RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #1735 - TROSTEL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1735, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1735 was submitted by Willard and Mary Trostel, 4914 North County Road 3, Fort Collins, Colorado 80524, for property known as Lot B of Amended RE #484, which is located in the SE% of Section 35, Township 1 North, Range 68 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 19 acres and 1 acre. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1735 submitted by Willard and Mary Trostel be, and hereby is, approved conditional upon the following: 1. A Weld County septic permit is required for any proposed home. It shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. Prior to recording the plat, any existing septic system(s) which is not currently permitted through the Weld County Health Department shall require an ISDS evaluation. 3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The parcel of land under consideration is described as Lot B of AmRE-484, being in the SE4 of Section 35, T1 N, R68W of the 6th P.M., Weld County, Colorado. The property lies within the Urban Growth Boundary of the City of Northglenn and the City of Broomfield. A residence is existing on proposed Lot A, and a proposed Lot B is vacant farm ground. This request is to further divide Lot B of AmRE-484 into two parcels of 19 and 1 acres, more or less. Mountain View Water provides both proposed lots with water and septic systems will provide sewage disposal. Access to both proposed lots is existing onto Weld County Road 11. Weld County Road 11 has been annexed by the City of Northglenn. The City of Northglenn has reviewed this request and has no conflict of interest. The Weld County Health Department has reviewed this request and recommends conditional approval. The City of Broomfield has reviewed this request and has stated that this area is located in their Master Planning area and is designated for commercial and industrial uses. This request will be the third recorded exemption on the property. In 1972 the Board of County Commissioners approved RE -101 which split the property into two parcels of 1 acre and 54 acres, more or less. In 1981 the Board of County Commissioners approved RE -484 which split the 54 acre parcel of RE -101, into two parcels of 35 acres and 19 acres, more or less. In 1982, the 20 acre parcel of RE -484 was amended by the Board of County Commissioners to 20 acres. The applicant is now requesting to further divided the 20 acre parcel of Amended Recorded exemption 484 into two parcels of 1 acre and 19 acres more or less. Comprehensive plan Agricultural policy number 7 states that a lot may be created to "enable the property owner to provide a residence for direct members of the farm family and also for workers employed at the farm." The applicants have stated that they intend to farm the property with their son. Section 35, Township 1 North, Range 65 West of the 6th P.M., Weld County, Colorado, is a unique section. The northern and western parts of the section are in the City of Broomfield. The section directly to the east is the City of Northglenn. Adams County lies directly to the south. The portion that lies in the Weld County has had two recorded exemptions and one amended recorded exemption. The City of Broomfield has designated this area as future commercial and industrial uses. Adding another buildable residential lot to this area would be in conflict of the City of Broomfields master plan. The City of Broomfield does not object to this request, but their master plan should be taken into consideration when reviewing this request. Staff requests that the Board decide if allowing another lot to be created in this area will be consistent with the standards of Sections 11.5.1 through 11.5.7, given previous property divisions and the City of Broomfields master plan.
