RE: VIOLATIONS OF THE WELD COUNTY ZONING ORDINANCE
A public hearing was conducted on December 12, 1995, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that a public hearing was conducted to consider whether to authorize the County
Attorney to proceed with legal action against the individuals named for violations of the Weld County
Zoning Ordinance. Bruce Barker, County Attorney, made the following cases a matter of record.
VI #2235 - CALDERON: Susan McMullen, Department of Planning Services, reported this case
closed.
VI #2238 - WEATHERLY: Ms. McMullen reported this case closed.
VI #2240 - BRESSIEUX: Ms. McMullen referred to the inspection report dated December 11, 1995,
indicating the property is in violation of Sections 31.2 and 31.3.9 of the Zoning Ordinance due to an
unscreened, noncommercial junkyard which consists of one derelict vehicle. She stated Mr.
Bressieux indicated he would have the vehicle removed within one week, but he has been ill;
therefore, she recommended he be allowed two weeks. Commissioner Harbert moved to delay
referral of VI #2240 against Jean Pierre Bressieux to the County Attorney for legal action for two
weeks, to allow removal of the derelict vehicle. Commissioner Kirkmeyer seconded the motion,
which carried unanimously.
VI #2241 - GERDE: Ms. McMullen referred to the inspection report dated December 11, 1995,
indicating the property is in violation of Sections 31.2 and 31.4.8 of the Zoning Ordinance because
there is a kennel on the property. She stated there are six dogs on the property, two of which belong
to Mrs. Gerde's daughter who was in a traffic accident and has been hospitalized since
November 18, 1995. Ms. McMullen stated the property owners are allowed four dogs and noted Ms.
Gerde has been very cooperative. After discussion, Commissioner Harbert moved to delay referral
of VI #2241 against Lynne and Percy Gerde until February 1, 1996, to remove two of the dogs.
Commissioner Kirkmeyer seconded the motion, which carried unanimously.

VI #2242 - TROSTEL: Ms. McMullen referred to the inspection report dated December 11, 1995,
indicating the property is in violation of Sections 31.2 and 31.3.9 of the Zoning Ordinance due to an
unscreened, noncommercial junkyard consisting of several derelict vehicles. She stated Mr. Trostel
indicated some of the vehicles were owned by others and requested until January 30, 1996, to
remove them. Ms. McMullen noted Mr. Trostel also collects antique tractors, which are not a
violation. Commissioner Kirkmeyer moved to delay referral of VI #2242 against Timothy and Mary
Trostel to February 1, 1996, to allow removal of the derelict vehicles. Commissioner Webster
seconded the motion, which carried unanimously.
VI #2243 - LANGLEY: Ms. McMullen referred to the inspection report dated December 11, 1995,
indicating the property, which is in Larson Subdivision near Evans, is in violation of Sections 31.2
and 31.3.9 of the Zoning Ordinance due to an unscreened, noncommercial junkyard consisting of
a derelict truck and miscellaneous trash, scrap metal, tires, and plastics. She stated the owners
have done some cleanup and have been fairly cooperative, indicating most of the remaining cleanup
is trash and the derelict truck with a flat tire. Ms. McMullen also stated the owners requested two
months to complete the cleanup since he is a truck driver and his wife works. In response to
Commissioner Harbert, Ms. McMullen confirmed the owners are tenants on the property, which is
owned by Mrs. Langley's mother, and all are aware the next step is to go to court on the matter. She
further stated there were five dogs on the property, which number has been reduced, and the rest
of the cleanup should not take much time. After discussion, Commissioner Harbert moved to delay
referral of VI #2243 against Hugh and Nadine Langley until February 1, 1996, to allow time for
completion of the cleanup of the property. Commissioner Kirkmeyer seconded the motion, which
carried unanimously.
This Certification was approved on the 18th day of December, 1995.
