RE: APPROVE AMENDMENT TO AGREEMENT FOR INTAKE SCREENING OF WELD
COUNTY JUVENILES IN CUSTODY AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Amendment to Agreement for Intake
Screening of Weld County Juveniles in Custody between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Sheriff's Office, and Weld Adolescent Resources, Inc., with terms and conditions being as
stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Amendment to Agreement for Intake Screening of Weld
County Juveniles in Custody between the County of Weld, State of Colorado, by and through
the Board of County Commissioners of Weld County, on behalf of the Sheriff's Office, and Weld
Adolescent Resources, Inc., be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 31st day of December, A.D., 1997.

AMENDMENT TO AGREEMENT FOR INTAKE SCREENING
OF WELD COUNTY JUVENILES IN CUSTODY
THIS AMENDMENT TO AGREEMENT, made and entered into this 31st day of December,
1997, by and between Weld County, Colorado, a body corporate and politic of the State of Colorado,
by and through the Board of County Commissioners of Weld County, on behalf of the Weld County
Sheriff, whose address is 915 Tenth Street, Greeley, Colorado 80631, hereinafter referred to as
"County," and Weld Adolescent Resources, Inc., whose address is 2116 24th Street, Greeley,
Colorado 80631, hereinafter referred to as "Contractor."
WITNESSETH:
WHEREAS, on May 19, 1997, County and Contractor entered into an Agreement for Intake
Screening of Weld County Juveniles in Custody, and
WHEREAS, since that date, the Platte Valley Youth Services Center has opened, thereby
requiring a change to the services to be rendered and the fees to be paid in the original Agreement
between the parties, and
WHEREAS, the purchase of such services by County from Contractor is in the best interest
of the people of the County of Weld, State of Colorado.
NOW, THEREFORE, in consideration of mutual promises and covenants contained herein,
the parties hereto agree to amend their Agreement for Intake Screening of Weld County Juveniles
in Custody, as follows:
Delete all of Paragraph 1. of said Agreement, entitled "SERVICES TO BE
RENDERED," and add the following:
1. SERVICES TO BE RENDERED: Contractor agrees to perform professional
services set forth in Exhibit "A" entitled "Description of Juvenile Intake Services for
the 19th Judicial District" and dated December 4, 1997, which is attached hereto and
is made a part of this Agreement. All work performed by and under the direction of
the Contractor shall be consistent with the highest standards of care and in strict
compliance of all applicable federal, state, and local laws, regulations, and
procedures which may from time to time be adopted or amended.
Delete all of Paragraph 4. of said Agreement, entitled "PROFESSIONAL FEES," and
add the following:
4. PROFESSIONAL FEES: In consideration of the terms and obligations of this

Agreement, County agrees to pay and Contractor agrees to accept, as full and
complete compensation for all services rendered under this Agreement a total sum
not to exceed $64,400.00, payable as follows:
a. Equal monthly installments of $5,125.00, due and payable on the last
day of each month, beginning July 1, 1997, and continuing to and until
December 31, 1997, and then equal monthly installments of $5,608.33,
due and payable on the last day of each month, beginning January 1,
1998, and continuing to and until June 30, 1998.
b. The consideration set forth in subparagraph "a." above shall be the entire
amount of compensation to be paid by County for the services
contemplated herein. Contractor agrees that any modification or revision
within the annual program budget in excess of 10 percent by existing
categories shall be submitted to County for written approval prior to
implementation by Contractor.
All the remaining provisions set forth in said Agreement shall remain the same.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement this 31st day of
December, 1997.

DESCRIPTION OF JUVENILE INTAKE SERVICES FOR THE 19TH JUDICIAL
DISTRICT
TO: Weld County Sheriff's Office
From: Weld Adolescent Resources, Inc. — Jesse Quinby
Date: December 4, 1997
All described services, subject to specific conditions listed herein, will be available to
any Weld County law enforcement agency upon request 24 hours daily for the duration of
this agreement, except for the transportation of juveniles to Platte Valley Youth Services
Center, (PVYSC) which service is limited to the county of Weld, city of Greeley, and city
of Evans.
Services will be provided within the Juvenile Receiving Center (JRC) located at 915
10th Street, Weld County Centennial Center. The Weld County Sheriff will provide
equipment, supplies, facilities, and materials to the Contractor that is reasonably
sufficient to deliver the described services within the JRC. In addition the Weld County
Sheriff's Office will provide vehicle and associated insurance for the transport of
juveniles s screened to detention at PVYSC.
The standards for performance related to accuracy, adequacy, and routing of
documents and data entry related to the booking and/or release process will be to the
satisfaction of the Weld County Sheriff's Office designated Records Custodian for
Criminal Justice records.
Training in data entry and on -going procedural updates will be provided to Contractor
by Weld County Sheriffs Office Records Department.
OVERVIEW OF SERVICES
The Contractor will provide the following intake/booking/release processing services,
and transportation services:
1. Response to the JRC within 20 minutes of notification.
2. Accurate data entry of all necessary demographic, arresting agency/officer, charge,
court appearance, and disposition data into the Jail Management System (JMS)
computer necessary to complete the booking and/or release process.
3. Obtain classifiable inked fingerprints on a ten -print fingerprint card for each booking
(2 sets for felony arrests, 1 set for all other arrests).
4. Obtain one photographic array -quality digital image of each person booked.

5. Accurate completion and routing of all booking and court documents and related
materials necessary to disposition physical custody of a juvenile including, but not
limited to, the following dispositions:
• Detention
• Release to placement
• Release by promise to appear personal recognizance, cash or surety bond.
6. Supervision of juveniles transferred to our custody pending disposition.
7. If the juvenile is appropriate for detention, and space is not available at PVYSC the
pre -arranged procedures for this circumstance, as dictated by the court, shall be
followed.
8. Transportation from the point of intake screening to the Midway Staff Secure Shelter
shall be provided by the contractor. (WCSO to perform all court transports)
9. Transportation of juveniles screened to detention at PVYSC for the following
agencies: Weld County Sheriffs Office, Greeley Police Department and Evans Police
Department.
10. Update and maintain written Juvenile Justice Delinquency Prevention Act compliance
log with information necessary for inspection by the State of Colorado Division of
Criminal Justice.
11. Provide monthly general JRC activity statistics in a format approved by the Weld
County Sheriff's Office.
ORGANIZATION AND ADMINISTRATION
Fiscal Records: We shall maintain all fiscals, financial, payroll and budget records on
computer using Quickbooks Pro software. We shall print on hard copy comprehensive,
end of month, quarter and year financial reports. These reports shall include all direct
and indirect overhead charges to Weld County. All of our reports, fiscal and otherwise,
shall be available to Weld County upon their request.
We shall maintain adequate fiscal records for a period of three years following the
termination of our contract with Weld County. These records shall be available for audit
by Weld County, the State of Colorado, or its designees.
Personnel Policies and Procedures: We agree to maintain and make immediately
available to Weld County Colorado at any time upon request our personnel policies and
procedures which include policies on nondiscrimination concerning race, creed, color,
religion, and natural origin. We intend to adopt Weld County's personnel policies as
they relate to nondiscrimination concerning race, creed, color, religion and natural origin.

Monitoring of Program Operations: I agree to have our program operations and
services monitored by Weld County on a regular basis and agree to participate in any
monitoring upon request.
Liability Insurance: I shall maintain in full force and effect at all times during the
course of this contract Comprehensive General Liability Insurance written on an
occurrence basis, with a minimum of $400,000.00 combined single limit for bodily injury
and property damage arising out of any single occurrence. Any aggregate limit will not
be less than $1 million. I shall furnish Weld County with written certification of the
existence of such liability insurance and a copy of the policy endorsement naming the
State of Colorado or Weld County as additional insureds, prior to finalization of contract
provisions. If the State of Colorado or Weld County approves in writing the alternative
use of "claims made" insurance for Comprehensive General Liability, I also agree to
maintain beyond contract term such insurance as will cover incidents which occurred
during the contract period, including but not limited to continued maintenance of "claim
made" or "tail" policies for the applicable statute of limitations. The policies will be
equal amounts equal to or greater than the limits required by the contract.
Workers' Compensation and Unemployment Compensation Insurance: I shall at all
times keep in force Workers' Compensation and Unemployment compensation Insurance
in accordance with the general provisions noted in the request for proposal on which I am
responding to.
Increase of Annual Program Budget: I agree to submit to Weld county for written
approval any modification or revision within the annual program budget in excess of 10
percent by existing category prior to implementation by myself
Independent Contractor Status: I shall perform all of the duties herein as an
independent contractor and not as an employee. I shall be accountable to Weld County
for the ultimate results of my agents and my actions but my agents and I shall not be
subject to direction and control of Weld County as to details or particular hours of work
except as provided in the request for proposal. Neither I nor any agent or employee of
mine shall be deemed an agent or employee of Weld County. I shall pay when due all
required unemployment taxes, and income tax withholdings, shall provide and keep in
force workers' compensation (and show proof of such insurance) and unemployment
compensation insurance, all in the amounts required by law, and shall be solely
responsible for the acts of myself, my employees and agents. I shall furnish Weld
County with written certification of the existence of such coverage, prior to the
finalization of contract provisions.
Errors and Omissions: I agree that Weld county shall not be held liable for any error
or omission of employees, agents, or mine in providing services hereunder. To the
extent authorized by law, I agree to indemnify and hold harmless Weld County, its
employees and agents, and officers against any and all claims, demands, damages,
liabilities, and court awards including costs, expenses, and attorney fees incurred as the

result of any act or omission of any officer, agent or employee of myself or resulting
from the condition of any property owned or controlled by myself
Termination of Contract: I agree that any contractual agreement formulated as a result
of the request for proposal and my herein response, may be terminated by either party by
giving 30 days notice in writing, delivered by certified mail, return receipt requested, to
the other party. If notice is so given, any contractual agreement reached shall terminate
on the expiration of the thirty days, and the liability of the parties hereunder for the
further performance of the terms of this contract shall thereupon cease, but the parties
shall not be relieved of the duty to perform their obligations up to date of termination.
*Services formerly provided such as Intake Screening/Assessment and Alternative
Placement will continue to be provided and funded through SB94.
