RE: APPROVE ROAD MAINTENANCE AND IMPROVEMENTS AGREEMENT AND
AUTHORIZE CHAIR TO SIGN - STAN AND SHIRLEY ODENBAUGH
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Road Maintenance and
Improvements Agreement between the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, on behalf of the Public Works Department,
and Stan and Shirley Odenbaugh, 16124 Weld County Road 23, Platteville, Colorado 80651,
with terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Road Maintenance and Improvements Agreement between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, on behalf of the Public Works Department, and Stan and Shirley Odenbaugh be,
and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 20th day of May, A.D., 1998.

ROAD MAINTENANCE AND IMPROVEMENTS AGREEMENT
THIS AGREEMENT,by and between the COUNTY OF WELD,STATE OF COLORADO,
hereinafter called"County"and STAN and SHIRLEY ODENBAUGH hereinafter called"Operator"
is made and entered this 2 U `'� day of / 1a.q ,1998.

NOW THEREFORE,in consideration of the mutual covenants and conditions hereinafter set
forth,the County and Operator mutually agree to the following:
1. The primary haul route will be from the gravel pit south on Weld County Road(WCR)
23,approximately one-half mile to the intersection of WCR 32.5,then from that point
either west on the paved road to State Highway 66 or east staying on the pavement to
U.S. Highway 85.
2. Operator will control any fugitive dust created by the haul trucks by means of water or
chemicals for dust control.
3. WCR 23,the designated haul route, is the responsibility of the Operator to keep in good
repair needed due to the heavy hauling from the gravel pit. The County schedules
routine maintenance on this stabilization section of road approximately every six
months. If it is apparent that the hauling is creating problems,the County and the
Operator will meet on site and agree on the areas to be repaired and the approximate
repair costs prior to any repairs being done. Then the County will do repair and send
an invoice to the Operator,to be paid within 30 days of Receipt.
4. The Operator will construct the new access to match the grade of WCR 23 in a manner
that will not damage the existing stabilized road bed.
5. The approximate number of trucks vary between five and ten per day utilizing the site
on an as needed basis.

COLORADO SUBJECT: USR-1095; Stanley and Shirley Odenbaugh
The Weld County Public Works Department recommends that the Board of County Commissioners accept the
Road Maintenance and Improvements Agreement from Stanley and Shirley Odenbaugh for their proposed sand
and gravel operation located adjacent to WCR 23 and WCR 32.5. Our legal staff has reviewed the proposal and
Weld County has been working with the Odenbaugh's to work out a reasonable haul route from the facility to the
nearest paved road. We are recommending that this agreement be approved by the Board of County
Commissioners.
