Approved with Conditions The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of the County. 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. Prior to recording the plat, the applicant shall: A. The Environmental Protection Services Division of the Weld County Health Department was unable to locate septic permits for any of the septic systems which are currently serving structures involved in this application. Any existing septic system(s) which is not currently permitted through the Weld County Health Department must be permitted. Each unpermitted septic system will require an (17 -2c")/I i • I.S.D.S. Evaluation prior to the issuance of the required septic permit(s). In the event the system(s) is found to be inadequate, the system(s) must be brought into compliance with current I.S.D.S. regulations. B. The applicant shall submit to the Weld County Health Department a designated area on both Lots A and B for a replacement septic system. After approval by the Health Department, the replacement septic areas shall be clearly delineated on the plat. C. All access shall be clearly shown on the plat. D. The plat shall show a 75' (foot) right-of-way from the center line of State Highway 85. 3. The following notes shall be placed on the plat: A. All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. B. All construction or improvemnts occurring in the floodplain shall comply with the Flood Hazard Overlay District requirements of the Weld County Zoning Ordinance, Section 26. 4. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. As an alternative, Northern Water C -BT facilities inclusion fee may be calculated as the total amount of ad valorem taxes on the property and improvements to be included which would have been collected by Northern Water under its annual historic mill levy had the lands been included in Northern Water from 1937 to the date of the petition for inclusion. The petition to Northern Water for inclusion, if this alternative is selected by petitioner, shall be accompanied, or supplemented by, a certified list of annual assessed valuations on the property and improvements to be included from 1937 to the date of the petition for inclusion. 3. In its discretion in individual cases involving a large number of individual parcels of property to be included, the Board may permit the method described in Section 2 above to be applied to a representative sample of the parcels of property to be included to determine a factor that would then be applied to the current assessed valuation of all of the property and improvements to be included. 4. Satisfactory arrangements for payment of fees must be made with Northern Water before the inclusion will be approved by the Board of Directors. 5. The previous Board Resolution D-986-02-97 is hereby repealed. The two house wells are permitted at 50 GPM and 50.8 GPM and the irrigation well is registered at 800 GPM. 2. A statement about adequate disposal of sewage. There are two existing homes on the property both homes are located in 'Parcel A' as amended. Both homes have existing septic systems that are believed to be adequate and in compliance with Weld County Health Department. 3. A description of how the property is being used. The property is currently being used as two home sites, with the balance in agriculture production. 4. The reason for the AMENDED RECORDED EXEMPTION. The original RE that was done by previous owners split the buildings of the South improvements. Part of the South improvement are in Parcel 'A' and part are in Parcel 'B'. This is unsatisfactory to the present owner. We are asking for an Amended RE to include all of the improvements in Parcel 'A'. 5. A description of the location. size, and present use. The 58+ acre site is now split into two sites of Lot 'A' with 23.266 acres and Lot 'B' with 35.149 acres. This was done by the original Recorded Exemption in 1982. This Amended RE is being done to take .85 acre from Lot 'B' and add it to Lot 'A' to keep all of the improvements on Lot 'A'. 6. All existing improvements will meet required setbacks and off sets for agriculture zoning. 7. A statement that the proposal is consistent any municipal plan and any inter government agreements. The property is within the growth boundaries of Fort Lupton, therefore this plan may need to be submitted to the City of Fort Lupton for their input. This plan is believed to be compatible and consistent with all City and Weld County plans. 8. How will the proposed uses be compatible with surround land uses. The surrounding land uses are also agriculture with the exception of the property across the Four Lane Highway and to the North which is used as an Amoco Service Station. 9. Explain how the proposal is consistent with the intent of the district. The subject property is in an agricultural district and will remain in an agriculture district. No intended change of use desired. 10. Explain how the proposal is consistent with efficient and orderly development. The Environmental Protection Services Division of the Weld County Health Department was unable to locate septic permits for any of the septic systems which are currently serving structures involved in these applications. Any existing septic system(s) which is not currently permitted through the Weld County Health Department must be permitted. Each unpermitted septic system will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit(s). In the event the system(s) is found to be inadequate, the system(s) must be brought into compliance with current I.S.D.S. regulations. In addition, the typical operational life of a septic system is 15 to 20 years. After this time period the lots would likely be developed with out -buildings, corrals, etc. It has been the Department's experience that after development there is not adequate area for replacement systems. RIGHT -OP -WAY Right-of-way (ROW) has not been addressed by the proposal. Projected traffic along this portion of State Highway (SH) 85 indicates the need for a 150 foot total right-of-way, 75 feet each side of the highway centerline. Additional width to meet the projected need should be protected by reservation or preferably, dedication as permitted by County regulations. ACCESS It does not appear that additional access is being requested with this proposal. That would be appropriate, as no additional access would be allowed. Any plans to develop this property will require further review by our office. My comments are based upon the submittal as received April 11, 1997.
