RE: APPROVE REVISION TO RECORDED EXEMPTION #2494 - TOMM OWENS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on August 9, 1999, by Resolution #992010, the Weld County Board of
Commissioners approved Recorded Exemption #2494, with Conditions of Approval, and
WHEREAS, Tomm Owens, current owner, 33530 Weld County Road 25, Greeley,
Colorado 80631, has submitted a request to the Board of County Commissioners to change the
location of Lot A of said Recorded Exemption prior to the recording of the plat, and
WHEREAS, said request was considered at the regular meeting of the Board on
December 13, 1999, and
WHEREAS, after review the Board deemed it advisable to allow the request to change
the location of Lot A of Recorded Exemption #2494 and to limit each lot to one access.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of Tomm Owens to revise Recorded Exemption #2494
be, and hereby is, approved as follows:
1. The location of Lot A shall be changed to the southwest corner of the
original parcel.
2. Delete Condition of Approval 2.C.
3. Amend Condition of Approval 2.D. to read, "Lots A and B shall be limited
to one access per lot, as permitted by Ordinance#180. Lot A shall utilize
the existing access located at the western edge of the lot. Lot B shall
utilize the existing agricultural, oil and gas ditch road access located at
the eastern edge of the lot. No circle drives or additional access shall be
granted."

SUBJECT: Recorded Exemption 2494
Tomm Owens is requesting a change in the location of Lot A of Recorded Exemption 2494,
approved by the Board of County Commissioners on August 9, 1999. (See attached letter and map)
The plat has not been recorded and the Department of Planning Services' staff is recommending
approval of the change in location for Lot A.

The above-referenced R.E. # 2494 was initially denied by the Planning Staff
P'' because it would create an island lot and the possibility of overly expensive
costs to bring utilities to the lot. At that time we felt that our proposed location
was the most efficient and would have the least negative impact on the
0 productive farm ground. With this in mind, we chose to take this denial before
the Board of Commissioners for their approval, and it was approved at that ,>
Y,l meeting. After closer review, and a better understanding of the farming
•y; practices on this property, we feel that the Staff recommendation for the location
rof Lot A was probably the most orderly and efficient for this farm. `,

With this said, it is our request prior to the final plat recording, to relocate Lot A
In to the Southwest corner of the farm and designate the previous location, along ,,
with one other, as a building envelope on Lot B. Attached you will find a map of
