RE: APPROVE MUTUAL AID AGREEMENT BETWEEN WELD COUNTY AMBULANCE
SERVICE AND UNION COLONY FIRE RESCUE AUTHORITY AND AUTHORIZE
CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Mutual Aid Agreement between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, on behalf of the Weld County Ambulance Service, and the Union Colony Fire
Rescue Authority, with terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Mutual Aid Agreement between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Weld County Ambulance Service, and the Union Colony Fire Rescue Authority, be, and hereby
is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 14th day of May, A.D., 1997.

MUTUAL MD AGREEMENT
THIS AGREEMENT made and entered into this / T12 -(-day of 1997, b
and between THE COUNTY OF WELD, STATE OF COLORADO, by and thry
Board of
County Commissioners for the County of Weld, acting on behalf of the WELD COUNTY
AMBULANCE SERVICE, (WCAS) located at 1121 M Street, Greeley, Colorado 80631, and the
UNION COLONY FIRE RESCUE AUTHORITY (UCFRA), whose address is 919 7th Street,
Greeley, Colorado 80631.
WCAS AND UCFRA maintain paid and/or volunteer emergency service personnel and
equipment. It is to the mutual benefit of each named agency to assist the other. As a result, both
of the agencies named in this agreement agree to the following:
1. In cases where emergency assistance is requested by either agency, the requested
agency agrees to respond to such request in the form of personnel, facilities, and equipment,
whenever, in the discretion of the responding agency, it is within the ability of the responding
agency to provide such assistance.
2. Signing this agreement does not create an employment relationship between the
agencies. The equipment and personnel responding shall be the responsibility of the individual
agencies, except in the following circumstance:
In the event that an employee of one agency is acting under the authority and
control of the other agency in providing medical care for a patient, the agency in control shall
assume liability set forth in Sections 29-5-108, 109, and 110, C.R.S, as though those particular
sections were applicable to emergency medical service providers. If the agency in control of the
medical care for a patient is WCAS, then the employee of UCFRA acting under the direction of
the WCAS is no longer subject to incident command. In the event that an employee of UCFRA
is requested, and agrees, to assist in driving the ambulance for WCAS, then WCAS assumes
liability pursuant to the applicable No Fault statutes. Any and all above stated liability shall be
subject to the provisions of the Colorado Governmental Immunity Laws.
Each agency shall be responsible for its own equipment and maintenance of equipment.
3. Each agency agrees that the equipment, actions, methods and practices of its
personnel shall conform to the applicable requirements of Colorado law and to acceptable
methods and practices of emergency response services.
4. This agreement may be supplemented with various exhibits setting forth specific
areas of response, protocol, communications, and other procedural matters. These supplements
must be adopted, signed, and dated by both agencies (see Exhibit "A" attached.).
5. This agreement shall supersede and replace any and all previous mutual aid
agreements, contracts and written or oral understandings concerning this subject matter in
existence prior to the execution of this agreement. This agreement shall specifically not
supersede the Intergovernmental Agreement entered into between the County of Weld, by and
through Weld County Ambulance Service, the City of Greeley, Western Hills Fire District, and
the Union Colony Fire Rescue Authority, dated September 23, 1996.
6. No alteration of the terms of this agreement shall be valid unless made in writing
and signed by the authorized representatives of the parties to this agreement.
7. Nothing in this agreement shall be construed to create a cause of action and/or
civil liability remedy in any person not a party to this agreement. This agreement exists for the
sole benefit of the parties to the agreement. This agreement shall not be construed to create a
duty by either party to any third party, where no such duty otherwise existed.
8. This agreement shall take effect upon execution by the authorized representatives
to each party. This agreement shall remain in effect until such time as either agency gives sixty
(60) days advance written notice to the other agency of its intention to terminate or amend.
IN WITNESS WHEREOF, the parties above -named have executed this agreement on the
day and year first written above.
