HomeMy WebLinkAbout580198.tiff 6" ,.;A /-- • TO SIGN COOPERATIVE AGREEMENT WITH STATE HIGHWAY DEPARTMENT REGARDING PROJECT S 0053(2): BE IT RESOLVED, by the Board of County Commissioners of Weld County, Colorado, ,that they hereby approve a certain agreement with the State Highway Commission of Colorado, a public corporation, for the use and benefit of the Department of Highways of the State of Colorado, dated March 13, 1958, whereby the County has reviewed and approved the Geometic Standards designated to govern the construction of a Federal Aid Secondary Project to consist of improvements = on State Highway No. 60, extending from about 3.292 miles between Johnstown and - - - Milliken, as per terms of said Agreement on behalf of Weld County by signatures of the Board, as per attached Agreement and made a part of this resolution. THIS AGREEi'ENT entered into this ' 13th- day of March 19 58 , ' by and between the County of Weld , party of the first part, and THE STATE HIGHWAY COMPESSION OF COLORADO, a public corporation, for the use and benefit of the DEPARTMENT OF HIGHWAYS of the STATE OF COLORADO, party of the second . part, NITNESSETH that • WHEREAS, the Department has constructed, or proposes to construct, or provide for the construction of, a project known as Project S 0053(2) approximately 3.292 miles long, extending between Johnstown-and-Milliken on State Highway - No. 60"--in the Countyc.arid'- -- WHEREAS, the said State Highway is part of the Federal Aid Secondary System, NUJ, THEREFORE, in accordance with the Federal Aid Act of 1950, the Parties have jointly reviewed the Geometric Standards governing the type of construction for said Project and have agreed as follows: • That the 19 57 Annual Average Traffic Volume, as determined from actual vehicular count, by the Planning and Research Division of the Department is found to be 1500 vehicles per day. Therefore, in accordance with approved and ._ established practices, the -traffic volume twenty years hence is estimated to be 3150 vehicles per day. Consequently, the type of construction shall be that ; designated as Type B-1 of the Geometric Standards dated August 1, 1952 more ' fully described as follows: ,. In the ultimate constructi the surface shall consist of Plant Mixed .Asphalt 24k . 'feet wide, on a roadway 44 feet wide. ' The maxiMum grade shall be 1.40 percent and the curvature shall not exceed 5 degrees And U minutes. Dear Sir: _ It has become necessary for the Department of Highways to institute eminent domain proceedings to acquire part of the right of way for the construction and/or improvement of State Highway No. 60 • in Weld County. The Department feels that it is advisable to have the County join in such proceedings as party petitioner with the Department. Our standard allegation reflects that the Board of County Commissioners has by resolution approved the subject project and pursuant to law joins therein as a party petitioner. We will, therefore, appreciate your making certain that the minutes of the Board reflect such resolution of approval . By way of sug- gestion, the following sample resolution is furnished: "BE IT RESOLVED, that the Board of County Commissioners of Weld County hereby approves Colorado Depart- ment of Highways Project No. S 0053 (2) , which provides for the improvement of S.H. No. 60 in Weld County, and authorizes the County Attorney to join said Board of County Commissioners as party Petitioner with the Colorado Department of Highways in the event it becomes necessary to acquire needed right of way by__ condemnation, it being understood that all court costs and awards to property owners are to be paid by said Colorado Department of Highways. " (Delete the last portion if the County has agreed to participate in right of way costs . ) This office will appreciate your informing us as soon as the approval is reflected in the Board ' s minutes .
