RESOLUTION
RE: APPROVE MINOR RESUBDIVISION - LUTZE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 27th day of
February, 1995, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing
the application of Donald L. Lutze, 2036 1st Avenue, #178, Greeley, Colorado 80631, for Minor
Resubdivision to vacate that portion of Russell Avenue on the north side of Lots 33 through 43,
Block 48, Barnesville, Weld County, Colorado, as further described on the Petition to Vacate
attached hereto and incorporated herein by reference, and
WHEREAS, Donald L. Lutze, applicant, was present, and
WHEREAS, the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented in this matter and, having
been fully informed, finds that this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 8 of the Weld County Subdivision Ordinance.
2. It is the opinion of the Board of County Commissioners that the applicant has shown
compliance with Section 8.2.5 of the Weld County Subdivision Ordinance including
specifically:
a. The right-of-way has not been used for its intended purpose since the
recording of the approved plat.
b. Seventy (70) percent of the landowners adjacent to the proposed right-
of-way vacation have waived any objection to the vacation by signing a
petition.
c. The vacation would be compatible with the surrounding area and uses, be
consistent with efficient and orderly development, is consistent with the
Weld County Comprehensive Plan, and would not deprive any parcel of
adequate access to a public road or street right-of-way.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of Donald L. Lutze, Minor Resubdivision #374 on the
hereinabove described parcel of land be, and hereby is, granted, subject to the following conditions:

1. Lots 1 through 11 and 33 through 43, Block 48 and Block 59 shall be combined onto
one deed and a restriction placed on the deed that no lot or combination of lots may
be transferred separately.
2. The applicant shall record the deed at the Clerk and Recorder's office and provide
a copy of the recorded deed to the Department of Planning Services.
BE IT FURTHER RESOLVED that Russell Avenue on the north side of Lots 33 through 43,
Block 48, Town of Bamesville, Weld County, Colorado, as fully described on the attached Petition
to Vacate, be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 27th day of February, A.D., 1995.

The attached application and submitted materials are concerning a request made by Donald L.
Lutze. The request is to vacate the portion of Russel Avenue on the north side of Lots 33-43,
Block 48, Town of Barnsville. The property is located north and adjacent to Madell Avenue and
south and adjacent to Weld County Road 293 right-of-way.
Based upon the submitted application materials and other relevant information regarding this
request, the Department of Planning Service's staff recommends conditional approval of this
request.
This determination was based on the following:
- The submitted materials are in compliance with Section 8.2.5 of the Weld County
Subdivision Ordinance.
- The right-of-way has not been used for its intended purpose since the recording of the
approved plat.
- Seventy (70) percent of the landowners adjacent to the proposed right-of-way
vacation have waived any objection to the vacation by signing a petition.

Dear Mr. Lutze:
Your application and related materials for the request described above are complete and in order at
the present time. I have scheduled a meeting with the Board of County Commissioners for Monday,
February 27, 1995, at 9:00 a.m. This meeting will take place in the Weld County Centennial Center,
915 Tenth Street, Greeley, Colorado.
It is recommended that you and/or a representative be in attendance at each of the meetings
described above in order to answer any questions that might arise with respect to your application.
The Department of Planning Services' staff will make a recommendation concerning this application to
the Weld County Planning Commission. It is the responsibility of the applicant to contact the

RE: PROPOSAL OF RIGHT-OF-WAY VACATION
Dear Commissioners,
Donald and I purchased 23 lots in the unicorporated town of
Barnseville, equal to 2.17 acres. Block 59 being 1 lot and 22
lots on the east half of Block 48. In between Block 48 and 59
there is an avenue that runs East. and West, Russell Avenue. We
are applying to vacate Russell Avenue along the South edge of
Block 59 with the West edge of the vacation going only to the
alley that is adjacent to lot 33 in Block 48 and the East edge of
the vacation going only to Weld County Road 61 3/4 that is
adjacent: to lot 43 in Block 48. Our intent upon vacation of this
portion of Russell Avenue is to improve the land by building a
residence in Block 59. Of the 2.17 acres Block 59 is the most
suitable portion of the landscape to build our residence. To the
best of anyones knowldege the avenue and alleys never existed,
only on the platted maps of Barnseville. Barnseville was only a
town from 1910 to 1935 and has since that time been
unicorporated.
We are requesting your approval of this right-of-way vacation.
