under this application. Please refer to Part III, Section 6 for more
information.
Family - A family is defined by its members, BUT, for purposes of these funds, a
family must include one or more children ages 0-21. A family may include biological,
adoptive, foster, and extended families, as well as emancipated youth up to age 21.
Family Advocacy Coordinator (FAG) - An individual employed to coordinate services
in the targeted area linking family support networks with family preservation
programs in an effort to address local service gaps. It is preferred that this person
be a parent or family member of a child or adolescent who is or has been at risk.
See Part III, Section 4-b and Appendix C for additional information.
Family Preservation Services - Those services provided or funded by county
departments of social services, Mental Health Services, and the Department of
Education to help families deal with crises that might otherwise lead to out -of -home
placement for a child.
Family Support Services - Those services provided to enable families to care for and
nurture their children, and prevent crises which might lead to out -of -home
placement. A base of family support should be available for families throughout the
continuum of services; from prevention, through residential placement, to follow up
and aftercare, with the intention of keeping children safe and healthy within their
families.
Targeted Area - One of seventeen (17) areas of the state selected to receive funds
under this RFA.
Technical Assistance - Services provided directly or purchased by the State to assist
collaborative bodies to respond to this RFA, to prepare their service plans, and to
implement those plans.

3. LENGTH OF PROGRAM: The period of all grants entered into through this
Request for Application will be twelve (12) months - October 1,1997 through
September 30, 1998. There exists the potential for one year additional funding,
pending program accomplishments in each targeted area and pending the ongoing
receipt of Federal funds by the Division of Child Welfare. Successful applicants will
be notified regarding ongoing funding by mid -August, 1998, and informed of
procedures for funding renewal.
4. COMPONENTS TO BE ADDRESSED UNDER THIS REQUEST FOR
APPLICATION: There are four principle support and service components to be
addressed by the applicants. The first is the Local Collaborative Council.
a. The Collaborative Council: Each targeted area must have a collaborative
council which will provide input into the development of the local plan,
determine the distribution of these funds, and establish a procedure for
project oversight and decision making. Targeted areas are strongly
encouraged to enhance or expand an existing collaborative council
rather than creating a new entity, but the manner of formation of this
council will be left to the discretion of the area. It is the intent of this RFA to
increase collaboration among local, state, county, community private agency
programs and families and their advocates. The dollars available under this
RFA are not sufficient to address the strongest areas of concern reflected by
parents, youth and service providers during the state wide focus group
process (especially economic conditions/employment and housing).
However, bringing together the representatives listed below should permit
targeted communities to focus existing resources on these critical areas, and
use some or all of the funds available through this RFA to leverage services
that will directly impact these concerns.
1) Membership of the local collaborative council shall, at a minimum,
include:
• three parents/consumers whose children have been served or are
being served by the local human services system (preferably
including parents of children with disabilities and adoptive
families);
• a youth representative or representatives or a youth advocate;
• the Family Advocacy Coordinator(s) for the targeted area;
• the CORRA representative for the targeted area;
• staff of existing public and private programs providing family
resource services, including Head Start, family centers, and
community action agencies and Bright Beginnings (Governor's
Office);

• representatives of state and local government agencies,
specifically, social services, health, mental health, juvenile justice,
education, vocational rehabilitation, employment, housing,
transportation, economic development agencies, and
organizations providing community services activities and
recreation;
• representatives of groups with expertise in substance abuse
treatment;
• representatives of the business community;
• representatives of each local county and municipal government
within the targeted area;
• representatives of groups with expertise in child abuse prevention,
including respite and crisis care;
• representatives of local communities in which family resource
programs are likely to be located;
• representatives of groups with expertise in providing services to
children with disabilities;
• representatives of groups with expertise in providing services to
victims of domestic violence;
• representatives of other funded initiatives to coordinate services
and efforts to enhance the public service system; and
• other individuals with expertise in services that family resource
programs in the state intend to offer.
If it is initially not possible to involve all of these key players, it is
expected that each targeted area will document its efforts to include all
parties listed above, and will further document ongoing efforts to
include representatives who are unavailable at the beginning of the
grant year. It is acceptable to have one individual take more than one
role, i.e.: the representative from one of the required agencies may
also be a parent of a child with special needs. The Collaborative
Councils are expected to set aside funds to reimburse parents for
travel and child care, or other reasonable expenses that will permit
their participation.
It is also understood that decision making with such a large group
presents many problems. Within the spirit of inclusion, the areas must
include within their plan, how decisions are made and how oversight
by the total council will occur.
Within the spirit of the FPFS plan, the council represents a "capability
team" that includes consumers and parents of children with special

needs as equal partners, to oversee the project. The council will
entertain feedback as to how they are enhancing a system of care
that advocates for families and children, with the ultimate goal
being that children will be safe within their own families and
communities. Expectations of the Council would include but not be
limited to the following:
• Development of an FPFS plan, utilizing and enhancing
community resources, to address the needs of all families for
family support and family preservation for families in crisis.
Particular attention should be paid to the enhancement of
respite and home visitation services and to the needs of
adoptive and transient families.
• Determine the local designated fiscal agency and how the local
project will be coordinated. This would include decision making
about a coordinator, sub -committees to accomplish tasks, etc.
• Address how agencies work together in a more coordinated
manner, with emphasis toward linking the county DSS with the
community.
• Address how families can be seen as experts on their own
families.
• Address the need for culturally competent services and support.
• Continually assess the strengths and needs of the community
and how to change the local plan to address the needs
accordingly.
• Establish a support/services mechanism that allows the system
of care to respond quickly to family needs and with the flexibility
to address non-traditional needs.
2) Cultural Competence:
Indicate the method/manner by which the area has chosen to address
cultural competence within the plan. This will include the following
factors: a) the Collaborative Council will reflect the diverse
populations within an area; b) the Family Advocacy Coordinator will
demonstrate skills and sensitivity to the cultural and linguistic
differences of the local areas; c) family and community strengths will
be the focus of the planning and delivery of support and services; d)
any planned training and technical assistance must address an aspect
of cultural competence; and e) part of the evaluation component will
objectively measure an area's degree of cultural competence
(technical assistance will be available to assist the targeted areas in
complying with this requirement).

b. Family Advocacy Coordinator (FAC): Each targeted area will be required
to select an individual from the community to be employed in this position. It
is preferred that the FAC be a parent or family member of a child or
adolescent who is at risk, and who has been, or currently is, an active
consumer of some aspect of the local service system (i.e.: social services,
mental health, special education, developmental disabilities, juvenile justice).
It is hoped that s/he will have first-hand knowledge of the obstacles faced by
service recipients. There is no specific educational requirement imposed by
the State, although it is expected that the advocate will have sufficient oral
and written communication skills to perform the duties of the position. If a
targeted area already has an individual employed in this capacity and can
clearly demonstrate that the expectations described in this section and in
Appendix C, Family Advocacy Coordinator Job Description. are being
accomplished by that person, the Council may choose to use the designated
funds to enhance existing family advocacy efforts or, with specific consent of
the State, it may apply the funds planned for the FAC to the menu of
services. See Appendix C for a complete description of the expectations of
the FAC.
c. Menu of Services: Regarding specific services, the local areas must plan
within the project goals and objectives how the funding will address the need
for, utilization of, and enhancement of:
• home visitation programs as support for all families,
• respite/crisis services (including services for families experiencing
domestic violence),
• supports for families with children at risk for maltreatment (including
community planning for collaborative efforts to better deliver basic
services such as child care, housing and transportation),
• supports for families with children with a disability (including
emotional disabilities).
d. Under Served Populations: Within the goals and objectives, each local
project must address the needs of the following under and/or inadequately
served populations: 1) Adoptive families - the local project will work with the
state and local providers from social services, mental health, juvenile
probation, etc., to enhance and improve services and supports for families
who have adopted children. 2) Transient families - the local project will
identify the special needs of transient families and work with both agency
providers and community -based organizations to enhance the services for
this population.

5. USE OF FUNDS: In an effort to provide a base of family support, funds received
through this application process may be used to create new support programs.
However the areas are encouraged to enhance existing support and service
programs, and/or to leverage other funds to achieve similar ends. Because the State
of Colorado provides significant funding for family preservation services, we
encourage applicants to target approximately 75% of their funds to programs
on the family support end of the spectrum. These funds cannot be used as a
match to other federal funds.
a. Supplantation: Because these funds are time -limited, they may not be
used to supplant existing funds for existing programs or for those that are
being eliminated. These dollars are not meant as replacement dollars for
existing programs that are being abolished, or to continue programs that
have exhausted their funding streams.
b. Matching Funds: Each targeted area will be required to provide a match
of ten (10) percent to the funds made available. Five (5%) percent may be
matched through in -kind contributions of service provision, project
coordination, capital outlay, or provision of office space and equipment for
the Project Coordinator and/or Family Advocacy Coordinator. Time spent
attending meetings will NOT be acceptable as an in -kind match. Five (5%) _
percent must be in cash, which should be raised collaboratively and
collectively by all participating agencies. Federal funds may NOT be used
as the cash match for these dollars. The sources and amounts of the in -
kind match must be documented in the application, and the sources and
amounts of the cash match must be outlined. The cash match must be
accounted for with the Second Quarterly Report, due April 1, 1997. The
designated fiscal agency will be responsible for collecting and maintaining
the funds comprising the cash match, and for distributing those funds under
the direction of the Collaborative Council.
c. Prefundinq: The State may elect to prefund a portion of the funds to the
designated fiscal agencies. Applicants will be required to justify the need for
such prefunding by submitting a current financial statement for the
designated fiscal agency accompanied by a detailed request for prefunding.
Any agency receiving prefunding must sign a repayment agreement with the
State. Also, federal requirements allow a one-time only prefunding which
must be totally exhausted within 30 days of prepayment. Prefunding is not
assured under the terms of this RFA.
6. DESIGNATED FISCAL AGENCY: Because the State can only enter into a fiscal
arrangement with an existing qualified fiscal entity as opposed to an interagency

council such as the Collaborative Council, the local council in each targeted area
must select a designated fiscal agency which will function as a fiscal agent for the
funds to be received through this RFA process. This agency may be public,
governmental, or private non-profit. The designated fiscal agency will be
responsible for receiving and distributing funds, keeping records, and will be
accountable to the State. For that reason, a representative of the designated fiscal
agency should be an active member of the decision making branch of the
Collaborative Council. The designated fiscal agency will also be responsible for the
coordination of the local projects and possibly the hiring, housing, and supervising of
the Family Advocacy Coordinator. As an employee of the designated fiscal agency,
the Project Coordinator and possibly the Family Advocacy Coordinator will be
required to comply with the applicable rules, regulations and policies of the hiring
agency.
The designated fiscal agency shall be responsible for the following:
a. be the fiscal agent for the local Family Preservation and Family Support project
and assure that the guidelines within this RFA, are adhered to.
b. be responsible for the overall program coordination and ensure the
completion of the coordination duties expected by the State and described in
Appendix D Working Job Description for FPFS Local Project Coordinator.
c. ensure the completion of duties described in the approved local FPFS plan
submitted by the local Collaborative Council.
d. be an entity authorized by law to enter into legal contracts and to sue and be
sued on such contracts.
e. be responsible to provide qualified staff to coordinate and oversee the
appropriate and lawful obligation and expenditure of Family Preservation and
Family Support funds; receiving and distributing funds, keeping records, and
auditing acceptable procedures of sub -contractors.
f. present evidence of a current audit (last fiscal year), and produce balance
sheets and income statements for the last two years.
g. set up a separate account for the federal Family Preservation and Family
Support funds (only the amount received from the state).
h. be responsible to gather data and provide quarterly reports regarding the
attainment of the local plan's goals and objectives, and final financial and
narrative reports detailing the amounts of funds obligated and liquidated, as

well as gather appropriate data for the State evaluation of the Family
Preservation and Family Support Program.
i. list all actual or pending federal, state, county grant applications related to
Family Preservation and Family Support services including agency name and
amount requested. If applicable, list private grants as well.
j. be responsible for ensuring confidentiality of records.
k. collect, maintain and account for the funds comprising the cash match, and
distribute those funds as directed by the Collaborative Council through the
local FPFS plan or any amendment thereof.
I. distribute funds to agencies/individuals providing family preservation and family
support services, according to the local FPFS plan.
m. adhere to agreed upon timelines as delineated in this contract as well as
those written into the approved local FPFS plan.
n. use Appendix E, Family Preservation and Family Support Local Plan
Amendment, to notify the State in writing of any anticipated or actual
deviations from the agreed upon timeline, budget, or deviations within the
local FPFS plan; such deviations shall require the prior written approval of
the state.
o. ensure participation with the State staff, as requested to allow for open
discussions of progress, problems encountered, and problem solution
both at the local and state level of operations.
p. ensure participation with other Family Preservation and Family Support
coordinators in all aspects of the ongoing technical assistance provided
by the State.
q. provide adequate plans for the disbursement and ownership of equipment
purchased through payments pursuant to this contract, in the event that
State and Federal funding is no longer provided for the maintenance and
support of the local program, or in the event that the Contractor fails to
fulfill the obligations of this contract. In the event that the Family
Preservation and Family Support funding is revoked from the designated
area, all purchased equipment shall revert to the State.
r. agree that any and all work products which are the result of this contract
(in whole or in part) will be the property of the State. Any product of this

contract which is distributed to the public or made available to the public
must prominently acknowledge the use of Family Preservation and Family
Support funds through the Colorado Department of Human Services;
Division of Child Welfare.
7. RELATIONSHIP TO INFORMATION AND REFERRAL COMPONENT: State
wide access to resources and information are included in the goals of the state plan.
Indicate in the application an agreement to work with this process. A separate
component of the initiation of the Family Preservation and Family Support Plan is
the expansion of information and referral (I&R) services state wide. A contract exists
between the State and the Colorado Office of Resource and Referral Agencies
(CORRA), an agency which currently provides state wide I&R for child care.
CORRA subcontractors are located in or responsible for coverage of all of the
targeted areas. The CORRA representative will be a member of the Collaborative
Council, and will work closely with the Family Advocacy Coordinator. Separate
funds have been earmarked for CORRA, distinct from the funds to be granted to the
targeted areas.
8. EVALUATION: Indicate in the application an agreement to work with the State in
the evaluation of FPFS. A contract exists between the State and the Colorado
Foundation for Families and Children (CFFC) Specifically, CFFC will work with the
state and local projects as follows:
a. Work with the project staff, including family advocates, to flesh out what
the various "measures of success" for the goals and objectives of the local

b. Facilitating a self -evaluation on the progress being made by the Local
Collaborative Council. The Local Collaborative Councils are an integral part
of the FPFS initiative and we at the State are interested in what is the "value
added" of utilizing this collaborative decision -making entity. It is believed this
process can strengthen the councils.
c. Assist the local site in designing a local evaluation plan that will produce
information about the strengths and challenges of the project, as well as, the
impact of the local project.
IV. INSTRUCTIONS FOR PREPARING APPLICATIONS
1. FORMAT: Please use the forms included in this RFA (Appendix F) and attach
them to the end of your application. Duplicate the forms as needed.

2. NARRATIVE: The application narrative must be written as concisely and
concretely as possible. Narrative must be limited to no more than fifteen (15) single-
spaced typed pages (#12 font), numbered consecutively. These fifteen pages DO
NOT INCLUDE the cover page, goals and objectives, budget summary and budget
narrative.
In attempting to meet the requirements of this RFA, applicants should at all times be
guided by the spirit and intent of this entire initiative: that these funds serve as a
catalyst to help communities and agencies find innovative, collaborative ways to
provide families with support and to deliver services that will promote healthy
families and keep children safe.
The following subject areas must be addressed in the application narrative. Address
the subject areas in the order in which they are listed here.
a. Provide a brief description of the scope of the project. Outline the
geographic area to be served, and provide a brief description of the
progress made toward goal accomplishment from previous years of FPFS
funding.
b. Describe the process for selecting a designated fiscal agency to enter into
formal agreement with the State. R�sum� of the individual authorized to
sign applications for the designated fiscal agency should be attached.
c. List members of the collaborative council (Use the form provided) - names
and affiliations. How does this roster fulfill the requirements of the RFA,
Section III, Part 4-a-1? If unable to include any of the required members,
detail efforts made to find an appropriate representative OR selection and
justification of an acceptable substitute.
d. Describe the process for selecting a chairperson or spokesperson for the
Collaborative Council, and plan for rotating such responsibility among the
members during ensuing grant years.
e. Describe the structure and how the Council will provide oversight of the
local project and how final decisions are made.
f. Document the involvement of parents of children who are consumers
within the local human services system, parent advocates, and youth or
youth advocates in the design and implementation of this plan from

Because up to 15% of the award can be utilized for project coordination,
indicate the dollar amount and number of hours to be spent in this role.
Also, include expected duties of the coordinator (Appendix D), other
expectations of this person with regard to the local FPFS project,
administrative support provided, and the relationship to the community and
collaborative council.
h. Describe the selection process for hiring the Family Advocacy
Coordinator criteria for selection, office arrangements, supervision,
specific duties, strategy for assuring cultural competence of chosen
individual (Appendix C). Describe the role of the Family Advocacy
Coordinator in assisting the Collaborative Council to implement the goals
and objectives of the local plan.
i. Indicate services and supports selected from the Menu of Services
outlined in Part III, Section 4c. Give a rationale for this selection and
explain how the selection meets the need of the local area and the criteria
in Part III, Section 5, for directing the majority of the funding to family
support services.
j. Describe the role of the information and referral service representative
with implementation of the plan.
k. Indicate readiness to prepare and submit quarterly reports in a timely
manner. Quarterly reports (Appendix G) will address the progress made in
achieving the goals and objectives delineated in each local plan. Reports
should address the success of programs and services in both fiscal and
human terms. Actively cooperate with the larger evaluation process
undertaken by the state to measure achievement of the goals outlined in
the State Plan for Family Preservation and Family Support.
I. Describe how the targeted area will assure that families participating in
programs and services funded under this RFA will be informed of the
short-term nature of the available funding. Steps should be taken to
assure that services and programs funded under this application
procedure do not result in financial harm to participants (for example, loss
of TANF benefits), or that participants are fully informed of the risks of
losing such benefits and given the opportunity to make informed decisions
about the potential risks. Describe how these steps will be taken in the
targeted area.

m. Describe how the targeted area will ensure ethnic and cultural diversity in
the planning and delivery of services.
n. Indicate efforts being made by the targeted community to continue this
process when federal and state funding are no longer available. Also,
indicate how families who receive assistance as a result of this initiative
are encouraged to use give back to the project.
3. GOALS AND OBJECTIVES: Keeping in mind that the state goal for FPFS is to
facilitate change in the process as to how the needs of all families can be addressed
by the local service system, develop the list the goals and objectives of the local plan
for use of FPFS funds (use Appendix F). Goals should reflect knowledge of existing
FPFS services and awareness of gaps in the continuum of service in the targeted
area, as well as barriers faced by families in accessing existing services. Goals
should also reflect the effectiveness of the four components of the FPFS plan toward
the accomplishment of the local plan objectives. Ultimately, accomplishment of the
goals should lead toward a positive link between agencies, communities, and
families. for the safety of children.
Objectives should reflect measurable outcomes (i.e. an increase or decrease in the
number of substantiated cases of child abuse and neglect in a given area for a
specific period of time) that indicate the goals are being accomplished. Writing
goals and objectives with measurable outcomes allows effective evaluation of
program success.
4. BUDGET INFORMATION:
a. Detailed Budget Report (Use Appendix F): - To be completed by the
designated fiscal agency as follows:
1) The grant period for the first year is based on a Federal Fiscal year
- October 1, 1997 through September 30, 1998.
2) Personnel for the grant will include any staff employed by the local
project designated fiscal agency (i.e. project coordinator, family
advocacy coordinator, supervisors, administrative support staff, etc.)
and who directly serve in the capacity of this award.
3) Indicate the 'Title" of the staff with regard to the award initiative.
4) "% of time on Proj" indicates the percentage of time spent working
for the FPFS initiative. (i.e. a full-time support staff might spend only

20% of his/her time on the FPFS initiative, therefore, 20% of their
salary would be written into the budget.
5) Indicate the yearly salary, fringe, and indirect cost benefits that will
be spent for personnel. The dollar amount should be in line with the
percent of time on the project and only indicate the FPFS funds spent
for personnel. (i.e. A full-time family advocacy coordinator might be
funded through FPFS dollars as well as other dollars. If 50% of
his/her time is spent for the FP FS project, only half the salary, fringe,
and indirect costs should be totaled into this budget).
6) "Operating Expenses" includes funds used to purchase office
supplies, phone, mailing, copying, and other costs incurred by the
designated fiscal agency for the administration of this project
(Administrative support staff should be included under personnel).
7) 'Travel" includes funds budgeted for travel, beyond that provided
by the State, to attend required meetings.
8) "Equipment and Supplies" includes any major capital outlay used
to support the local project and/or any particular agency within the
project. Before purchasing major items (i.e. computers, furniture, etc.)
a plan for disbursement and ownership of equipment (see III -6-q)
needs to be in place.
9) "Publicity and Printing" includes funds budgeted for publicity
beyond that provided by the State.
10) "Contract/Consultant" costs includes the amounts paid for the
provision of services within the scope of this grant (i.e. family
advocates contracted through an agency other than the designated
fiscal agency, home visitation, crisis respite, other supports and
preservation enhancements, services for under served populations,
wrap around contracts).
11) "Other" includes any costs budgeted not included in the above
categories, such as technical assistance beyond that provided by the
State.

b. Budget Narrative: The Budget Narrative will justify the expenditures listed
in the Detailed Budget Report. The figures will be supported with
explanations how the figures were calculated. Vitae will be provided as part
of the Budget Narrative. Funding must not be used to replace existing
federal, state, or local expenditures.
V. REVIEW OF THE LOCAL PLANS
A panel made up from members of the state FPFS Advisory Council will review the plans
using the checklist in Appendix H. The review will take place shortly after the plans are
received, the targeted areas will receive feedback and be instructed what to do before the
contracting process to receive the funding can continue.

JOB DESCRIPTION
Definition:
Family advocates support and encourage families to identify their own strengths. Advocates
are members of the community and have often experienced the same needs and issues as the
families with whom they work. Family advocacy work is guided by the beliefs that every family
is unique; that family members have the capacity to set their own goals, and implement them;
and that the culture of families should be recognized, understood and respected.
Family advocates and families work together, with communities in a partnership which focuses
on the strengths of families, and acknowledges that families should have choices and the
power to invest in those choices. They mediate, guide, support and educate as they assist
families to meet their own needs.
Brief Description of Expected Family Advocacy Activities:
A family advocacy coordinator assists families either directly or through referral efforts and works
with providers in the planning for families, children, and adolescents. This person will serve on the
local collaborative council and work in conjunction with the council toward linking community -
based family support networks with agency family preservation programs. Some of the duties
would include but not be limited to:
• work with the local system of care toward the design, implementation and evaluation of a model
of care that is collaborative, participation oriented and that views parents and families as key in
the service provision and safety of children and adolescents who are at risk.
• work toward the linkage of family support networks (those that are focused on enhancing the
ability of families and surrogate families to better care for children) with Family Preservation
Programs (services aimed for families with children at risk for out of home placement) in an
effort to create an easily accessible array of services for families and children.
• work with the local interagency council toward the identification of strengths and services gaps
in the local area.
• work with existing community information and referral systems for parents and families to
enhance accessibility.
• provide education materials for parents and families.
• Coordinate local family advocacy efforts for all families with particular attention being given to
adoptive families and transient families.
• work as a liaison between families with children and adolescents who are at risk and the various
agencies that form the local service system of care

WELD COUNTY FAMILY SUPPORT PROGRAM
NARRATIVE
A. BACKGROUND
The State of Colorado, through the Colorado Department of Human
Services, applied for and was awarded funds under the Family
Preservation/Family Support provisions of the Omnibus Budget
Reconciliation Act of 1993. The Colorado Department of Human Services
developed a five year plan, which is funded annually. This coming year
of October 1, 1997, through September 30, 1998, constitutes the third
year of the plan.
Weld County was one of 10 original local area/communities
selected by the State. Weld County's original selection was
based on high risk for child maltreatment, high percentage of
children of color in the child welfare caseload, community
capacity to mitigate risk, and other factors discussed in the
State's plan.
• Under separate funding through the State's plan, the State
expanded the information and referral services statewide, which,
at the conclusion of the 5 year plan, will provide for State -
wide telephone access to family preservation and family support.
The Weld Information and Referral Services (AIRS) received these
resources as the local Colorado Office of Resources and Referral
Agency (COBRA) office.
• Weld County has a local collaborative council, which plans for.
families and children and takes responsibility for:
* Addressing basic family needs: housing, child care,
employment, transportation, recreation
* Selecting from a menu of services that emphasizes
prevention and early intervention, family preservation and
family support
* Assuring Family Advocacy coordination
* Addressing issues of culture and ethnic diversity.

a. Local Collaborative Council: The Weld County Placement
Alternatives Commission (PAC) with two parent
representatives from the Weld County Local Planning
Committee, formed under HB94-1005, and the local CORRA
representative from the Weld Information and Referral
Services, will be Weld County's local collaborative
council. As the local collaborative council, the Weld
County PAC would function in its advisory capacity to the
Board of Weld County Commissioners and the Weld County
Department of Social Services. The Weld County PAC will
recommend a plan for family preservation/family support
services and for the distribution of these funds.
b. Fiscal Agent: The Board of Weld County Commissioners,
through the Weld County Department of Social Services, will
be the fiscal agent and administrator of the local Family
Preservation/Family Support Program. Because the local
collaborative body would be advisory, the local
collaborative body would not have the authority to
designate the Weld County Fiscal Agent or distribute these
funds.
c. Family Advocacy Coordinator: The Board of Weld County
Commissioners, through the Weld County Department of Social
Services, will not hire a Family Advocacy Coordinator as a
employee or a contract position. Funds will be designated,
as a part of the Weld County program design, to provide
family advocacy services in Weld County.
B. OVERVIEW OF WELD COUNTY PROJECT
1. TITLE OF PROJECT: The Weld County Project is titled: "The Weld
County Family Support Program".
2. ASSESSED AREAS OF NEED IN WELD COUNTY: The title of the project
is descriptive of the project's intent to meet the needs of Weld
County. The focus of these funds will be for family support
services, not family preservation services. This decision was
based on the current availability of family preservation
resources through the Family Preservation Program under the Weld
County PAC and the lack of community resources for family support
services. In particular, those family support services which
will enable families to care for and nurture their children, and
prevent crises which might lead to out -of -home placement; and to
encourage more formal local collaborative efforts to delivery
family support services within Weld County. New services for
Adoptive Families have been negotiated with the North Range
Behavioral Health under Title IVE/EA resources with WCDSS. TheseI2 / y �y

3. PURPOSE OF THE PROJECT: The purpose of the Weld County Family
Support Program will be to expand, through collaborative
community efforts, a family's support system which will:
* provide quality family education, mentoring, and client
assessment/service access;
* use family advocates from the community who will
provide
case management directly to "young families at high risk".
The definition of "Young Families at High Risk" is
contained in Item B, Part 5. Cultural competency, services
to Adoptive Families, and migrants will be addressed, as
appropriate.
4. BASIC PROJECT STANDARDS: To assure the Weld County Family
Support Program will focus on its purpose, several basic project
standards were developed as follows:

The program will be based on a third -year funding basis.
The program will have an integrated bilingual/bicultural
component which will be demonstrated in its goals and
objectives, and in its bid preference criteria. This
strong integration will assist migrant families.
The program will be developed from the community
perspective or neighborhood driven.
d. The program will provide direct services on a one-to-one
basis with families.
e.
The program will focus on those methods or services that
have the potential to continue without additional resources
from the Family Preservation/Family Support provisions of
the Omnibus Budget Reconciliation Act of 1993.
f. The program will provide services to a targeted population
which is "Young Families at Risk", in order to effectively
measure outcomes, goals, and objectives of the project.
5. DEFINITION OF TARGETED POPULATION: The target population
selected for the Weld County Family Support Program is "Young
Families at Risk". The definition of "Young Families at Risk" is
composed of selection criteria as follows:
a. Families with children 12 years of age and under; and

b. Families that quality under two risk areas or more as
follows:
1) Economic Risk: Families receiving public assistance
meet the definition of economic risk.
2) Family Risk: A family may qualify under the Family
Risk category by meeting at least one of the
following three criteria:
* Families isolated by culture, language, and/or
from natural family members; or
• Families with parent(s) or children who are
physically and mentally challenged; or
• Families with a divorce within the last year
3) Stress Risk: A family may qualify under the Stress
Risk category by meeting at least one of the
following three criteria:
Families that are new to the community, i.e.,
migrant families (residents of one year or
less); or
♦ Families that have rent or mortgage expenses
that exceed 30% of income; or
* Families with a head of household having less
than a high school education
6. SCOPE OF SERVICES: The Weld County Family Support Program will
have two major service components for "Young Families at Risk".
The two major service components of the project are as follows:
a. Family Advocacy Services: The enhancement of existing
family advocacy coordination services would best meet the
needs of our targeted population and provide the best
vehicle to deliver the Family Education component under the
Weld County Family Support Program.

The major area of need for family support services was
Family Education which would provide for case management
resources for "Young Families at Risk". The Family
Education component would consist of three major elements
as follows:
1) Parenting Education including budgeting, family/in-
home recreation, health, and crisis management
2) Mentoring for self-esteem and support system skills
3) Client Assessment/Service Access including alcohol
and drug education and special skills/needs with a
target group of families with disabled children)
The intent of Family Advocacy Services is to:
1) Focus on retraining existing or training new family
advocates (i.e., a parent or family member of a
child or adolescent who is at risk, and who has
been, or currently is, an active consumer of some
aspect of the local delivery system) who can closely
identify with "Young Families at Risk";
2) Provide case management services directly to "Young
Families at Risk" through family advocates;
3) Train family advocates to provide quality services
as outlined under the Family Education component;
4) Provide support services directly to "Young Families
at Risk" through family advocates from the
community. (Support services are defined as
transportation, child care, recreation services,
employment and education related and other support
services as defined and approved with contractors.);
5) Contract, as a result of last year's competitive bid
process, with public or non-profit organization(s)
which can clearly demonstrate the skills and ability
to:
• Develop and implement collaboration among
agencies, community groups, and other
organizations who employ or have as volunteers
family advocates who may provide the scope of
services described under the Weld County
Family Support Program;

• Access training opportunities for family
advocates through the Weld County Department
of Social Services;
• Manage support resources on behalf of family
advocates to provide support and as defined in
services to families in Item B, part 6 a.5;
and
• Designate a current or contract manager to
oversee the Family Advocacy Component of the
project and as required red under the bid contract
provisions.
b. Training Program for Family Advocates: The Weld County
Department of Social Services will continue to develop, in
conjunction with the Weld County PAC, and implement a
training program for family advocates. This training
program will assure consistency of training for family
advocates. The Weld County Department of Social Services,
through the assistance of professionals and training
programs, will focus training for family advocates in those
areas identified in the Family Education component of the
Project and to assure cultural competence. A resource
library and other resources will be made available for
family advocates. Contractor(s) identified through the
competitive bid process will also assist in the development
of the training program for family advocates as well as to
participate in the training program.
7. BID PROCESS/PROJECT CONTRACTORS: To assure that the Weld County
Family Support Program is community -driven and meeting the basic
standards of the program design as developed by the Weld County
PAC, two public/nonprofit contractors have been retained to
assure that a Greeley Area project and a South Weld County
project are funded. Weld County's intent is to continue a third
year for these projects.
The contractors are Catholic Charities and the Family Education
Network of Weld County/Employment Services of Weld County of the
Weld County Division of Human Services. These contractors are
responsive to the Weld County Department of Social Services which
is the administrator of the Weld County Family Support Program.
The contractors will be reimbursed for: family advocacy project
management, planning, and development; and support services for
families through the family advocates.

Contractors have incorporated certain factors with the Weld
County Department of Social Services as follows:
* Process to identify the number of paid and volunteer family
advocates in the specified geographical area (Greeley Area
or South Weld County Area) who meet established criteria
and screening standards;
* Methods to develop a collaborative effort with agencies,
organizations, and community groups that represent family
advocates;
* Innovative efforts to accomplish the goals and objectives
of the Weld County Family Support Program;
* Process to integrate cultural competence;
* Innovative efforts to recruit "Young Families at Risk"; and
* Description of managerial and administrative experience and
fiscal responsibility.
C. REOUIRED PLAN NARRATIVE UNDER THE REQUEST FOR APPLICATION
1. Describe the geographical area to be served.
Weld County was initially selected as a targeted area by the
Colorado Department of Human Services for the following reasons:
* It is in the greatest risk category and currently has a
child welfare caseload of 2,244 children, including 41%
children of color;
* Services may potentially reach those children as well as an
overall child population of 39,300;
* Weld County is a rural county with an urban center and
includes a migrant population;
* Weld County falls into the moderate capacity category; and
* There is a local Colorado Office of Resources and Referral
Agency (COBRA) located in Weld County. This local office
is the Weld information and Referral Services, Inc. (AIRS).
The geographic area to be served under the Weld County Family
Support Program will be Weld County. Weld County is 4,004 square
miles which is primarily rural and has two distinct service
areas: the Greeley Area which includes Greeley (urban center),
Evans, Windsor and towns north of Platteville; and the South Weld
County area which includes Fort Lupton, Frederick, Firestone, and
towns south of Platteville.

2. The Weld County Placement Alternatives Commission (PAC) with two
parent representatives from the Weld County Local Planning
Committee, formed under BB94-1005, and the local COBRA
representative from the Weld Information and Referral Services,
is the local collaborative council for the Weld County Family
Support Program.
See page 2 for the membership list.
Because the Family Support Coordinator function will be
contracted through contractors, the committee will not have a
Family Support Coordinator position.
As the local collaborative council, the Weld County PAC functions.
in an advisory capacity to the Board of Weld County Commissioners
and the Weld County Department of Social Services in the areas
of: plan development and monitoring of the Weld County Family
Support Program; and fund distribution.
3. Describe the process for selecting a chairperson or spokes person
for the local collaborative body, and plan for rotating such
responsibility among the members during ensuing grant years.
The Weld County PAC functions under by-laws and an agreement
adopted by the Board of Weld County Commissioners. The Weld
County PAC By-laws outlines the process for selecting a
chairperson and other officers. The Weld County PAC selects a
Chairperson for a one year term. A Vice -Chairperson (or
Chairperson -Elect) is selected by the PAC membership for a one
year term and will ascend to be the Chairperson the following
year. This process assures the rotation of officers on a
timely basis and is in accordance with its by-laws.
4. Document the involvement of parents of children involved in the
local human services system, parent advocates, and youth or youth
advocates in the design and implementation of this plan from
inception through evaluation.
The Weld County PAC, as the local collaborative council,
designated a subcommittee to develop a plan for approval by the
PAC. This subcommittee was intentionally structured to directly
involve those members who were parents and youth advocates in the
design of the plan and its formulation of goals and objectives.
Its membership is included as part of the local collaborative
council in page 2.
The subcommittee or the Weld County Family Support Council,
through six planning meetings, developed an initial plan
for PAC review and approval that:

The Weld County Family Support Council, under the Weld
County PAC, will continue to monitor the Goals and
Objectives of the Weld County Family Support Program, to
continue to monitor the training program for family
advocates, to initially select Bidders for PAC approval,
and to recommend changes to the program design as
appropriate.
5. Describe the process for selecting a Designated Agency - to enter
into formal agreement with the State. Resume of the individual
authorized to sign applications for the Designated Agency should
be attached.
• The Weld County PAC will function in an advisory
capacity to the Board of Weld County Commissioners
and the Weld County Department of Social Services.
• The Board of Weld County Commissioners, through the
Weld County Department of Social Services, will be
the fiscal agent and administrator of the Weld
County Family Support Program. The local
collaborative body, the Weld County PAC, will not
have the authority to designate the fiscal agent or
to distribute the funds.
• Commissioner George E. Barter, Chair, Board of Weld
County Commissioners, will be authorized to enter
into formal agreements with the State.
6. Describe the selection process for hiring the Family Advocacy
Coordinator: criteria for selection, office arrangements,
specific duties, strategy for assuring cultural competence of
chosen individual.
Under the Weld County Family Support Program, the Family Advocacy
Coordinator function will continue to be accomplished by
designating funds for family advocacy coordination services.
In the initial year the Weld County Department of Social
Services, upon recommendation of the Weld County PAC, awarded two
bids for: family advocacy project management, planning, and
development; and support services for families through the family
advocates. These bids were from Catholic Charities and
FENWC/Human Services.

In addition to bid £actors described previously, the Weld County
Family Support Program will distribute $178,000 funds to
successful Bid contractors. The allocation of funds will be
based on the ability of the contractors to serve families at
reasonable costs, and the ability of the contractors to provide
2.5% cash match and 7.5% In -Kind match, according to the
requirements outlined in the State's Request for Application.
7. List the goals and objectives of the targeted area plan for use
of Family Preservation/Family Support funds.
See page 19for the list of goals and objectives.
8. Describe the role of the Family Advocacy Coordinator in assisting
the Collaborative Body to implement the goals and objectives of
the local plan.
The Family Advocacy Coordinator Function will be purchased with
two contractors. Catholic Charities and FENWC/Human Services.
These contractors will implement the goals and objectives.
9. Describe the role of the information and referral services
representative in the implementation of the local plan.
The Weld Information and Referral Services (AIRS), which is the
local Colorado Office of Resources and Referral Agency (COBRA) is
a member of the local collaborative council. As a member of the
local collaborative council, AIRS has participated in the
development of the Weld County Family Support Program Plan.
Significantly AIRS will help the Contracted Project Managers to
recruit families and market the program.
Project Managers will be required to:
• achieve the goals and objectives of the Weld County Family
Support Program;
• participate in evaluation and monitoring activities with
the PAC;
• participate with the Weld County PAC and Weld County
Department of Social Services in designing and implementing
the training program for family advocates; and
• adhering to all Bid terms and conditions.
10. Indicate readiness to prepare and submit quarterly reports in a
t imply manner. quarterly reports will address the progress made
in achieving the goals and objectives delineated in each local
plan. Reports should address the success of programs and
services in both fiscal and human terms. Actively cooperate with
the large evaluation process undertaken by the State to measure
achievement of the goals outlines in the State Plan for Family
Preservation and Family Support.

The Weld County Department of Social Services has the
administrative and -fiscal accountability and commitment to
prepare and submit quarterly reports in a timely manner to the
Colorado Department of Human Services.
The Weld County PAC has designated $2,000 under this plan to
purchase an evaluation of case management documentation and
outcomes and has been incorporated in the budget category,
"Contact/Consultant". Also, the project will cooperate fully
with the State on the Evaluation of the project.
11. Describe how the targeted area will assure that families
participating in programs and services funded under this HFA will
be informed of the short-term nature of the available funding.
Steps should be taken to assure that services and programs funded
nectar this application procedure do not result in financial harm
to participants (for example, loss of TANF benefits), or that
participants are fully informed of the risks of losing such
hanafits and given opportunity to make informed decisions about
the potential risks. Describe how these steps will be taken in
the targeted area.
Families participating in the Weld County Family Support Program
will receive services which shall include:
• Case management services with Family Advocates. Family
advocates will not receive direct subsidies through Weld
County Program.
• Family support services for families participating in case
management services. These family support services will be
purchased and are intended to be intervention and support
resources for families only. The support services to be
purchased will not result in a loss of TANF Benefits but
are intended to be short-term intervention service. The
Weld County Family Support Program is based on a one year
funding basis.
12. Describe how the targeted area will ensure ethnic and cultural
diversity in the planning and delivery of services.
The goals and objectives of the Weld County Family Support
Program outlines the measures by which cultural competence will
be incorporated.
In addition, the local collaborative council made efforts to
ensure that ethnic and cultural diversity was reflected in its
mnmharship for purposes of planning and monitoring.

13. Include a brief plan for providing technical support to the new
group of targeted areas selected for federal fiscal year 1998,
including participation in the next year's annual state child
welfare conference. *Attended by two Collaborative Council
Members.
Under the Weld County Family Support Program Budget, the Weld
County PAC made provisions to purchase a case management audit in
order to survey the case management documentation and outcomes
for families in the Weld County Family Support Program. A
primary objective will be to test the criteria developed for the
Family Education Component.
Contractors and staff of the Weld County Department of Social
Services win be available to provide technical support to a new
group of targeted areas by participating in next year's Annual
State Child Welfare Conference, through written materials that
will provide technical assistance, and by participating in
teleconferencing discussions.
14. Include a description of an agreement to work with the State in
the evaluation of the project.
The Weld County Department of Social Services with its
contractors and the Weld County PAC agree to work with the state
as follows:
a. Work with project staff, including family advocates,
to flesh out what the various "measures of success"
for the goals and objectives of the local project
b. Facilitating a self -evaluation on the progress being
made by the Local Collaborative Council. The Local
Collaborative Councils are an integral part of the
FPFS initiative and we at the State are interested
in what is the "value added" of utilizing this
collaborative decision -making entity. Some of you
also expressed a desire to utilize this process to
strengthen your councils.
c. Assisting the local site in designing a local
evaluation plan that will produce information about
the strengths and challenges of the project, as well
as, the impact of the local project. Local plan
(also monthly reports to the State for evaluation)
will be centered around Pacific Institute for
Research and Evaluation's Results Mapping instrument
and technique.

A Child Care The costs of child care were calculated at $25 per family for 30 families during the
program period_ including child care for parenting classes. workshops. job training. computer and
literacy classes and appointments. as needed.
B. Client Transportation Provides for $25.00 for 20 families during the project period. including
transportation for parenting classes workshops. and appointments. as needed

a.1. The Weld County PAC, will continue to
contact with two provider agencies to develop
and manage community -centered Family
Education activities for 285 "Young Families at
Risk" in Weld County. These provider agencies
are Catholic Charities and FENWC/Human
Services
a.2. Within Year One of Operation, contacted
provider agencies will implement programs that
will enable each participant family to identify and
access a minimum of three agencies or offices of
which was not previously aware.
a.3. Within Year One of Operation, at least 15%
of participant families will eliminate one risk
factor (per risk criteria established for eligibility
of "Young Families as Risk")
a.4. Compared to a three-year mean (FY92-
FY94) of comparable families in Weld County, in

b.1. Provider agencies will recruit 25 individuals
from neighborhoods and communities to receive
training as Family Advocates; Family Advocates
will be trained to implement Family Education
with 142 families via a case management, in home
approach in communities with which advocates are
well acquainted.
b.2. Family Advocates will receive training
regarding services available county -wide and those
focussed services will include: basic literacy and
English as a Second Language; consumer
education; social services and basic needs; mental
and physical health support system; further
educational opportunities, etc. This objective will
be measured by pre -post questionnaires completed
by Family Advocates.
b.3. Family Advocates will be trained to
recognize elements of cultural competence, and to
employ these as building blocks in Family
Educations activities. This objective will be
measured via pre and post administration of a
criterion referenced instrument to be adopted by
Weld Social Services; and pre -post questionnaires
completed by Parent Advocates.
b.4. Family advocates will be trained to
compliment services, promote personal
responsibility, and demonstrate these skills with
families.

c. I. Weld Social Services will coordinate with
contracted providers to develop a schedule and
standards for Family Advocate training and
performance.
c.2 Weld Social Services will coordinate with
contracted providers to conduct Family Advocate
training, including compilation of a consultant file
of professionals and practitioners; and a resource
library for use at all program levels.
c.3. Contracted providers will recruit at least
50% of individuals for Family Advocates who can
provide training services in Spanish.
c.4. Weld Social Services and contractors will
collaborate to provide a support services network
(e.g. child care, transportation) at all program
levels.
c.5. Weld Social Services will train family
advocates in adoption and kinship services with
families.

RE: Family Preservation and Family Support ( FS) Contract
between the Colorado Department of Human Services and
the Weld County Department of Social Services
Enclosed for Board approval is an FPFS Contract between the Colorado Department of Human
Services and the Weld County Department of Social Services.
The Weld County Department of Social Services receives and disburses FPFS funds through two
subcontracts: the Weld County Division of Human Services (North Weld County) and Catholic
Charities, Inc. (South Weld County). This year is a third -year funding of a five-year grant.
The major provisions of the contract are as follows:
1. The term of the contract is October 15, 1997 through September 30, 1998.
2. The total available funds under the contract are $200,000.
3. The project provides family advocacy services for families at risk for economical, family,
or stress factors.
