RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST EDWARD AND MERLA YOST FOR VIOLATION OF THE
WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Edward and Merla Yost, VI #9600314, are allegedly in violation of the Weld
County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of May, 1997, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Merla Yost, property owner, was present at said hearing,
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until June 13, 1997, to allow adequate time for the property owners to
bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Edward and Merla Yost to remedy the violation of the
Weld County Zoning Ordinance, and any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until June 13, 1997,
to allow adequate time for the property owners to bring the subject property into compliance.

PERMITS. I MET WITH MERLA YOST AT THE TIME OF INSPECTION
AND SHE INDICATED TO ME THAT THE MOBILE HOME WAS TO BE
REMOVED FROM THE PROPERTY WITHIN 30 DAYS. THERE IS A MOVING
PERMIT ATTACHED TO THE MOBILE HOME. A VIDEO WAS TAKEN AT
THE TIME OF INSPECTION.

The uses on the above described property are being considered as a zoning violation of Section 31.2,
31.2.16 and 43 of the Weld County Zoning Ordinance. This is not a use allowed by right in the
Agricultural zone district.
The violation can be corrected by removing the third mobile home from the property or obtaining the
appropriate permits for the mobile home.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have 30 (Thirty)
days from February 18, 1997 to correct this zoning violation. Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the
violation to the County Attorney's office for legal action.

THIS DEED OF TRUST IS DATED MARCH 6, 1995, among EDWARD J. YOST and MERLA F. YOST, whose
address is 19500 WCR #10, HUDSON, CO 80642 (referred to below as "Grantor"); COLORADO STATE BANK OF
DENVER, whose address is 1600 BROADWAY, DENVER, CO 80202-4999 (referred to below sometimes as
"Lender" and sometimes as "Beneficiary"); and the Public Trustee of WELD County, Colorado (referred to
below as "Trustee").
CONVEYANCE AND GRANT. For valuable consideration, Grantor hereby Irrevocably grants, transfers and assigns to Trustee for the benefit of
Lender as Beneficiary all of Grantor's right, title, and interest in and to the following described real property, together with all existing or subsequently

THENCE N89 28'W, 925.0 FEET; THENCE SO 26'W, 37.7 FEET, THENCE N89 43'W, 1254.9 FEET TO THE
TRUE POINT OF BEGINNING; THENCE N89 43'W, 418.3 FEET; THENCE SO 30'W, 945.0 FEET; THENCE
S89 34'E, 418.8 FEET; THENCE NO 29'E, 946.1 FEET TO THE TRUE POINT OF BEGINNING.
The Real Property or Its address is commonly known as 19500 WCR #10, HUDSON, CO 80642.
Grantor presently assigns to Lender (also known as Beneficiary in this Deed of Trust) all of Grantor's right, title, and Interest in and to all present and
future leases of the Property and all Rents from the Property. In addition, Grantor grants Lender a Uniform Commercial Code security interest in the
Rents and the Personal Property defined below.
DEFINITIONS. The following words shall have the following meanings when used in this Deed of Trust. Terms not otherwise defined in this Deed of
Trust shall have the meanings attributed to such terms in the Uniform Commercial Code. All references to dollar amounts shall mean amounts in lawful
money of the United States of America.
Beneficiary. The word "Beneficiary" means COLORADO STATE BANK OF DENVER, its successors and assigns. COLORADO STATE BANK OF
DENVER also Is referred to as tender' in this Deed of Trust.
Deed of Trust. The words Teed of Trust" mean this Deed of Trust among Grantor, Lender, and Trustee, and includes without limitation all
assignment and security interest provisions relating to the Personal Properly and Rents.
Grantor. The word "Grantor" means any and all persons and entities executing this Deed of Trust, including without limitation EDWARD J. YOST
and MERLA F. YOST.
Guarantor. The word "Guarantor" means and includes without limitation any and all guarantors, sureties, and accommodation parties in
connection with the Indebtedness.
Improvements. The word "Improvements" means and includes without limitation all existing and future improvements, fixtures, buildings,
structures, mobile homes affixed on the Real Property, facilities, additions, replacements and other construction on the Real Property.
Indebtedness. The word "Indebtedness" means all principal and interest payable under the Note end any amounts expended or advanced by
Lender to discharge obligations of Grantor or expenses incurred by Trustee or Lender to enforce obligations of Grantor under this Deed of Trust.

Lender. The word 'Lender" means COLORADO STATE BANK OF DENVER, its successors and assigns.
Note. The word "Note" means the Note dated March 6, 1995, in the principal amount of $83,384.37 from Grantor to Lender.

Personal Property. The words 'Personal Property' mean all equipment, fixtures, end other articles of personal property now or hereafter owned
by Grantor, and now or hereafter attached or affixed to the Real Property; together with all accessions, parts, and additions to, all replacements of,
and all substitutions for, any of such property; and together with all proceeds (including without limitation all insurance proceeds and refunds of
premiums) from any sale or other disposition of the Property.
Properly. The word "Property' means collectively the Real Property and the Personal Property.
Real Property. The words "Real Property' mean the property, interests and rights described above in the "Conveyance and Grant" section.

documents, whether now or hereafter existing, executed in connection with the Indebtedness.
Rents. The word "Rents" means all present and future rents, revenues, income, issues, royalties, profits, and other benefits derived from the
Property.
Trustee. The word "Trustee" means the Public Trustee of WELD County, Colorado.
THIS DEED OF TRUST, INCLUDING THE ASSIGNMENT OF RENTS AND THE SECURITY INTEREST IN THE RENTS AND PERSONAL
PROPERTY, IS GIVEN TO SECURE (1) PAYMENT OF THE INDEBTEDNESS AND (2) PERFORMANCE OF ANY AND ALL OBLIGATIONS OF
GRANTOR UNDER THE NOTE, THE RELATED DOCUMENTS, AND THIS DEED OF TRUST. THIS DEED OF TRUST IS GIVEN AND ACCEPTED
ON THE FOLLOWING TERMS:
PAYMENT AND PERFORMANCE. Except as otherwise provided in this Deed of Trust, Grantor shall pay to Lender all amounts secured by this Deed of
Trust as they become due, and shall strictly and in a timely manner perform all of Grantor's obligations under the Note, this Deed of Trust, and the
Related Documents.
POSSESSION AND MAINTENANCE OF THE PROPERTY. Grantor agrees that Grantor's possession and use of the Property shall be governed by the
following provisions:
Possession and Use. Until the occurrence of an Event of Default. Grantor may (a) remain in possession and control of the Property, (b) use,
operate or manage the Property, and (c) collect any Rents from the Property.
Duty to Maintain. Grantor shall maintain the Property in tenantable condition and promptly perform all repairs, replacements, and maintenance
necessary to preserve its value.
