SUBJECT: Swimming Pool at Naill Ranch
I was recently contacted by Penny Naill concerning the installation of an in-ground swimming pool. The
purpose of this pool is for visitors at their bed and breakfast in northeast Weld County. The Naill's are
currently in the process of applying for a Special Use Permit (USR)through the County. Building permits
for various amenities at the facility have been obtained and work has commenced. Ms. Naill explained that
a portion of the work has already been completed on the swimming pool. It is anticipated this portion of
the project will be completed in time for the summer season.
According to the"Swimming Pool and Mineral Bath Regulations"this pool is considered a Semi-Public pool
and is therefore not regulated under these regulations. The definition of a Semi-Public Pool is, a pool
associated with hotels,motels,country clubs,health clubs and mobile home parks. It appears the Naiill pool
would therefore not be regulated under the aforementioned regulations.
In the future, prior to any building permits being issued to anyone installing a pool or making any changes
to a swimming pool they should be referred to Environmental Protection Services. At that time a
determination can be made as to whether or not the facility needs to meet the requirements of the
regulations. This should help ensure construction is completed according to the regulations, if the facility
is regulated.
