Hall, Chairman Commissioner Barbara J. Kirkmeyer, Pro -Tern Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Todd Hodges The following business was transacted: I hereby certify that pursuant to a notice dated June 19, 1995, and duly published June 29, 1995, in the Windsor Beacon, a public hearing was conducted to consider the request of David and Barbara Wilson for a Site Specific Development Plan and Special Review Permit for erection of five (5) private radio towers (140' tall) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Todd Hodges, Planning Department representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Hodges stated he contacted the FAA who confirmed the tower height is under the minimum height of 200 feet; therefore, the FAA had no comments or concerns. He also noted, concerning Condition of Approval #5a, that Mr. Wilson submitted the Individual Sewage Disposal System evaluation this morning; therefore, said Condition is satisfied. David Wilson, applicant, was present and stated amateur radio is his hobby, and he purchased this property because it is isolated. He presented photos of the surrounding area in each direction as Exhibit B for the record. Mr. Wilson explained the towers need to be 140 - feet high to compete in his field and confirmed all Conditions of Approval and Development Standards are acceptable. Mr. Wilson noted operation of a ham radio is very competitive and technical. Franklin Zadel, private pilot, voiced concerns about the location of the proposed towers which is due north one-half mile from the runways of the airport, which has been in existence for 40 years. Discussion ensued concerning the location of the airstrip, and Mr. Hodges reiterated the FAA did not review this proposal because the towers are under the minimum height nor did the FAA mention the existing airstrip in the area. Mr. Morrison clarified the FAA does not assume jurisdiction unless towers exceed 200 feet. Mr. Zadel answered questions from the Board and stated further concerns about safety. Mr. Wilson stated he spoke to the FAA in Denver and noted the airport is private. He stated the FAA informed him the minimum flying height over private property is 500 feet and the minimum height of towers requiring lighting is 200 feet. Mr. Wilson noted there are many existing structures in the area which are 120 to 150 -feet high, and the height of his towers is well below regulations and will not be a hazard. After further discussion, Mr. Zadel requested a written statement from the FAA indicating the 140 -foot towers may be built in the path of the airport. Dave Farley, private pilot, voiced concerns about take offs and landings and noted 500 feet is not the minimum height in the traffic pattern of an airport. Jayne Tuttle, South Weld Ag, voiced concerns for the pilots who fly for the aerial application company, which has been in existence for 14 years. She noted strong objection to the proposal and questioned why the FAA did not inform the company about the proposal. Commissioner Hall suggested staff acquire a response from the FAA specifically regarding measurement between the proposed towers and the runway to mitigate concerns and acquire sufficient information for the Board to make a decision. After further discussion, Commissioner Harbert moved to continue the request of David and Barbara Wilson for a Site Specific Development Plan and Special Review Permit for erection of five (5) private radio towers (140' tall) in the A (Agricultural) Zone District to Wednesday, July 26, 1995, at 10:00 a.m. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. 951395 PL1000 ems: Pt RE: HEARING CERTIFICATION - USR #1083 FOR WILSON PAGE 2 This Certification was approved on the 17th day of July, 1995. to the Board TAPE #95-24 DOCKET #95-48 PL1000 APPROVED: BOARD OF COUNTY COMMISSIONERS LD COUNTY, COLORADO Dale K.
