McNaney, 32852 Weld County Road 13, Windsor, Colorado 80550, for property which is described as Lot A of RE #1199, located in part of the NW% of Section 19, Township 6 North, Range 67 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 4.00 acres and 2.73 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1802 submitted by Clement McNaney be, and hereby is, approved conditional upon the following: 1. Prior to recording the plat, a note shall be placed on the mylar as follows: A Flood Hazard Development Permit will be required for any new construction or the substantial improvement of existing structures in the Floodway or Floodprone District located on the property. 2. Prior to recording the plat, the applicant shall apply for a proper zoning permit for the mobile home located on Lot A. The mobile home will require a zoning permit for a mobile home to be used as a principal dwelling. 3. Any existing septic system(s) which is not currently permitted through the Weld County Health Department will require an Individual Sewage Disposal System (ISDS) evaluation prior to the issuance of the required septic permit(s). McNaney. The parcel of land is described as Lot A of RE -1199 located in the NW4 of Section 19, T6N, R67W of the 6th P.M., Weld County, Colorado. The property is located east of and adjacent to Weld County Road 13 and approximately 1/4 miles south of State Highway 392. This request is to divide Lot A of RE -1199 into two lots of 4 acres and 2.73 acres, more or less. RE -1199 was approved by the Department of Planning Services' staff on September 2, 1989. RE - 1199 created two lots of 46.2 acres and 6.725 acres, more or less. The applicant is now requesting to further subdivide the 6.725 acre parcel into two lots of 4 acres and 2.73 acres, more or less. The applicant has stated in the application that the reason for the request is to separate the existing dwellings and allow for the farm help to own their own property. Currently both proposed lots contain a home. Proposed Lot A contains a mobile home and proposed Lot B has a stick built home on it. The applicant is not requesting any changes to the existing property. No new building sites will be created with this request. North Weld County Water District ist he current water source for both lots A and B. Deptic systems are the current sewage disposal for both proposed lots. Access to both lots is existing onto Weld County Road 13. The property is located in the Urban Growth Boundary Area of the Town of Windsor.
