HomeMy WebLinkAbout962020.tiff HEARING CERTIFICATION DOCKET NO. 96-16 RE: ASSESSMENT OF COSTS OF IMPROVEMENTS FOR ROTH SUBDIVISION LOCAL IMPROVEMENT DISTRICT #1995-1 A public hearing was conducted on November 6, 1996, at 9:00 a.m., with the following present: Commissioner Barbara J. Kirkmeyer, Chair Commissioner George E. Baxter, Pro-Tern Commissioner Dale K. Hall Commissioner Constance L. Harbert Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Public Works Department representative, Drew Scheltinga The following business was transacted: I hereby certify that pursuant to a notice dated October 1, 1996, and duly published October 3, 1996, in the North Weld Herald, a public hearing was conducted to consider the assessment of costs for the Weld County Roth Subdivision Local Improvement District#1995-1. Lee Morrison, Assistant County Attorney, made this a matter of record and stated he is not aware of any objections being received. He noted formal notice was mailed to all property owners, and the draft resolution has been corrected to reflect the effective date as November 15, 1996, with the whole assessment payable without interest until December 15, 1996. Drew Scheltinga, Engineer for the Public Works Department, confirmed the improvements have been completed and noted his red- line changes as he reviewed overhead displays, previously marked as Exhibit E, since the project was completed for less than the estimated amount. Mr. Scheltinga stated the total cost was $86,460.40; therefore, assessments will be $1,729.12 per lot. He then reviewed the table of estimated payments over ten years, at 6.25-percent interest, and noted the assessment was divided equally among the 50 lots. Mr. Scheltinga clarified one letter from Harry D. and Debra A. Bruntz, Exhibit M for the record, was received indicating they access onto Weld County Road 76; and Mr. Maeda, who is present and owns two lots, has verbally requested only one assessment. Commissioner Harbert confirmed that if Bruntz's lot is removed and Maeda's assessment is decreased to one, it increases the amount of all other assessments. Mr. Scheltinga clarified Lots 3 through 7 and 48 and 49 are not being assessed because they are not adjacent to the 962020 Ce : PC2) SD0050 HEARING CERTIFICATION-ASSESSMENT OF COSTS FOR ROTH SUBDIVISION LID#1995-1 PAGE 2 improvements. Ron Maeda, property owner of two lots, corrected his address from P.O. Box 1469 to P.O. Box 6711 and stated he owns Lots 40 and 41; however, he requests they be assessed as one property since they have only one home on both lots. Discussion was held concerning Mr. Maeda's address change, and Mr. Morrison questioned whether there was anything to prevent the second lot from being developed. Mr. Maeda stated there is not; however, he has no plans of moving. Responding to questions from the Board, Mr. Morrison clarified the Assessor's Office included the value of both lots in one assessment; however, that does not affect the ability to develop the other lot. Harry Bruntz, property owner, stated his property is approximately four feet below the road, and it is very improbable that they will ever access the improved road in the future. After further discussion, the Board concurred Mr. Bruntz will benefit from the improvements by receiving less dust. Mr. Scheltinga confirmed the apportionment per lot is $1,729.12 and responded to further questions from the Board. Commissioner Hall moved to approve the assessment of Weld County Roth Subdivision Local Improvement District #1995-1, as recommended by staff. He recognized Mr. and Mrs. Bruntz's point but reiterated they will benefit from less dust, and he also reiterated that Mr. Maeda has two lots, one of which may be sold; therefore, he has two benefits. Commissioner Baxter seconded the motion, and Mr. Morrison clarified the corrected resolution reflects the window in which to make the full payment of the assessment with no interest is between November 15, and December 15, 1996. The motion then carried unanimously.
