RE: APPROVAL OF RECORDED EXEMPTION #1705 - DOERSCHLAG
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1705, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1705 was submitted by Steve and Sandy
Doerschlag, 36125 Weld County Road 43, Eaton, Colorado 80615, for property which is described
as Lot B of RE #1148, located in part of the E 1/2, SE 1/4 of Section 33, Township 7 North,
Range 65 West of the 6th P.M., Weld County, Colorado, being more particularly described in the
plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded,
and
WHEREAS, this request is to divide the property into parcels estimated to be approximately
1.5 acres and 73.5 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1705 submitted by
Steve and Sandy Doerschlag be, and hereby is, approved conditional upon the following:
1. A Weld County septic permit shall be obtained for the proposed home septic system
and shall be installed according to the Weld County Individual Sewage Disposal
System (ISDS) Regulations.
2. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.
3. No new accesses to either Lot A or Lot B shall be allowed.

Dear Commissioners:
This request for a recorded exemption is submitted by Steve and Sandy Doerschlag. The parcel
of land under consideration is described as Lot B or RE -1148, part of the E2, SE4 of Section 33,
T7N, R65W of the 6th P.M., Weld County, Colorado. The property is located north of and adjacent
to Weld County Road 74, and west of and adjacent to Weld County Road 43. This request is to
divide a 75-acr4 rn nko parcels of 1.5 acres and 73.5 acres, more or less. The applicant has
indicated that they plan to build a home on proposed Lot A. Proposed Lot B will remain in
agricultural production with an existing home.
North Weld County Water District currently provides proposed Lot B with water and is proposed
for Lot A. A septic system currently provides Lot B with sewage disposal and is proposed for Lot
A. The Town of Eaton has reviewed this request and finds no conflicts with their interests. The
Weld County Health Department and Public Works Department have reviewed this request and
both have no conflicts of interest.
The Department of Planning Services' staff has concerns that the proposed division will be
inconsistent with efficient and orderly development and the agricultural goals and policies as stated
in the Weld County Comprehensive plan. Staff also has concerns with the number of recorded
exemptions that have occurred in Section 33, T7N, R65W. Six recorded exemptions have been
approved in Section 33 since 1981.
The subject property is Lot B of RE -1148, which was approved by the Department of Planning
Services' staff in 1989. The approval of RE -1148 divided a 80 -acre parcel, more or less, into 75
and 5 acres, more or less. The applicants are not requesting to further subdivide Lot B of RE -1148,

into two parcels of 1.5 acres and 73.5 acres, more or less. This request, if approved, would allow
for a residence on proposed Lot A, further intensifying the residential uses on the property and
potential reduction of agricultural farm ground. Proposed Lot B contains an existing home and
agricultural farm ground.
Staff is concerned about the level of development that has occurred in this area through the
recorded exemption process and the potential for continued divisions. The Board should consider
whether it wants to allow this type of piecemeal development to continue. Continued divisions of
this type evade the intent and purpose of the Weld County Subidivision Ordinance and the Weld
County Comprehensive Plan.
The Department of Planning Services' staff requests that the Board of County Commissioners
consider this proposal and determine if the standards of Section 11.5.1 through 11.5.7 of the Weld
County Subdivision Ordinance have been met.
