A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. Prior to recording the plat, the applicant shall: A. Submit evidence to the Department of Planning Services that the existing septic system located on proposed Lot B is permitted through the Weld County Health Department. If the existing system is not currently permitted, the applicant shall submit evidence to the Department of Planning Services that an I.S.D.S. Evaluation has been performed on the system. The owners agree to extend water to this site from Weld County Road 7, and are in negotiations with land owners for easements and participation of construction. See letter from Water District dated September 18, 1995. 2. A package sewage treatment plant is planned to serve this site. This plant will be in compliance with both Weld County Health and Colorado State Health Departments. 3. The property is classified as non -prime farmland with soils subject to erosion and flooding in the low areas. Improvements include a house located near the intersection of Weld County Road 44 and I-25 Frontage Road, and a mobile home located near the northeast corner of the south half of the Southwest Quarter of Section 14. The irrigation ditches are shown on the drawing along with the Little Thompson River. No oil or gas wells exist on the site; however, there are two oil and gas transmission lines located near the east -west center of the 80 acres. 4. The reason for the proposed amended Recorded Exemption is to incorporate the C-4 boundary (30.6 acres) which was zoned in 1985 (see Z425: 85: under Reception #02048879 of Weld County records). The Record Exemption to be amended is #1061-14-3-RE182 recorded under Reception #1668097 of Weld County Records. The C-4 zoned area is planned for a Travel Center with a restaurant, driver's lounge and convenience store, with fueling islands for both 18 - wheelers and automobiles. In addition, a truck shop facility is proposed for maintenance of trucks. There are no plans in the immediate future for the remaining 50 acres. 5. The C-4 zone area, to be called Lot A on the Recorded Exemption, is located in the west 30.6 acres of the south half of the Southwest Quarter of Section 14. It is bounded on the west by I-25 Frontage Road, and on the south by Weld County Road 44. At present, part of the site is irrigated farmland, with the east two-thirds terraced to accommodate low velocities in irrigation of crop lands. 6. We shall comply to placing note on the plat that: "All proposed structures will, and all existing structures do, meet minimum setback and offset requirements for the zone district in which the property is located." This site lies within the growth areas of both Johnstown and Berthoud. Johnstown has already annexed a Quarter section of Section 22 which lies in the southwest intersection of 1-25 and Weld County Road 44. The proposed uses are compatible with surrounding uses, a proposed single-family and commercial development is to be located in the southwest corner of intersection of I-25 and WCR 44. The application is consistent with the Weld County Comprehensive Plan because C-4 zoning should be located at well -planned areas along major highways and thoroughfares. We believe that the agricultural zoning is inappropriate for this site as the land cannot be farmed economically due to the erosion and chemical properties of the land. 10. In meeting with the goals and policies of the C-4 zone district, as laid out in the Zoning Ordinance and the Comprehensive Plan, this proposal is also consistent with the promotion of orderly and integrated development within Weld County. Health Department CASE NUMBER: AMRE-182 NAME: Hank Properties, LLC Environmental Protection Services has reviewed this proposal; the following conditions are recommended to be part of any approval: 1. The Environmental Protection Services Division of the Weld County Health Department was unable to locate a septic permit for the septic system for the house near WCR 44 and I-25 Frontage Road or the mobile home of this application. The smaller parcel is planned to have packaged sewage treatment plant to serve this site. This treatment plant shall comply with all state requirements for a site application permit. Any existing septic system(s) which is not currently permitted through the Weld County Health Department must be permitted. Each unpermitted septic system will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit(s). In the event the system(s) is found to be inadequate, the system(s) must be brought into compliance with current I.S.D.S. regulations. 2. The installation of any septic system within the 100 -year flood plain shall comply with the Weld County I.S.D.S. flood plain policy (attached). In accordance with the Colorado I.S.D.S. Regulations, no septic systems shall be installed within the floodway. Further,the typical operational life of a septic system is 15-20 years. After this time period the lots would likely be developed with out -buildings, corrals, etc. It has been the Department's experience that after development there is not adequate area for replacement system. Therefore, the Department encourages the applicant to designate an appropriate area on the parcel for a replacement septic system. Flood Plain Policy Septic systems will not be allowed. toibe located in the floodway. Septic systems will be allowed in the flood plain, but the system must be installed in a manner as to prevent the infiltration of groundwater into the septic tank and to prevent the release of sewage from the tank during a flood event. If the tank is above the flood plain elevation, no special installation requirements would be necessary. • If the tank is not above the flood plain elevation then the access to the tank manhole lids must be covered with 20 mil PVC and sealed with plumbers cement. When the seal is broken, i.e. the tank is opened for pumping, etc., the tank must be re -sealed prior to backfilling again. A backflow preventer must also be installed in the effluent line between the tank and the absorption field. All other percolation and suitable soil criteria must be met for a conventional septic system to be installed. For inspection purposes, the materialsHo seal the -manhole lids must be on site. Colorado 80513 F ;RECEIVED SEP 2 0 1995 Re: Commitment for Domestic Water Service Dear Mr. Nelson: This letter is in response to your request for information and a water service commitment for the proposed commercial development described as follows: The Northeast Quadrant of the intersection of I-25 and WCR 44. We currently have a 2 1/2" Dia. water line that serves the tap you have referred to on the property located at the intersection of I-25 and WCR 44. We will continue to provide service to all of the taps on this line. You will find that you may have two problems that will need to be addressed in the future planning for your proposed development. 1. Your water needs may not be able to be serve from the existing taps. You should estimate the water usage required to determine if the existing tap can provide the flow required for the development. 2. The fire protection requirements may require that a line extension be built to provide the flows needed at the site. Below is brief summary of the details surrounding the installation of fire hydrants. A. All improvements to District facilities required to provide service will be the financial responsibility of the developer in accordance with the District Rules and Regulations. All improvements must conform to District Specifications. B. The installation of a fire hydrant requires payment of a $2,000 fire hydrant fee prior to installation of the fire hydrants. +M N C. In order to provide any type of fire flow you will be required to do a main line extension to serve the development. Currently Little Thompson Water District is beginning construction of a 12" Dia. water line along WCR 7. This line will be a high pressure ( +220 Psi.) transmission line. You would need to connect to this line and extend it across I-25 to your development. You will also need to construct a pressure reducing vault to reduce the pressure to a range for providing your service.
