MUST-CARRY CQMPLAINT
Paxson Denver License, Inc. ("Paxson"),' licensee of commercial television station
KUBD-TV,2 Denver, Colorado, by its attorneys and pursuant to Sections 76.7 and 76.61 of the
Commission's rules,hereby files this must-carry complaint against Fanch Communications, Inc.
("Fanch") for its failure to carry the signal of KUBD-TV on its cable systems serving various
communities in Arapahoe, Jefferson, Larimer, Park, and Weld counties, and the surrounding
areas (the "cable communities").3
' Paxson Denver License, Inc., is a subsidiary of Paxson Communications Corporation.
Both entities will be referred to as"Paxson."
Z Paxson's request to change the call sign of KUBD-TV to KPXC is pending before the
Commission.
The cable systems are listed in Exhibit 1.

By letters dated October 27, 1997, Paxson requested carriage on the Fanch systems,
informing the cable operator that it was entitled to carriage and that the station either currently
delivers a quality signal or is committed to doing so and would purchase the requisite equipment
to ensure signal delivery.' Pursuant to Section 76.61(a)(2)of the Commission's rules, Fanch was
obligated to respond to Paxson's requests for carriage in writing within thirty (30)days of receipt
of the letters. Fanch did not respond as required by the rules, however, and has, to date, failed to
add KUBD-TV to its channel line-up.' Thus,pursuant to Section 76.7(c)(4)(iii)(A) and(B) of
the Commission's rules, Paxson is now filing this complaint within 60 days of Fanch's failure to
respond to KUBD-TV's requests for carriage.`
KUBD-TV Is A Qualified Local Commercial Television Station
KUBD-TV is licensed to Denver, Colorado,which is in the Denver"Area of Dominant
Influence"("ADI"). Fanch operates cable systems serving various communities in Arapahoe,

Regional Manager, Fanch Communications Inc., dated October 27, 1997, attached hereto as
Exhibit 2.
s Despite Fanch's failure to respond in writing as required by the Commission's rules,
Paxson has had discussions with Fanch which indicate that the cable operator may begin to carry
the station on its systems soon. However,because the Bureau has taken a hard line in enforcing
the requirement that stations file Must-Carry Complaints within 60 days of a"specific event,"
fig,tg, Complaint of Horizon Broadcasting Corporation against Horizon Cable I Limited
Partnership, CSR-5025-M(Cable Serv. Bur., Oct. 21, 1997), and because Fanch failed to respond
to Paxson's carriage request in the manner required under section 76.61(a)(2) of the FCC's rules,
Paxson believes that, in order to preserve the station's must-carry rights, it must file this must-
carry complaint.

Jefferson, Larimer, Park and Weld counties,which are also within the Denver ADI.
Accordingly, KUBD-TV is entitled to mandatory carriage on Fanch's systems if it satisfies the
statutory definition of a"qualified local commercial television station"under the must- carry
rules. Under this definition, a full-power local station is entitled to carriage if(1) such carriage
will not cause increased copyright liability for the cable operator, and(2) it either delivers a
signal of at least-45dBm to the cable system's principal headend or agrees to be responsible for
the costs of delivering a signal of good quality to the cable system.'
KUBD-TV is a qualified local commercial television station as defined under the must-
carry rules. First,because the Fanch systems and KUBD-TV are located within the same ADI,
the station's signal will not cause increased copyright liability for the cable operator.' Second, in
the October 27 letters,Paxson assured Fanch that should its systems be unable to receive a
quality signal off-the-air from KUBD-TV at their headends, Paxson would commit to acquiring
and installing any and all necessary improvements and equipment needed to provide Paxson with
such a signal.

Copyright Act provides that a cable operator's carriage of a local station(i.e., within the same
ADI as the operator)does not increase the operator's copyright liability. See Mountain
Broadcasting Corp , 10 FCC Rcd 7132, 7133 (Cable Serv. Bur. 1995) ("[Al station located
within the same ADI as a cable system is no longer considered a `distant signal' on that system
for purposes of compulsory copyright license liability."); ,Son Broadcasting.Inc , 10 FCC Rcd
8763, 8765 (Cable Serv. Bur. 1995).

Fanch Ras Failed to Fulfill Its Obligation Under the Rules
The Commission has stated that it will not allow cable operators to avoid their statutory
carriage obligations by refusing to cooperate with a local television station that seeks to obtain its
must-carry rights.' In this case,Fanch has not responded to Paxson's requests for carriage, as it
was required to do under the Commission's rules.
In sum, Fanch has failed to comply with its statutory obligation to provide carriage, upon
request, to a qualified local television station. By refusing even to respond to KUBD-TV's
requests, moreover, Fanch has ignored its obligation under the must-carry law"to cooperate fully
with broadcast stations so that they are not deprived of the statutorily mandated must-carry rights
to which they are entitled."10 Accordingly,Paxson respectfully requests that the Commission

Paxson seeks carriage on the systems identified in this Petition and in the carriage request
letters attached as Exhibit 2. Based upon its review of the FCC's records, Paxson understands
that the communities listed below are served by these systems.
Wellington(CO0357), and unincorporated portions of Larimer County (CO0223). The
cable systems that serve these communities appear to provide cable service to Fort Collins,
Laporte, Lory State Park, and Bellvue, Colorado -- although these areas are not assigned separate
community unit identification numbers. See 1997 Television& Cable Factbook at D-215
(indicating that the system serving LaPorte also serves Fort Collins, Wellington and portions of
Larimer County). KUBD-TV's general manager was informed by Fanch Communications that
its system serving Fort Collins also serves Wellington, Laporte, Lory State Park, and Bellvue,
Colorado.
Eaton (CO0163), Ault(CO0164), Pierce(CO0230).
Bailey(CO0327), Pine Junction(CO0445), Shawnee(CO0328), and unincorporated
portions of Park County(CO0381). The cable system that serves these communities appears to
provide cable service to Burland,Deer Creek,Pine,Roland Valley, and Woodside, Colorado--
although these area are not assigned separate community unit identification numbers. Stc 1997

Burland, Deer Creek, Pine, Roland Valley and Woodside).
Conifer, Colorado. See 1997 Television& Cable Factbook at D-204(indicating that
Fanch Communications serves Conifer, Colorado). KUBD-TV's general manager was informed
by Fanch Communications that its system serving Confier also serves Marshdale, Colorado
(CO0398).
Greystone (CO0397). KUBD-TV's general manager was informed by Fanch
Communications that its system serving Greystone also serves portions of Evergreen, Colorado.
Genesee (CO0258),Hiwan(CO0261), and unincorporated portions of Jefferson County
(CO0455). The cable system that serves these communities appears to provide cable service to
Lookout Mountain, Colorado -- although this area is not assigned a separate community unit
identification number. See 1997 Television& Cable Factbook at D-210 (indicating that the
system serving Genesee also serves Lookout Mountain).
Gilcrest (CO0333), Platteville(CO0331), and unincorporated portions of Weld County
(CO0332).

Table Mountain, Colorado. Although it does not appear that Table Mountain has an FCC
community unit identification number,KUBD-TV's general manager was informed by Fanch
Communications that it has a cable system serving that community and the surrounding areas.

Fanch Cablevision of Colorado).
