RE: APPROVE QUIT CLAIM DEED TO TOWN OF PIERCE, COLORADO, AND AUTHORIZE
CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Quit Claim Deed between the County of
Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and
to the Town of Pierce, Colorado, concerning Lots 22, 23, and 24, Block 8, Town of Pierce, Colorado,
according to the map thereof recorded at Reception Number 115120 in the office of the Weld County
Clerk and Recorder, with further terms and conditions being as stated in said deed, and
WHEREAS, after review, the Board deems it advisable to approve said deed, a copy of which
is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the above mentioned Quit Claim Deed between the County of Weld, State
of Colorado, by and through the Board of County Commissioners of Weld County, and to the Town
of Pierce, Colorado, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized
to sign said deed.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 20th day of December, A.D., 1995.

QUIT CLAIM DEED
THIS DEED is made this a jlIA day of klr j . , 1925, between the County of
Weld, a political subdivision of the State of Colorado of the first part, and to the Town of Pierce,
Colorado, a municipal corporation of the second part.
WITNESSETH, that the said party of the first part, for and in consideration of the sum of
$10.00, and other good and valuable consideration, to the said party of the first part in hand paid by
the said party of the second part, the receipt whereof is hereby confessed and acknowledged, has
remised, released, sold, conveyed and QUIT CLAIMED, and by these presents does remise, release,
sell, convey and QUIT CLAIM unto the said party of the second part, its heirs, successors and
assigns, forever, all the right, title, interest, claim and demand which the said party of the first part
has in and to the following described lots or parcels of land situate, lying and being in the County
of Weld and State of Colorado, to wit:
Lots 22, 23, 24
Block 8
Town of Pierce, Colorado, according to the map thereof recorded at Reception
Number 115120 in the office of the Weld County Clerk and Recorder.
TO HAVE AND TO HOLD the same, together with all and singular the appurtenances and
privileges thereunto belonging or in anywise thereunto appertaining, and all the estate, right, title,
interest and claim whatsoever, of the said party of the first part, either in law or equity, to the only
proper use, benefit and behoof of the said party of the second part, its heirs and assigns forever.

COLORADO RE: Donated Property in Pierce, Colorado
On October 2, 1995, the Board of County Commissioners accepted the transfer of properties
known as Lots 22, 23, and 24, Block 8, Town of Pierce, Colorado, pursuant to the stipulation in
Case No. 94 -CV -461. A copy of the Resolution accepting the transfer is attached. Also
attached is a copy of a Memorandum which I wrote to the Board of County Commissioners dated
September 19, 1995, explaining the transfer.
I have received a request from Don Hoff, Attorney for the Town of Pierce, expressing the
Town's desire to use the three lots for the storage of its road maintenance equipment. There had
been a request by a youth group in Pierce to have the properties transferred to the group for use
as a teen center. It seems that the Town of Pierce is not particularly wild about that idea and now
desires to obtain the properties for the Town's use.
These properties were transferred to Weld County as part of the stipulation in a criminal case
filed by the District Attorney's Office (Case No. 94 -CV -461). The intent of the District
Attorney's Office in creating the stipulation was to keep the properties for public use.
Transferring the properties to the Town of Pierce for its use as storage for road maintenance
equipment will satisfy that goal.
I recommend that the Board of County Commissioners consider this matter on one of its regular
agenda's and authorize the Chairman's signature on the attached Quit Claim Deed.

Dear Bruce:
I am in receipt of the proposed Quit Claim Deed which is to be
executed by the Chairman of the Board of County Commissioners and
in favor of the Town of Pierce.
The Town of Pierce will accept the grant of property contained
in the Quit Claim Deed. If title to the property is in fact
delivered to the Town of Pierce, the town will use the property for
storage purposes. The Town does not have adequate indoor storage
for a tractor, weed cutting equipment, lawn mowers, water meters
and miscellaneous municipal supplies and equipment. The structure
does have a large -door which would facilitate use of the property
for this type of storage.
While certain citizens may have contacted the County
Commissioners with regard to use of the building as a Youth Center,
such use is not immediately contemplated. Such a use may occur in
the future if funds become available for such a purpose. In the
meantime the Town would use the structure for equipment storage if
the property is granted to the Town of Pierce.

Deed for Lots 22, 23, 24 of Block 8, Town of Pierce,
Colorado
Attached is a copy of a settlement in Case No. 94 -CV -461. The case is a civil forfeiture action for
property which was involved in a marijuana bust executed by the Weld Drug Task Force. Brandon
Marinoff from the District Attorney's office has been working on the race. Lots 22, 23, 24 of Block
8., Town of Pierce, Colorado, have been deeded to Weld County as a result of the settlement in the
civil foreclosure. As with any properties which are deeded to Weld County, the Board of County
Commissioners is required to accept the transfer, especially in those situations in which the property
is transferred to the County with no consideration paid by the County.
It is my understanding that the Town of Pierce and some local youth group will be presenting to the
Board of County Commissioners a request that this property be transferred to the Town of Pierce so
that a youth center may be built. The request will be arriving sometime in the near future.
I recommend that the Board of County Commissioners accept the transfer of the properties known
as Lots 22, 23, and 24, Block 8, Town of Pierce, Colorado, as deeded by David Cook to the County
of Weld by quit claim deed dated May 30, 1995.
