THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 24.3 of the Weld County Zoning Ordinance as follows: This proposal is consistent with the Weld County Comprehensive Plan. This land use is located within the Urban Growth Boundary area of the Johnstown and Milliken. The Urban Growth Boundary area section provides for the County to encourage land -use development proposals as long as they conform to the desires of affected municipalities. The town of Johnstown has indicated that they -find no conflicts with this proposal. This proposal is consistent with the intent of the A (Agricultural) zone district and is _provided for as a Use by Special Review. No overlay districts affect the site. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. a EXHIBIT s RECOMMENDATION, USR-1081 Melvin & Janice Callen Page 2 This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding -the request, and responses from referral entities. The Department of Planning Services' staff recommendation for -approval is conditional upon the following: 1. The attached Development Standards for the Special Review permit shall be adopted and placed on the Special Review plat -prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within 15 days of approval by -the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Speci-al Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. A runway safety area measuring 120' wide and 240' beyond each end of the runway shall be maintained to ensure safe operations of aircraft. 4. Access from State Highway 257 shall not change in use. 5. Prior to recording of the plat: a. The plat shall be amended to show the safety area surrounding the runway, as described above in Condition of Approval 3. b. The plat shall be amended to show the 75' right-of-way measure from -the center line of State Highway 257 should expansi-on occur, as indicated in the letter from Gloria Idler, dated April 26, 1995. c. A copy of the amended plat shall be submitted to the Department of Planning Services for review and approval. SITE SPECIFIC DEVELOPMENT PLAN SPECIAL -REVIEW PERMIT DEVELOPMENT STANDARDS Melvin & Janice Callen USR-1081 1. The Site -Specific Development Plan and Special Review permit is for -an a private airstrip in the A (Agricultural) zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development -Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 4. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 5. The property owner or operator shall be responsible for _complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 6. The site shall be maintained in compliance with the Federal Aviation Administration regulations. 7. Access from State Highway 257 shall not change from existing use. 8. A runway safety area measuring 120' wide and extending 2110' beyond each end of the runway shall be maintained to ensure safe operations of aircraft. 9. No commercial use shall be associated with this site without proper permits. 10. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County DEVELOPMENT STANDARDS Melvin & Janice Callen USR-1081 Page 2 Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. 11. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing Standards and all applicable Weld County Regulations. Any other changes shall be filed in the office of the Department of Planning Services. 12. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards Pay be reason for revocation of the Permit by the Board of County Commissioners. I have scheduled a meeting with the Weld County Planning Commission for May 16,1995, at 1:30 p.m. This meeting will take place in the County Commissioners' Hearing -Room, First -Floor, Weld County Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended -hat you -and/or a representative be in attendance to answer any questions the Planninj Commission members may have. It is the policy of Weld County to refer an application to any town or municipality lying within three miles of the property or if the property is located within the comprehensive planning area of a town or municipality.
