HomeMy WebLinkAbout950053.tiffRESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST LOU ANN CATENCAMP FOR VIOLATIONS OF THE WELD COUNTY ZONING ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Lou Ann Catencamp, VI #2158, is allegedly in violation of the Weld County Zoning Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violations have not been corrected, and WHEREAS, on the 10th day of January, 1995, a public hearing was held before the Board of County Commissioners for the purpose of hearing any testimony relating to said violations, and WHEREAS, Lou Ann and Dennis Catencamp was present at said hearing, and WHEREAS, at said hearing the Board of County Commissioners delayed referral of said violations to the Weld County Attorney's Office for a period of 60 days to allow the property owner adequate time to bring subject property into compliance, and WHEREAS, the Board deems it advisable to proceed with legal action against the above named individual without further Board action if the subject property is not brought into compliance within 60 days. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that if said violations still exist on March 14, 1995, the Weld County Attorney be, and hereby is, authorized to proceed with legal action against Lou Ann Catencamp to remedy the violations of the Weld County Zoning Ordinance, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties. 950053 PL0824 Pt; (A; Cat& n ct rn p VIOLATIONS PAGE 2 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 10th day of January, A.D., 1995. The noncommercial junkyard and mobile home without a permit are a violation of Section(s) 31.2, 31.3.9 and 31.2.16 of the Weld County Zoning Ordinance. To correct the violation a screening plan would need to be submitted to the Planning Department for approval then installed around the noncommercial junkyard or the noncommercial junkyard would have to be removed from the property and the appropreate permits for the mobile home would need to be applied for and approved or the mobile home would have to be removed. The property is not in compliance at this time A noncommercial junkyard is still located on the property without proper screening and no screening plan has been submitted to the Planning Department for approval also the mobile home is still located on lot 6 without the proper zoning permits . To bring the property into compliance a screening plan would need submitted to the Planning Department for approval then installed around the noncommercial junkyard or the noncommercial junkyard would have to be removed and the proper zoning permits applied for and approved on the mobile home or it would have to be removed.
