We own and operate B & B Mobile & R.V. Park, we have been here
for over 24 1/2 years Over the years the traffic has increased
tremendously. Traffic used to flow smoothly then they put in the
traffic signal on our corner.
I wrote the CDOT concerning this problem, I have enclosed a
copy of the letter they sent back. Since the light has been put in
we are have a nightmare in the daytime of trucks using the "jake
brakes' starting 1/4 mile up and continuing to the light. These
"jake brakes" are extremely loud and actually rattle walls on the
R.V.'s and mobile homes, as well as our house.
Our tenants have asked me to see if a sign could not be put up
that states that "jake brakes" or compression brakes could not be
used in this area. People have told us that they have sign such as
this in other states.
We realize that the State Patrol cannot monitor this, they are
very busy, but if we had such a sign, we would be able to contact
companies that constantly use these types of brakes, we would have
some leverage.
My husband drove for a gravel company for 30 years and they were
not allowed to use these types of brakes in a residential area.
The letter I am enclosing as you can see, have put the "jake
brake" problem up to you. We would appreciate any help that you
could give us.

Dear Mrs. Smith:
The Colorado Department Of Transportation (CDOT) thanks you for bringing this
noise issue to our attention. In response to your 9-7-95 letter, a noise
analysis was completed for this area.
The noise analysis determined the residential setback distance to be at 91 feet
for the year 1993 and 97 feet for the year 2013. The noise setback distance is
measured from the centerline of the median out toward the residential site. 91
feet is the distance to which the noise level is at 66 DBA. If the residence
falls within that distance, it is considered to have a noise impact. The closest
residences within the B & B Mobile and RV Park are approximately 75 feet from the
centerline of the roadway. This is within the noise impact area.
The CDOT compiles a list of all sites meeting the 66-67 DBA threshold and funding
is provided for several locations each year. There are many sites on the list
at this time. When the Type II Noise List is updated (time frame unknown), we
will have your area added to this list.
In addition, you may consider contacting your County Commissioners regarding
regulations on the use of "jake brakes"; for possible action at the county level.

This is in response to your letter regarding the use of truck "jake" brakes in your area. We have
received similar complaints from other parts of the County and have reviewed the problem with the
Weld County Sheriffs Office. Unfortunately, "jake" brakes are legal devices in the State of
Colorado, and their use cannot be restricted. Since law enforcement agencies cannot restrict their
use, placing of signs is inappropriate.
Your suggestion about contacting the companies whose drivers are consistently discourteous in their
use of "jake" brakes is an excellent point. I'm sure they will help if you contact them.
