The Weld County Health Department has reviewed this proposal.
The application has satisfied PUD Ordinance No. 197 in regard to water service. Water will be
provided by the Central Weld County Water District.
The application does not appear to satisfy the PUD Ordinance in regard to sewage disposal. The
application has proposed septic systems to serve all 6 lots. However, one of the lots is proposed to be
a commercial lot. Section 2.20 of the PUD Ordinance indicates that all PUD's containing commercial
lots must be served by a public sewer system. The ordinance does not define "public sewer system".
However, we do not consider an individual septic system to be a public system. It should be noted
that the majority of commercial uses discharge only domestic type effluent, i.e. no chemicals, into
their septic system. Thus, the discharge from this commercial use would likely be chemically similar,
and probably less actual flow, than from a typical residential home.
The environmental impact plan provided in the application materials and required in section 5.3.6 of
the PUD Ordinance appears to substantially address all potential impacts as described in Section 6.3.
However, it did not appear to consider the possible visual and aesthetic impacts from the commercial
lot (Dan's Garage). It is our understanding that those impacts as well as specific impacts from the
commercial lot will be addressed through the Site Plan. Review process.
As we discussed above, the application does not appear to comply with the PUD Ordinance in regard
to sewer service. However, in the event the application is found to be complete and in substantial
compliance with the Ordinance, we recommend that the following conditions be a part of any
approval:
1) No permanent disposal of wastes shall be permitted at this site.
2) The maximum permissible noise level shall not exceed the residential limit of 55 db(A) as
measured according to 25-12-102, Colorado Revised Statutes.
3) All residential homes and commercial uses shall be served by the Central Weld County Water
District.
4) An individual sewage disposal system, is required for each proposed home and the proposed
commercial structure. Each system shall be installed according to the Weld Count Individual
Sewage Disposal Regulations. EXHIBIT

In addition, Our staff observed that in the vicinity of the proposed development there were confined
animal feeding operations and numerous small acreage homes. Many of these homes have livestock
that include but may not be limited to cows and horses. It is our opinion that any future property
owner should be made aware that these agricultural uses exist and that they may be exposed to noise,
dust, flies, odors, etc. in excess of the common urban experience. As a result, we recommend that the
"Right to Farm" covenant be required to be placed on any recorded plat.

The Weld County Public Works Department has reviewed this proposal. This project falls
primarily under the purview of the Weld County Planned Unit Development Change of Zone
Standards. Our requirements are as follows:
1. WCR 33: WCR 33 is designated on the Weld County Transportation Plan Map as a local
gravel road and is maintained by Weld County. State Highway 256 and US Highway
85 border the proposed PUD on the south and east sides. A traffic count was
taken on November 4, 1998, and reflected an average daily traffic count of 82.
2. Urban Development Nodes:Any urban development located within 1/4 mile radius of
the intersection of two or more roads in the State Highway system as defined in the Weld
County Comprehensive Plan and Urban Development Growth Map 1, shall be
required to pave the internal road system. (Sections 2.17 and 2.18 of the PUD
Ordinance 197).
3. Internal Cross Section: Subdivision Ordinance 173-E, Section 10.2.1.8 states that local
roads shall have 10 to 11-foot driving lanes with four-foot shoulders. Hot bituminous
pavement and aggregate base course or full depth asphalt will be acceptable for
the internal cross section.
A. A minimum 50-foot paved edge to edge cul-de-sac radius will be required.
4. Access: The main access to the PUD will be from WCR 33. All access will be onto the
internal road system with no direct access onto WCR 33 except Black 3, Lot 1, the
existing agricultural parcel. This parcel shall utilize the existing agricultural, oil and
gas, and ditch roads that are necessary for agricultural operation. No additional
accesses shall be granted.
5. Maintenance: The homeowners association for this PUD will own and maintain the road
system.
6. Traffic Impact Analysis: A traffic impact analysis will not be required unless the State
Highway Department (CDOT) requests it for the intersection at State Highway 256.
7. State Highway 85 Access Corridor Plan: Segment 2b and page 9 of the Access
Phasing Worksheet identifies the intersection of State Highway 256 and WCR 44
as realigned to 90°. It also appears that a portion of WCR 33 is to be realigned south
of State Highway 256. Please require the Colorado Department of Transportation
to respond with preliminary realignment drawings to see how the proposed PUD may
be affected.

8. Storm Water Drainage: The applicant has submitted a statement describing how the
storm water drainage will be handled. Due to the size of the lots, area of the open
space and agricultural space, and the expanded slight increase I the storm water
runoff, we do not anticipate the need for additional drainage facilities. Standard
borrow pit ditches along the proposed internal road system will accommodate the
storm water drainage runoff.
9. Street Names: Streets shall have the names of existing streets which are in alignment in
the county or in adjacent counties or municipalities. There shall be no duplication of
street names within the area.
A. The applicant shall be responsible to provide a stop sign and a street name sign
at the appropriate location prior to entering onto WCR 33.
10. Improvements Agreement: I have reviewed the improvements Agreement
According Policy Regarding Collateral for Improvements (Private Road
Maintenance) for improvements, unit costs, and time for completion. All items appear to
be adequate for the proposed PUD. I have no conflict with the Improvements
Agreement.
11. Off-Site Improvement Agreement: The applicant shall enter into a Road
Maintenance and Improvements Agreement with Weld County Public Works for
upgrading and paving WCR 33 from State Highway 256 through the radius of the
entrance, a distance of 400±feet.
