RE: DECLARE CERTAIN EVIDENCE AS SURPLUS PROPERTY FOR SHERIFF'S OFFICE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, State statute and the Weld County Administrative Manual require that all
items disposed of be declared surplus by the Board of County Commissioners, and
WHEREAS, Weld County Ordinance 28 describes the procedure by which the Sheriffs
Office shall dispose of unclaimed evidence and seized property, and
WHEREAS, certain unclaimed evidence and seized property, a list of which is attached
hereto and incorporated herein by reference is requested for use by Weld County, and
WHEREAS, the Board deems it advisable to declare said property as surplus and direct
the Sheriff to convert said property for use by the Weld County Bomb Team.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the abovementioned property be, and hereby is, declared surplus.
BE IT FURTHER RESOLVED by the Board that the Sheriffs Office be, and hereby is,
directed to convert said property for use by the Weld County Bomb Team.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 4th day of March, A.D., 1998.

RE: Conversion of Stolen Property
Case Report WC 95-5141
Dear Commissioners:
The Weld County Sheriffs Office, Bureau of Alcohol, Tobacco and Firearms, Westminster Police Department,
Brighton Police Department and Lorimer County Sheriffs Office became involved in a burglary case on November
22, 1995. This culminated in the execution of a federal search warrant and subsequent seizure of several
motorcycles and other property. One of the items seized was a Honda gas generator.
The generator was found to have the serial number and identification tag removed from the frame. This made
identification of the owner impossible. The victims were contacted and identified the stolen motorcycles, however,
no one claimed the generator. This generator has been in our custody since November, 1995.
Manager Richard Bauer contacted agent Kenneth Coffey of the Bureau of Alcohol, Tobacco and Firearms. Agent
Coffey reported all defendants pled guilty in federal court and are currently in federal prison. No charges were filed
in Weld County Court.
We are requesting that the Honda generator be converted to the Weld County Sheriffs Office for use by the Weld
County Bomb Team. This item cannot be sold at auction due to the state statute making it illegal for a citizen to
possess an item with a defaced (removed)serial number.
