TO SIGN CORRECTED EASEMENT WITH BERT LOWELL
AND JANET E. LOWELL:
BE IT RESOLVED, by the Board of County Commissioners of Weld
County, Colorado, that they hereby sign the Corrected Easement with
Bert Lowell and Janet E. Lowell, Route 2 Box 178, Greeley, Colorado, in
lieu of the Easement of record in the office of the Weld County Clerk and
Recorder, Book 1338 Page 337, dated August 26, 1952. Correction is hereby
made from Section 34, Township 8 North, Range 66 West of the 6th P.M. Weld
County, to Section 34, Township 6 North, Range 66 West of the 6th P.M. Weld
County, in the set of the SW* of said Section. Reference is hereby made to
the record of the Weld County Clerk and Recorder, Book 1475 page 221 .

by and between Bert Lowell and Janet E. Lowell of Greeley, Route 2, Box 178,
of Weld County, Colorado, parties of the first part, and The County of Weld, in the State of Colorado,
a municipality, party of the second part:
WITNESSETH: The part of the first part, for and in consideration of
- -TWO THOUSAND EIGHT HUNDRED AND FIFTY ($2,850.00) Dollars,
to first part ies in hand paid by the party of the second part, the receipt whereof is hereby confessed
and acknowledged, do hereby bargain, sell and convey unto the party of the second part, its succes-
sors and assigns, the right to remove all gravel, sand and road-making and building material which it
shall be able to remove from the following described lands, situate in the County of Weld and State of
Colorado, to-wit: A tract of land located in the SE* of the SW*: Section 34, Township
6 North, Range 66 West of the 6th Principal Meridian, Weld County, Colorado, described'
as follows: Beginning at 'the Southwest corner of the SE* of the 3W* of said Section
34, Thence N 3° 35' E 464.5 feet, to a point on the South line of the County Road as
now -constructed across said SE4 of the SW$ of said Section 34, Thence N 78° -15' E
462 feet along the South line of said County Road, Thence S 7° -22' E 562.3 feet to
a point on the South line of the SE* of the ..)0, of said Section 34, Thence West 556
feet to the place of beginning, containing 5.9 acres more or less for a term of ten
years; renewable from year to year, for ten additional years, upon payment on or before
annual date of an additional One Hundred ($100.00) Dollars, and for the further con-
sideration that second party will keep said area posted against trespassers and dump-
ing of trash during all the term, and that first parties, or their assigns, may cause
prosecution of persors found ignoring said posting, and that second party will level
up bottom of gravel pit at end of term.
The County of Weld, as a further consideration for this Deed and by acceptance thereof, agrees
that said tract of land shall be excluded from further assessment for taxes; the first part ies hereby
granting to the party of the second part the right to enter upon said lands at any time hereafter and to
excavate and remove therefrom all gravel, sand and earthen material which it shall find suitable to its
needs, together with the rights and privileges incident to the proper enjoyment thereof.
This instrument shall give no title to said land, and shall only give the right to remove therefrom
the part of the surface thereof as hereinabove set forth. This contract shall be binding upon and inure
to the benefit of the heirs, administrators, and assigns of the part ies of the fist part, and the succes-
sors and assigns of the party of the second part.
