Dear Richard:
The Department of Planning Services' has reviewed your submitted drawings, A-1 .1 and
Z-2 and offer the following response.
Drawing A-1.1
Delineate the existing landscape material (trees and ground covers) located on the
west property line adjacent to the existing fence. (This area has been idenitifed as
a five (5)foot pandscape area.) Identify them by Botanical and Common Name and
list quantity.
Modify the spelling and identify the size of the plant material, specific to Pinus edulis
Pinyon Pine. Graphically this tree is shown in two sizes. Please identify the
differences in plant material size. The County minimum size for evergreens is six
(6) feet in height.
• Please give quantity of each species listed in the Plant Schedule
Please identify the existing vegetation that is to be preserved and protected by
Botanical and Common name. Further, please locate specifically on plan, unless
plant materials are ground covers that cover the entire area.
Please identify the significance of the double asterisk after the word GROUND
COVER in the Plant Schedule.
The Juniper you have identified as GROUND COVER should read Juniperus
chinensis var. 'Sea Green', with the common name of Sea Green Chinese Juniper.
This specific plant has a growth habit of 6-8 feet in height and a spread of 6-8 feet
in width. Not exactly what I would term a GROUND COVER. At thirty (30) inches
o.c. this will prove to be a very dense planting.
Two suggested spreading juniper ground covers are Juniperus sabina var. 'Buffalo'
and tluniperus horizontalis var. 'Blue Rug'. Both are less than 18" in height and
have a spread of 6-8 feet. The appropriate spacing for this material is five (5) feet
o.c.
If graphic is delineating the location of the sign, will plant material surround the base
of this structure for three feet in all directions? Per Section 2.8.4.3d of the MUD
Ordinance plant material shall extend three (3) feet in al directions.
Please refer to Sections 2.6.3 and 2.6.4 of the MUD Ordinance pertaining to
landscape requirements for parking lots and along roadway corridors. Amend the
landscape plan to reflect these modifications.
The graphic, detail 1/Z2.1, the trash area shall be enclosed with an opaque fence.
Please contact this office if further direction is required.
Please remove the word "CITY" from item 7 of the construction notes
Under item 12 of the construction notes, will landscape fabric be placed prior to the
' addition of the 3 inch bark mulch?

The parking requirement has been met. Please note, should the spaces designated
for parking be used for any type of storage, the property will be in violation. Should
this occur during the construction process, the Certificate of Occupancy will be
withheld.
Please modify text to read Existing 3-bay Truck Wash and 1-bay Oil and Lube
Facility.
Please delineate on the plan a "No Parking Area" immediately adjacent to the
existing 3300 square foot structure identified as Existing Retail, immediately south
of the Oil Change Bay.

The trash enclosure, located in the northeast corner of the property shall be

Dear Richard:
The Department of Planning Services' has reviewed your facsimile letter dated April 19, 2000
pertaining to the required parking by building use on the above referenced land and offer the
following response.
Staff has reviewed the original site plan submitted by Mr. Hiatt, case number SPR 10:3 dated
February 2, 1988 and SPR 107 dated March 25, 1988 pertaining to the Truck wash facility.
Staff requested clarification of the type of activity on the premises. Information received from the
applicant's representative, after conversing with the property owner, Mr. Hiatt, stated there are
fourteen (14) employees on premises and approximately fifty (50) seats in the cafe. Tne cafe
employees four (4) individuals. Further, the truck wash facility has four (4) employees.
Given these numbers, staff determined the required parking for this facility remains the same
number as s`Tm ted in the original application (SPR 107), as the use of the property remains
unchanged. The monopole telecommunications addition is an unmanned facility per the applicant's
information, thus no parking is required. I have enclosed a cut sheet copy of the parking
calculations for SPR 107. As you will note, there are forty-three spaces required, inducing the
parking required for the cafe and coffee shop.
The proposed site plan that includes the AT&T Wireless Services monopole site has identified thirty
(30) spaces for the property. This number is less than the required number of spaces 'or this
specific type of use on site. Please delineate an additional thirteen (13) spaces to meet the
required parking space minimum. Please note, this facility shall meet the American for Disabilities
Act, and include at a minimum two handicapped spaces. Parking access aisles shall be pad
of the accessible route to the building and curb ramps shall be provided wherever an accessible
route crosses the curb.

The Department of Planning Services' has reviewed your amended application for Site Plan Review 309
(SPR-309) for a seventy (70) foot Wireless Communication Tower in the C-3 zone district and offers the
following comments.
Should you wish to proceed with siting the manpole and equipment shelter on this property, the Department
of Planning Services' shall require Mr. Hiatt, property owner of 10763 Turner Boulevard, to submit a new
application for a Site Plan Review that addresses the existing property uses and the proposed uses covered
under the above referenced application. Staff determined that the change to the number of parking spaces
(adequate parking problems), etc. constituted a major change to this existing SPR.
Further, the following ordinances will be effective for this application:
1) Ordinance 201 addresses site specific development and design standards within the Mixec
Use Development(MUD) area, of which this parcel is located.
2) The Mixed Use Development (MUD) Ordinance also addresses specific development and
design standards , however, it is less stringent than Ordinance 201.
3) The Weld County Zoning Ordinance, as amended, address all issues and standards not
specifically addressed in the previously identified ordinances.
Please note, the property located at 10763 Turner Boulevard is within the Southwest Weld County Service
Area Road Impact Program. Therefore, effective December 1, 1999, Building Permits issued on proposea
SPR-309 will be required to adhere to the fee structure of the Southwest Weld County Service Area Road
Impact Program (Ordinance 211).
Second. the above referenced property is in violation of the Weld County Zoning Ordinance that states all
derelict vehicles located on the property must be in running condition with current license plates. or oe
screened from all adjacent properties and public rights-of-way, or be removed from the property. Al other
items considered to be a part of a noncommercial junkyard must also be removed from the property or
screened from all adjacent properties and public rights-of-way." The applicant shall schedule a final
inspection with Vickie Brown, Weld County Zoning Compliance Officer and submit a copy of the closure letter
indicating compliance with the Weld County Zoning Ordinance.
Should you elect to move forward with the Site Plan Review application, please submit the necessary
materials to our office. The application fee for this process is four hundred dollars ($400.00). Please notify
our office of your intentions.

The Department of Planning Services' has reviewed your application for Site Plan Review 309 (SPR-309) for
a seventy (70)foot Wireless Communication Tower in the C-3 zone district and offers the following comments
The subject leasehold parcel, is located in the southwest corner of a parcel identified as 10763 Turner
Boulevard, of Longmont, Colorado in unincorporated Weld County. The present use of the property is a power
truck wash and retail office complex. This land use activity is covered under Site Plan Review 103 Given
the existing land use activity, as approved in 1988, the following issues were addressed, and it was
determined that the subject parcel was in compliance with the Weld County Zoning Ordinance and other
regulatory ordinances of record for this use. Specific issues addressing setbacks and offsets from property
lines, the number of parking spaces on site required to accommodate the specific land uses of record and the
circulation within the property relative to the structures, was found to be in compliance with the regulatory
ordinances.
Given the present land use proposal of a seventy (70) foot wireless telecommunications tower located in the
southwest corner of the above identified property, several on site issues, specifically, setbacks, parking and
circulation will be compromised and shall require an amended Site Plan Review 103. This amended SPR
shall be required to be in compliance with the following ordinances:
1) Ordinance 201 addresses site specific development and design standards within the Mixed
Use Development(MUD) area, of which this parcel is located.
2) The Mixed Use Development (MUD) Ordinance also addresses specific development and
design standards , however, it is less stringent than Ordinance 201.
3) The Weld County Zoning Ordinance, as amended, address all issues and standards not
specifically addressed in the previously identified ordinances.
Further, should a SPR for the above named parcel occur, and the findings show the subject property parcel
is not in compliance with the regulatory ordinances, the Department of Planning Services' shall designate this
land use activity including structures as a non-conforming use per Sections 73, 74 and 75 of the Weld County
Zoning Ordinance as follows:
73 Non-Conforming Uses of Land. Where at the time of passage of this Ordinance, or of passage of
future amendments of this Ordinance, a lawful USE of land exists which would not be permitted by
the regulations imposed by this Ordinance or future amendment, the USE may be continued so long
as it remains otherwise lawful provided the following conditions are met:
73.1 Extension or expansion.
73.1.1 No such non-conforming USE shall be enlarged or increased, nor extended to occupy a
greater area of land than was occupied at the effective date of adoption or amendment of this
Ordinance without first having received a Special Review Permit pursuant to the procedure
established in Section 24.
73.1.2 A non-conforming USE shall not be extended or enlarged after adoption or amendment of
this Ordinance by erection of additional SIGNS intended to be seen from off the premises,
or by the addition of other USES which would be prohibited in the zoning district invoved
73.1.3 No such non-conforming USE shall be moved in whole or in part to any portion of the LOT
or parcel other than that occupied by such USE at the effective date of adoption or
amendment of this Ordinance.
73.2 Substitution of USES
73.2.1 A non-conforming USE may as a Use by Special Review be changed to another USE which
does not conform to the USES allowed in the zoning district provided that the Board of
County Commissioners shall find that the proposed USE is equally appropriate or more
appropriate to the zoning district and NEIGHBORHOOD than the existing non-conforming
USE. In permitting such change, the Board of County Commissioners may require
appropriate conditions and safeguards in accord with the provisions of this Ordinance
73.2.2 Whenever a non-conforming USE is replaced by a permitted USE the non-conforming USE
may not be re-established. The permitted USE shall thereafter conform to the provisions of
this Ordinance.
73.3 Abandonment. If any such non-conforming USE of land ceases for any reason for a oeriod
of more than six(6) months, any subsequent USE of such LOT or parcel shall conform to the
regulations specified by this Ordinance for the zoning district in which such LOT or parcel is
located.
74 Non-Conforming Structures. Where a lawful STRUCTURE exists at the effective date of adoption
or amendment of this Ordinance that could not be built under the terms of this Ordinance by reason
of restrictions on area, LOT coverage, height, its location on the LOT, or other requirements
concerning the STRUCTURE, such STRUCTURE may continue to exist so long as it remains
otherwise lawful, subject to the following provisions:
74.1 Repair and Restoration. Should such non-conforming STRUCTURE or non-conforming
portion of a STRUCTURE be destroyed by any means to an extent more than fifty percent
(50%) of its replacement cost at time of destruction, it shall not be restored except in
conformance with the provisions of this Ordinance. Ordinary repairs the value of which do
not exceed fifty percent (50%) of replacement cost of the STRUCTURE may be permitted.
74.2 Expansion or enlargement. No such non-conforming STRUCTURE or non-conforming
portion of a STRUCTURE may be expanded, enlarged or altered in a way which increases
its non-conformity, except that those STRUCTURE(S)that are non-conforming by reason of
non-compliance with existing SETBACK requirements may be expanded or enlarged so long
as such expansion or enlargement does not further diminish the non-conforming SETBACK.
No expansion or enlargement of STRUCTURE(S)shall be allowed within an existing right-of-
way.
74.3 Substitution of STRUCTURES. Should such non-conforming STRUCTURE be moved tor
any reason, for any distance whatever, it shall thereafter conform to the regulations for the
zoning district in which it is located after it is moved.
74.4 Existing Building Permits. To avoid undue hardship, nothing in this Ordinance shall be
deemed to require a change in the plans or construction of any STRUCTURE on which
actual construction was lawfully begun prior to the effective date of adoption or amendment
of this Ordinance and upon which actual construction has been carried on diligently. Actual
construction is hereby defined to include the placing of construction materials in permanent
position and fastened in a permanent manner. Where excavation or demolition or removal
of an existing STRUCTURE has begun preparatory to construction, such excavation,
demolition or removal shall be deemed to be actual construction provided a building permit
for the new STRUCTURE has been issued and the preparatory work is carried on diligenty
75 Non-Conforming Uses of Structures. If a lawful USE of a STRUCTURE or STRUCTURE and
premises in combination exists on the effective date of adoption or amendment of this Ordinance that
would not be allowed in the zoning district under the terms of this Ordinance, the USE o: such
STRUCTURE or STRUCTURE and premises may be continued so long as it remains otherwise
lawful, subject to the following provisions:
75.1 Repair and Restoration. An existing STRUCTURE devoted to a USE not permitted oy this
Ordinance in the zoning district in which it is located which is destroyed by any means to an
extent greater than fifty percent(50%)of its replacement cost at time of destruction shall not
be restored except to gain conformance with all provisions of this Ordinance. Tha non-
conforming USE may not be re-established after restoration. Ordinary repairs. the value of
which do not exceed fifty percent (50%) of replacement cost of the STRUCTURE may oe
permitted.
75.2 Expansion or Enlargement
75.2.1 A non-conforming USE may be extended throughout any parts of a STRUCTURE which were
manifestly arranged or designed for such USE at the time of adoption or amendment of this
Ordinance, but no such USE shall be extended to occupy any land outside such
STRUCTURE without first having received a Special Review Permit pursuant to the
procedures established in Section 24.
75.2.2 A non-conforming USE shall not be extended or enlarged after adoption or amendment of
this Ordinance by erection or attachment of additional SIGNS intended to be seen off the
premises, or by the addition of other USES which would be prohibited in the zoning district
involved.
75.2.3 No such non-conforming USE shall be moved in whole or in part to any portion of the LOT
or parcel other than that occupied by such USE on the effective date of adoption or
amendment of this Ordinance.
75.3 Substitution of USES
75.3.1 A non-conforming USE may, as a Use by Special Review, be changed to another USE which
does not conform to the USES allowed in the zoning district. Provided, however, that the

75.4 Abandonment. When a non-conforming USE of a STRUCTURE or STRUCTURE and premises is
discontinued or abandoned for any reason for a period of more than one (1) year, any subsequent
USE of such STRUCTURE or STRUCTURE and premises shall conform to the regulations specified
by this Ordinance for the zoning district in which such STRUCTURE or STRUCTURE and premises
is located.
Regarding the leasehold parcel in the southwest corner of the before-mentioned parcel. Planning Staff has
determined based on the information provided, referrals received, property research and investigation that
the proposal is in violation of Section 5.6 of Ordinance 201 that address setbacks from property lines. The
twelve foot by twenty eight foot(12x28) pre-fabricated equipment shelter does not meet the required setbacks
for the C-3, Commercial zone district. Further, the proposal is in violation of Section 3.2.2 through 3.2.7, 3.'
and 5.2.5 of Ordinance 201, and Section 2.6.4.2.g of the Mixed Use Development Ordinance, (Ordinance 191)
that addresses the landscaping requirements for this zone district. Further, this parcel shall be required 'o
be in full compliance with the previously identified County Ordinances.
Should the applicant wish to proceed with the proposal as submitted, the Department of Planning Services
strongly recommends that the applicant or his representative contact this office to schedule a time to meet
and discuss available options and processes for further development of this parcel.

Your application and related materials for the request described above are complete and in order at this
time. Our Department will be processing the Site Plan within 45 days or upon receipt of recommendations

COMMENTS:
• Proposed site is located within the confines of the Truck Wash and Retail area. It is governed
under SPR-103. The parcel has two buildings, one storage shed and numerous trailers. The
larger of the two structures contains a 3-bay truck washing and an oil and lube facility. Further
there is a massage parlor, and a strip commercial building with various retail/commercial
establishments, including a cafe/coffee shop
Access is off of Turner Blvd., a paved street. The parking lot is also paved. There are numerous
55 gallon barrels stacked two high behind the wash facility. There are also stacks of wood pallets
adjacent to the wood fence enclosure that surrounds the property. Three windowless trailers and
one potable water tanker truck are also parked on the property. One of the trailers is connected
to power via an extension cord.
Landscaping on site is limited to island plantings in front of facility, that includes ornamental
animals, a bird bath and limited green growing plantings. The rear of the facility has seven
ornamental trees, that include but are not limited to maples, honeylocust and ornamental
crabapples. This planting area is linear and is approximately 8' x 100'. No other landscaping was
present on the property. (Visibility was difficult as there was so much material stacked and piled
adjacent to the rear fence). A rear fence approximately 8' in height surrounds the property to the
west.
The curb cut to the rear of property, southwest corner is present. Access to this point is
unaccessible, as trailers are parked here. Further, a fence between the two properties restricts
accessibility between parcels.

process for the above-referenced project. I wanted to address each of the items listed in
the "Application Requirements for a Site Plan Review" packet, since some of the items
do not apply to an unmanned wireless facility.
Item 1.)—Ten(10) copies of the Site Plan Review Application Form(Page 9)
Item 2.)—One (1) original Site Plan Review Certificate Form(Page 10)
Item 3.) — One (1) copy of the Special Warranty Deed showing RRRS LLP, a Colorado
Limited Partnership, as owner.
Item 4.) — A party wall agreement and legal description for duplex or triplex uses, does
not apply.
Item 5.)—A condo declaration and legal description for the condo, does not apply.
Item 6.)—Detailed description of the Proposed Use: The proposed project will consist of
two (2) primary elements: a 12' X 28' unmanned equipment shelter that has an aggregate
rock exterior, tan in color, and a seventy foot monopole which will contain three (3)
sectors of antennas arrays, with four (4) antennas per sector, for a total of twelve (12)
antennas. Each antenna measures approximately 1'X 4'. AT&T Wireless Services will
be leasing approximately 1,350 square feet of land near the rear lot line (western
boundary) of the property.

Item 7.) —Evidence that the use will have an adequate source of potable water - Since the
proposed facility is unmanned, I request that this requirement be waived.
Item 8.) —Evidence that the use will have adequate sanitary sewage — Since the proposed
facility is unmanned, I request that this requirement be waived.
• Item 9.) —Two (2) copies of the completed Weld County Road Access Information Sheet
have been included.
Item 10.) — Number of employees associated with the use — The proposed facility is
unmanned, however, approximately once a month, a radio frequency technician will visit
the site for routine maintenance. In the event of a system failure, a technician would also
visit the site.
Item 11.) — Statement indicating that the proposed use meets the required setback and
offset requirements of the zone district — The subject property is zoned C-3, Commercial
by Weld County. The Weld County Zoning Ordinance requires uses or accessory uses be
a minimum of twenty five (25) feet from the existing or proposed street right-of-way; the
proposed use meets this requirement, as shown on the "Site Plan and Enlarged Site Plan"
on Sheet Z-2 of the enclosed plans. The C-3 Zone District permits as a use by right, a
seventy (70) foot or less "communication transmission or relay tower". The proposed
monopole is to be a maximum of seventy (70) feet in height.
Item 12.) -- Generalized sketch of building elevations — Please see the enclosed
"Elevation" drawing on Sheet Z-3 and the photo simulation for additional exterior
construction material details.
Item 13.) — Signage — There will be no signs associated with the proposed wireless
facility.

Item 15.) — Storm Water Runoff— Since no additional impervious area will be created as
a result of this proposed use, the existing storm water runoff will remain unaltered.
Item 16.) — Off-Street Parking — The proposed facility will be unmanned and therefore
will not require additional parking.
Items 17, 18, and 19.) —Loading/Service Area— There will be no loading or service area
associated with the proposed facility.

Items 20, 21, 22.) — Safe Access to an Approved Public or Private Street, Construction
Standards, and Acceleration/Deceleration Lanes —The proposed facility will be accessed
via a 15' access/utility easement, which is located within the existing driveway that
intersects with Turner Boulevard.
Item 23.) —Trash Collection—No trash will be produced at the proposed facility.
Item 24.) - Operational Standards
A. Noise — No noise will be generated from the facility. The noise
standards established in 25-12-101 C.R.S. will not be exceeded.
B. Air Quality — The proposed facility will not negatively affect the
air quality of the area. The air quality standards established by the
Colorado Air Pollution Control Commission will be met.
C. Water Quality — There will be no negative effect on the quality of
water as a result of this proposed facility. The facility will be
operated in accordance with the standards established by the
Colorado Water Quality Control Commission.
D. Radiation and Radioactive Materials—There will be no radioactive
materials on the site. The proposed facility will be in accordance
with the regulations of the State of Colorado and the United States
Government.
E. Heat — The proposed facility will not emit sufficient heat to raise
the temperature of the air or of materials at or beyond the lot line
more than five (5) degrees Fahrenheit.
F. Glare —No beams or rays of light will shine directly onto adjacent
properties; nor will direct or reflected light from the proposed
facility create a traffic hazard to operators of motor vehicles on
public or private streets; no color lights will be used that could be
confused with or construed to be traffic control devices.
G. Property Maintenance -- The property will be maintained such that
grasses and weeds will not grow taller than twelve (12) inches. No
noxious weeds will be allowed to grow on the site.

non-commercial junkyard consisting of miscellaneous debris,clothes dryer, and piles of wood have been removed
from the property. Therefore, the zoning violation is now closed.
